AN ACT

MAKING AN APPROPRIATION TO THE HEALTH CARE AUTHORITY DEPARTMENT TO INCREASE THE RECOMMENDED LIMIT ON ENVIRONMENTAL MODIFICATION SERVICES FOR ELIGIBLE MEDICAID RECIPIENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION.--

          A. Five million two hundred twenty-nine thousand nine hundred dollars ($5,229,900) is appropriated from the general fund to the health care authority department for expenditure in fiscal year 2025 and subsequent fiscal years to increase the recommended limit on environmental modification services for eligible medicaid recipients to fifteen thousand dollars ($15,000) every five years. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.

          B. If federal approval is necessary to increase the recommended limit on environmental modification services for eligible medicaid recipients, the health care authority department shall request such approval no later than July 1, 2024.

          C. On August 1, 2024 and on February 1, 2025, the health care authority department shall provide a written report on the department's use of this appropriation to the legislative council service for distribution to the appropriate interim or standing committee.
