A JOINT RESOLUTION

RATIFYING AND APPROVING THE EXCHANGE OF REAL PROPERTY BY THE GENERAL SERVICES DEPARTMENT WITH THE CITY OF SANTA FE OF FIVE PARCELS OF STATE-OWNED REAL PROPERTY LOCATED WITHIN THE CITY OF SANTA FE FOR ONE PARCEL OF CITY-OWNED PROPERTY LOCATED WITHIN THE CITY OF SANTA FE.

 

     WHEREAS, Section 13-6-2 NMSA 1978 provides that a state agency may sell or otherwise dispose of real property by competitive sealed bid, public auction or negotiated sale to a private person or to other entities; and

     WHEREAS, Section 13-6-3 NMSA 1978 provides in pertinent part that any sale, trade or lease of real property belonging to a state agency for consideration of five hundred fifty thousand dollars ($550,000) or more shall be subject to the ratification and approval by the state legislature prior to the sale, trade or lease becoming effective; and

     WHEREAS, the general services department and the city of Santa Fe have agreed to exchange certain property owned by the general services department and the city of Santa Fe; and

     WHEREAS, the facilities management division of the general services department owns five parcels of real property (identified as Tract A, Tract B, Tract D, Tract 3 and Tract O-1, hereinafter referred to as "state property"), all of which are in an area of the city referred to as the "midtown campus"; and

     WHEREAS, Tract A is located at Siringo Road, Santa Fe (located off Alumni Drive entrance road) containing 3.608 acres, more or less, being more particularly described as: Beginning at the southeast corner of said Tract A and a point on the northerly Right-of-Way line of Siringo Road; whence, a Santa Fe Reference Mark, stamped "EAST BASE 1945, NO 3 1976" in place bears N. 01°48'02" E., 6296.67 feet distant; thence, from said Point of Beginning; S.89°43'14"W., along the northerly Right-of-Way line of said Siringo Road also being the southwest along the northerly Right-of-Way line a distance of 665.80 feet, so being the southwest corner of said Tract A; thence, N.00°12'19" E., leaving the northerly Right-of-Way line of said Siringo Road, a distance of 53.68 feet to the northwest corner of the herein described Tract A; thence, N. 57°01'01" E., a distance of 601.69 feet to a point of curvature being the northeast corner of the herein described Tract A; thence, 334.74 feet along the arc of a curve to the right having a radius of 316.27 feet, a chord which bears S. 30°15'05" E., a distance of 319.33 feet to a point on the easterly line of said Tract A; thence, S. 00°00'45" E., a distance of 102.09 feet to the Point of Beginning; and

     WHEREAS, Tract B is located at Siringo Road, Santa Fe (located off Alumni Drive entrance road) containing 3.730 acres, more or less, being more particularly described as: Beginning at a point on the southwest corner of herein described Tract B and a point on the northerly Right-of-Way line of Siringo Road; whence, a Santa Fe Reference Mark, stamped "EAST BASE 1945, NO 3 1976" in place bears N. 01°48'02" E., 6296.67 feet distant; thence, from said Point of Beginning; N.00°00'45" W., leaving the northerly Right-of-Way line of said Siringo Road, a distance of 102.09 feet to a point of curvature; thence, 334.74 feet along the arc of a curve to the left having a radius of 316.27 feet, a chord which bears N. 30°15'05" W., a distance of 319.33 feet to the northwest corner of Tract B; thence, N.58°37'39" E., along the north line of Tract B, a distance of 465.30 feet to the northeast corner of herein described Tract B; thence, S. 03°40'49" E., a distance of 620.14 feet to a point on the northerly Right-of-Way line of Siringo Road, also being the southeast corner of herein described Tract B; thence, S. 89°43'14" W., a distance of 278.18 feet to the Point of Beginning; and

     WHEREAS, Tract D is located at Siringo Road, Santa Fe (located off Alumni Drive entrance road) containing 3.420 acres, more or less, being more particularly described as: Beginning at a point being the northeast of said Tract D; whence, a Santa Fe Reference Mark, stamped "EAST BASE 1945, NO 3 1976" in place bears N. 06°20'17" E., 5701.26 feet distant; thence, from said Point of Beginning; S. 33°13'26" E., a distance of 59.12 feet to a point of curvature; thence, 240.09 feet along the arc of a curve to the left having a radius of 503.00 feet, a chord which bears S. 46°53'54" E., a distance of 237.82 feet to a point of tangency; thence, S.60°34'20" E., a distance of 74.42 feet to a point being the southeast corner of herein described Tract D; thence, S. 57°01'01" W., along the southerly parcel line of said Tract D, a distance of 601.69 feet to the southwest corner of herein described Tract D; thence, N. 00°54'20" E., to the northwest corner of said Tract D, a distance of 272.73 feet; thence, N. 56°42'16" E., a distance of 275.73 feet to the Point of Beginning; and

     WHEREAS, Tract 3 is located at Siringo Road, Santa Fe containing 0.888 acres, more or less, being more particularly described as: Beginning at the Southeast Corner of the Tract herein described from whence a Brass Cap for the One mile marker of the South Boundary of the Santa Fe Grant bears S. 88 deg. 53'06"E a distance of 2572.88 feet, Thence from said Point of beginning along the southerly line of said tract being also the Northerly Line of Siringo Road S. 89 deg. 46'43"W a distance of 120.45 feet to the Southwest corner, Thence continuing along the Westerly line of said Tract N. 0 deg. 05'17"E a distance of 320.94 feet to the Northwest corner, thence to a point of curve on the Northerly line of said Tract, Thence continuing along a curve to the left having a radius of 2781.14 feet, through an arc of 2 deg. 26'56" with a length of 118.87 feet having a chord that bears N. 86 deg. 55'35"E a distance of 118.86 feet to the Northeast corner, Thence continuing along the Easterly Line of said Tract S 00 deg. 13'17"E a distance of 326.85 feet to the Southeast corner being also the point and place of beginning of the Tract herein described; and

     WHEREAS, Tract O-1 is located at 1600 Saint Michael's Drive, Santa Fe containing 7.908 acres, more or less, being more particularly described as: Beginning at a point on the southeast corner of said Tract O-1; whence, a Santa Fe Reference Mark, stamped "EAST BASE 1945, NO 3 1976" in place bears N. 15°39'47" E., 5133.43 feet distant; thence, from said Point of Beginning; S. 57°43'21" W., along the southerly parcel line of said Tract O-1, a distance of 263.41 feet to an angle point; thence, N. 31°57'08" W., a distance of 97.93 feet to an angle point; thence, S. 57°43'21" W., a distance of 258.32 feet to an angle point; thence, N. 32°21'29" W., a distance of 304.08 feet to an angle point; thence, N. 00°47'58" E., a distance of 21.00 feet to an angle point; thence, N. 32°17'11" W., a distance of 295.81 feet to an angle point; thence, N. 58°16'21" E., a distance of 514.24 feet to an angle point; thence, S. 31°57'08" E., a distance of 710.49 feet to the Point of Beginning; and

     WHEREAS, the general services department holds the title

to the state property but is not using or planning a use for the state property; and

     WHEREAS, the appraised fair market value of the state property is six million five hundred thousand dollars ($6,500,000); and

     WHEREAS, the city of Santa Fe owns one parcel of land located at 4491 Cerrillos Road, Santa Fe, containing 34.9764 acres, more or less (hereinafter referred to as the "city property"); and

     WHEREAS, the city property is described as follows:

Beginning at a point being a common corner of the Northeast corner of the New Mexico Highway Department property and the Southeast corner of the Old Municipal Airport for the City of Santa Fe: thence leaving the above-mentioned common corner across a 50' road easement on a bearing of N. 26° 47' E. across said easement to the true point and place of beginning, thence N. 26°47' E., a distance of 500 feet; thence N. 66° 37' W., a distance of 1205.4 feet; thence along a curve to the right having a radius of 659.4 feet and an arc length of 309.95 feet, thence S. 70° 15' W., a distance of 1220 feet.+; thence S. 19° 45' E., a distance of 400 feet+; thence along the northerly side of said easement N. 89° 23' E., a distance of 2130 feet+ to the point and place of beginning; and

     WHEREAS, the appraised fair market value of the city property is eight million six hundred thirty thousand dollars ($8,630,000); and

     WHEREAS, the general services department and the city of Santa Fe have agreed to exchange ownership of the state property and the city property without further compensation;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE

STATE OF NEW MEXICO that the trade of the state property as

described above from the general services department to the city of Santa Fe in return for the city property as described above be hereby ratified and approved by the legislature; and

     BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the secretary of general services, the mayor of the city of Santa Fe and the Santa Fe city council.
