AN ACT

MAKING AN APPROPRIATION TO THE DEPARTMENT OF ENVIRONMENT TO PLAN, DESIGN, CONSTRUCT, REPLACE AND IMPROVE WATER LINES IN TRUTH OR CONSEQUENCES IN SIERRA COUNTY; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. TEMPORARY PROVISIONS--FINDINGS OF EMERGENCY.--The legislature finds that this act is of the utmost importance and that an emergency shall be declared because of water line leaks that are causing the city of Truth or Consequences to lose more than twenty million gallons of water, or forty-three percent of its total water, per year.

     SECTION 2. APPROPRIATION.--Twenty million dollars ($20,000,000) is appropriated from the general fund to the department of environment for expenditure in fiscal years 2023 through 2027 to plan, design, construct, replace and improve water lines in Truth or Consequences in Sierra county. Any unexpended or unencumbered balance remaining at the end of fiscal year 2027 shall revert to the general fund.

     SECTION 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
