AN ACT

RELATING TO PUBLIC SCHOOLS; AMENDING CLASS AND TEACHING LOADS; REQUIRING THE PUBLIC EDUCATION DEPARTMENT TO CREATE AND MAINTAIN AN ONLINE PORTAL TO RECEIVE CONFIDENTIAL REPORTS OF CLASS LOAD VIOLATIONS; PROVIDING CLASS LOAD WAIVERS; PROVIDING RULEMAKING AUTHORITY TO THE PUBLIC EDUCATION DEPARTMENT; REQUIRING SCHOOL DISTRICTS TO PROVIDE NOTICE OF CLASS LOAD WAIVERS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 22-8-6 NMSA 1978 (being Laws 1967, Chapter 16, Section 60, as amended) is amended to read:

     "22-8-6. OPERATING BUDGETS--EDUCATIONAL PLANS--SUBMISSION--CERTAIN REPORTS--FAILURE TO SUBMIT.--

          A. Prior to April 15 of each year, each local school board shall submit to the department an operating budget for the school district and any locally chartered charter school in the school district for the ensuing fiscal year.

          B. The date for the submission of the operating budget for each school district and each charter school as required by this section may be extended to a later date fixed by the secretary.

          C. The operating budget required by this section may include:

                (1) estimates of the cost of insurance policies for periods up to five years if a lower rate may be obtained by purchasing insurance for the longer term; or

                (2) estimates of the cost of contracts for the transportation of students for terms extending up to four years.

          D. The operating budget required by this section shall include a budget for each charter school of the membership projected for each charter school, the total program units generated at that charter school and approximate anticipated disbursements and expenditures at each charter school.

          E. [For fiscal year 2021 and subsequent fiscal years] Each school district's and each locally chartered or state-chartered charter school's educational plan shall include:

                (1) information on the instructional time offered by the school district or charter school, including the number of instructional days by school site and the number of instructional hours in each instructional day and the frequency of early-release days;

                (2) for school districts, the class load and teacher load in each elementary or secondary class at each school site provided for in the operating budget to meet the requirements of Section 22-10A-20 NMSA 1978 and the class load and teacher load for each of those classes in the prior school year and any class load or teacher load waivers granted by the department in the prior school year or requested for the upcoming school year;

                [(2)] (3) a narrative explaining the identified services to improve the academic success of at-risk students;

                [(3)] (4) a narrative explaining the services provided to students enrolled in the following programs:

                     (a) extended learning time programs, including a report of how the extended learning time is used to improve the academic success of students and professional learning of teachers; and

                     (b) K-5 plus programs;

                [(4)] (5) a narrative explaining the school district's or charter school's beginning teacher mentorship programs as well as class size and teaching load information;

                [(5)] (6) a narrative explaining supplemental programs or services offered by the school district or charter school to ensure that the Bilingual Multicultural Education Act, the Indian Education Act and the Hispanic Education Act are being implemented by the school district or charter school;

                [(6)] (7) a narrative describing the amount of program cost generated for services to students with disabilities and the spending of these revenues on services to students with disabilities, which shall include the following:

                     (a) program cost generated for students enrolled in approved special education programs;

                     (b) budgeted expenditures of program cost, for students enrolled in approved special education programs, on students with disabilities;

                     (c) the amount of program cost generated for personnel providing ancillary and related services to students with disabilities;

                     (d) budgeted expenditures of program cost for personnel providing ancillary and related services to students with disabilities, on special education ancillary and related services personnel; and

                     (e) a description of the steps taken to ensure that students with disabilities have access to a free and appropriate public education; and

                [(7)] (8) a common set of performance targets and performance measures, as determined by the department in consultation with the department of finance and administration, the legislative finance committee and the legislative education study committee.

          F. In addition to the requirements of Subsection E of this section, a school district or charter school that receives federal or local revenue shall include in its educational plan a narrative explaining how the school district or charter school will use the federal or local revenue to improve outcomes for students or to improve the condition of a school building. No later than October 1 of each year, a school district or charter school that received federal or local revenue in the prior fiscal year shall report to the department on the actual uses of that revenue, including a comprehensive evaluation of how the programs and services provided with that revenue improved outcomes for students or how capital projects undertaken improved the condition of a school building. A school district or charter school that is required under federal law to consult with tribal entities as a condition of receiving impact aid funds shall include in its educational plan a detailed narrative of its consultations with tribal entities and the results of those consultations. The school district or charter school shall transmit the October 1 spending and outcomes report to the appropriate tribal authorities. No later than November 15 of each year, the department shall compile the federal and local revenue outcomes reports into a statewide report to the legislative education study committee and the legislative finance committee that includes an analysis and identification of effective programs and strategies that improve outcomes for students.

          G. A school district or charter school operating budget and educational plan shall prioritize federal and local revenue for purposes relating to the Indian Education Act; for capital expenditures authorized by the Public School Capital Outlay Act, the Public School Capital Improvements Act or the Public School Buildings Act; or for research-based or evidence-based social, emotional or academic interventions for which at-risk program units may be used.

          H. If a local school board or governing board of a charter school fails to submit an operating budget pursuant to this section, the department shall prepare the operating budget for the school district or charter school for the ensuing fiscal year. A local school board or governing board of a charter school shall be considered as failing to submit an operating budget pursuant to this section if the budget submitted exceeds the total projected resources of the school district or charter school or if the budget submitted does not comply with the law or with rules and procedures of the department.

          I. As used in this section:

                (1) "federal revenue" means seventy-five percent of the revenue derived from:

                     (a) federal forest reserve funds distributed in accordance with Section 22-8-33 NMSA 1978; or

                     (b) federal assistance to those areas affected by federal activity authorized in accordance with Title 20 of the United States Code, commonly known as "PL 874 funds" or "impact aid funds"; and

                (2) "local revenue" means seventy-five percent of the revenue from a school district one-half mill school district property tax and revenue from the Oil and Gas Ad Valorem Production Tax Act and the Oil and Gas Production Equipment Ad Valorem Tax Act."

     SECTION 2. Section 22-10A-20 NMSA 1978 (being Laws 1986, Chapter 33, Section 3, as amended) is amended to read:

     "22-10A-20. STAFFING PATTERNS--CLASS LOAD--TEACHING LOAD.--

          [A. The individual class load for elementary school teachers shall not exceed twenty students for kindergarten; provided that any teacher in kindergarten with a class load of fifteen to twenty students shall be entitled to the assistance of an educational assistant.

          B.] A. The [average] maximum class load for elementary school teachers [at an individual school] shall not exceed [twenty-two students when averaged among grades one, two and three; provided that any teacher in grade one with a class load of twenty-one or more shall be entitled to the full-time assistance of an educational assistant.

          C. The average class load for an elementary school teacher at an individual school shall not exceed twenty-four students when averaged among grades four, five and six] the following; provided that any elementary school teacher with a class load of fifteen or more students shall be entitled to the full-time assistance of an educational assistant:

                (1) fifteen students in kindergarten through grade three;

                (2) eighteen students in grades four through eight; and

                (3) twenty-two students in grades nine through twelve.

          [D.] B. The [daily] nine-week teaching load per teacher for grades [seven] six through eight shall not exceed ninety students and for grades nine through twelve shall not exceed one hundred [sixty] ten students, [except the daily teaching load for teachers of required English courses in grades seven and eight shall not exceed one hundred thirty-five with a maximum of twenty-seven students per class and the daily teaching load for teachers of required English courses in grades nine through twelve shall not exceed one hundred fifty students with a maximum of thirty students per class] with a maximum class load as delineated in Subsection A of this section.

          [E.] C. Students receiving special education services integrated into a regular classroom for any part of the day shall be counted in the calculation of class [load averages] loads. Students receiving special education services not integrated into the regular classroom shall not be counted in the calculation of class [load averages] loads. Students enrolled in courses that do not require the teacher to plan, grade or complete other tasks outside of the course meeting time and that meet for less than the equivalent of one class period per week, including advisory, homeroom and study hall, shall not be counted in the calculation of class loads. Only classroom teachers charged with responsibility for the regular classroom instructional program shall be counted in determining [average] class loads. [In elementary schools offering only one grade level, average class loads may be calculated by averaging appropriate grade levels between schools in the school district.

          F.] D. Class load limits provided for in this section do not apply to band or music classes or athletic electives.

          [G. The state superintendent may waive the individual school class load requirements established in this section. Waivers shall be applied for annually and a waiver shall not be granted for more than two consecutive years. Waivers may only be granted if a school district demonstrates that:

                (1) no portable classrooms are available;

                (2) no other available sources of funding exist to meet its need for additional classrooms;

                (3) the school district is planning alternatives to increase building capacity for implementation within one year; and

                (4) the parents of all children affected by the waiver have been notified in writing:

                     (a) of the statutory class load requirements;

                     (b) that the school district has made a decision to deviate from these class load requirements; and

                     (c) of the school district plan to achieve compliance with the class load requirements.

          H. If a waiver is granted pursuant to Subsection G of this section to an individual school, the average class load for elementary school teachers at that school shall not exceed twenty students in grade one and shall not exceed twenty-five students when averaged among grades two, three, four, five and six.]

          E. The department shall create and maintain an online portal to allow teachers, other school employees and parents of students to submit confidential reports to the department regarding violations of class load limits. There shall not be reprisals of any kind taken against a school employee by reason of the employee submitting or publicizing a report on the online portal.

          F. If exceptional circumstances arise, a school may request a one-time waiver of the class load limits. A school district shall apply to the department for approval and explain with specificity the exceptional circumstances creating a need for the waiver and the school district's plan for coming into compliance with the class load limits. A school may not receive a waiver for more than one class in any year. If such a waiver is approved, the maximum class load shall not exceed twenty-two students for kindergarten and first grade, twenty-four students for second and third grades, twenty-six students for fourth through six grades and for seventh through twelfth grades, one hundred sixty students, except for teachers of required English courses in seventh and eighth grades, whose class loads shall not exceed one hundred thirty-five students, with a maximum of twenty-seven students per class.

          G. A teacher who is asked to increase the teacher's class load over the maximum permitted shall be provided with additional support or compensation. The department may promulgate rules to implement the requirements of this subsection.

          H. If a waiver is approved, the school district shall notify the parents of all students affected by the waiver in writing:

                (1) of the statutory class load requirements;

                (2) that the school district has made a decision to deviate from these class load requirements; and

                (3) of the school district's plan to achieve compliance with the class load requirements.

          I. Each school district shall report to the department the size and composition of classes subsequent to the fortieth day and the December 1 count. Failure to meet class load requirements [within two years shall be justification for] shall result in the disapproval of the school district's budget by the [state superintendent] department.

          J. The department shall report to the legislative education study committee by November 30 of each year regarding each school district's ability to meet class load requirements imposed by law.

          [K. Notwithstanding the provisions of Subsection G of this section, the state board may waive the individual class load and teaching load requirements established in this section upon a demonstration of a viable alternative curricular plan and a finding by the state board that the plan is in the best interest of the school district and that, on an annual basis, the plan has been presented to and is supported by the affected teaching staff. The department shall evaluate the impact of each alternative curricular plan annually. Annual reports shall be made to the legislative education study committee.

          L.] K. Teachers shall not be required to perform noninstructional duties except in emergency situations as defined by the [state board] department. For purposes of this subsection, "noninstructional duties" means noon hall duty, noon ground duty and noon cafeteria duty."

     SECTION 3. TEMPORARY PROVISION--NOTIFICATION OF CLASS AND TEACHER LOADS FOR 2024-2025 SCHOOL YEAR.--By May 30, 2024, each school district shall file an addendum to its educational plan submitted as part of its proposed operating budget to include the information required by this act. The public education department shall approve or disapprove the addendum submitted by each school district. If a school district is unable to meet the requirements of Section 22-10A-20 NMSA 1978, it shall explain with specificity the exceptional circumstances that prevent it from meeting those requirements and provide a detailed plan for compliance.
