AN ACT

MAKING APPROPRIATIONS FOR WATER PROJECTS IN TAOS COUNTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATIONS.--

          A. The following amounts are appropriated from the general fund to the department of environment for expenditure in fiscal years 2025 through 2028 for the following purposes:

                (1) one million dollars ($1,000,000) to

plan, design, improve and construct a wastewater treatment facility and water system for the village of Questa in Taos county;

                (2) one million dollars ($1,000,000) to plan, design, improve and construct a wastewater treatment facility and water system for Taos county;

                (3) one million eight hundred thousand dollars ($1,800,000) to plan, design, construct and equip a mitigation well for the acequia del Monte del Rio Chiquito in Taos county;

                (4) two million two hundred thousand dollars ($2,200,000) to plan, design and construct water system improvements, including electrical infrastructure, well buildings and equipment, access roads, culverts and security systems, for El Prado water and sanitation district in Taos county;

                (5) one million six hundred thousand dollars ($1,600,000) to plan, design, construct, purchase and install the Rio Grande del Rancho mitigation well and associated equipment for the Llano Quemado mutual domestic water consumers association in Taos county; and

                (6) three hundred thousand dollars ($300,000) to plan, design and construct water system improvements for El Valle de los Ranchos water and sanitation district in Taos county.

          B. The following amounts are appropriated from the general fund to the interstate stream commission for expenditure in fiscal years 2025 through 2028 for the following purposes:

                (1) three hundred eighty thousand dollars ($380,000) to plan, design and construct improvements, including a diversion dam, for the citizen's middle ditch association in Questa in Taos county;

                (2) one million two hundred thousand dollars ($1,200,000) to plan, design, construct, repair and improve the ditch, including diversion structures, for the Llano irrigation company in Taos county;

                (3) thirty thousand dollars ($30,000) to plan, design and construct improvements, including a diversion dam, for the Jose Cleofes Arellano acequia association in Amalia in Taos county;

                (4) two hundred seventy-five thousand dollars ($275,000) to plan, design and construct improvements, including a diversion dam, for the Santa Barbara ditch association in Penasco in Taos county;

                (5) thirty thousand dollars ($30,000) to plan, design and construct improvements, including a diversion dam, for Los Cordovas ditch association in Los Cordovas in Taos county;

                (6) one hundred eighty thousand dollars ($180,000) to plan, design and construct improvements, including a diversion dam, for Los Lovatos acequia association in Taos county;

                (7) two hundred fifty thousand dollars ($250,000) to plan, design and construct ditch improvements, including an irrigation pipeline, for the Rio Lucio water ditch association in Taos county;

                (8) two million four hundred thousand dollars ($2,400,000) to plan, design, construct and improve an irrigation system for the Rio Costilla ditch association in Taos county;

                (9) thirty-five thousand dollars ($35,000) to plan, design, construct and improve a flume project for the Trampas ditch association in Trampas in Taos county; and

                (10) thirty-five thousand dollars ($35,000) to plan, design and construct ditch improvements, including an irrigation pipeline, for Sanchez ditch in La Loma in Taos county.

          C. Money from appropriations made in this section shall not be used to pay indirect project costs or be subject to a binding written agreement with a third party prior to the authorized state agency's approval to enter into that agreement.

          D. Any unexpended balance of an appropriation made pursuant to this section remaining within six months of completion of a project, but no later than the end of fiscal year 2028, shall revert to the general fund.

          E. For the purposes of this section, "unexpended balance" means the remainder of an appropriation after reserving for unpaid costs and expenses subject to a binding written agreement with a third party.
