    Your CONSERVATION COMMITTEE, to whom has been referred


SENATE BILL 165


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 5, line 24, strike ", including" and insert in lieu thereof "that ensures that every rate made, demanded or received shall be just, fair and reasonable and".


    2. On page 6, between lines 4 and 5, insert the following new paragraph:


             "(5) a complaint process that provides a customer with an opportunity to make a written complaint regarding the adoption of just, fair and reasonable rates, provide factual information to support the complaint and obtain a written response;"


    3. Renumber the succeeding paragraphs accordingly.


    4. On page 6, line 15, strike "and".


    5. On page 6, line 17, strike the period and insert in lieu thereof "; and".


    6. On page 6, between lines 17 and 18, insert the following new paragraph:


             "(3) approve the implementation plan if the commission finds that the local choice energy provider has complied with the requirements in Subsection A of this section.".


    7. On page 16, line 7, after "services", insert ", including services for and relating to power,".


    8. On page 16, line 20, strike "one hundred eighty days" and insert in lieu thereof "one year".


    9. On page 17, between lines 20 and 21, insert the following new paragraph:


             "(3) the verification of appropriate professional licensure;".


    10. Renumber the succeeding paragraphs accordingly.,



and thence referred to the JUDICIARY COMMITTEE.
