AN ACT

RELATING TO STATE VEHICLES; REQUIRING THE TRANSPORTATION SERVICES DIVISION OF THE GENERAL SERVICES DEPARTMENT TO PURCHASE ELECTRIC VEHICLES IN A MANNER IN WHICH THOSE VEHICLES WOULD CONSTITUTE AT LEAST SEVENTY-FIVE PERCENT OF ALL STATE VEHICLES BY JANUARY 1, 2030; REQUIRING RULEMAKING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 15-8-7 NMSA 1978 (being Laws 1994, Chapter 119, Section 7) is amended to read:

     "15-8-7. PURCHASE OF STATE VEHICLES--PROCUREMENT CODE--EQUIPMENT.--

          A. All state vehicle purchases shall be pursuant to the provisions of the Procurement Code. All purchases of state vehicles, even those not assigned to the motor pool, shall be approved by the director.

          B. Subject to legislative appropriations and directives and the approval of the secretary, the director shall determine the type and number of state vehicles to be purchased each year and how they shall be equipped.

          C. The division shall, pursuant to rules established by the general services department, create a plan for and purchase electric vehicles in a manner in which those vehicles would constitute at least seventy-five percent of all state vehicles by January 1, 2030. The general services department shall establish those rules by December 31, 2023.

          D. As used in this section, "electric vehicle" means a motor vehicle or plug-in hybrid electric vehicle with four wheels that:

                (1) is made by a manufacturer;

                (2) is manufactured primarily for use on public streets, roads or highways;

                (3) has not been modified from the original manufacturer specifications;

                (4) is rated at not less than two thousand two hundred pounds unloaded base weight and not more than eight thousand five hundred pounds unloaded base weight;

                (5) has a maximum speed capability of at least sixty-five miles per hour; and

                (6) is propelled to a significant extent by an electric motor that draws electricity from a battery that:

                     (a) has a capacity of not less than four kilowatt-hours; and

                     (b) is capable of being recharged from an external source of electricity."
