0001| AN ACT | 0002| AMENDING SECTION 72-1-2.1 NMSA 1978 (BEING LAWS 1991, CHAPTER 34, | 0003| SECTION 1) PERTAINING TO THE RECORDING OF CHANGES IN OWNERSHIP OF WATER | 0004| RIGHTS. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. Section 72-1-2.1 NMSA 1978 (being Laws 1991, Chapter | 0008| 34, Section 1) is amended to read: | 0009| "72-1-2.1. WATER RIGHTS--CHANGE IN OWNERSHIP--FILING AND | 0010| RECORDING--CONSTRUCTIVE NOTICE.--In the event of any changes of | 0011| ownership of a water right, whether by sale, gift or any other type of | 0012| conveyance, affecting the title to a water right that has been permitted | 0013| or licensed by the state engineer, has been declared with the state | 0014| engineer or has been adjudicated and is evidenced by a subfile order, | 0015| partial final decree, final decree or any other court order, the new | 0016| owner of the water right shall file a change of ownership form with the | 0017| state engineer. The form shall include all information conforming with | 0018| water rights of record filed with the state engineer and shall be | 0019| accompanied by a copy of a warranty deed or other instrument of | 0020| conveyance. The new owner shall record a copy of the change of | 0021| ownership form filed with the state engineer with the clerk of the | 0022| county in which the water right will be located.
