Section 35-1-23 NMSA 1978 (being Laws 1968, | 0019| Chapter 62, Section 25, as amended) is amended to read: | 0020| "35-1-23. MAGISTRATE COURT--QUAY DISTRICT.--There shall be | 0021| ~~[one magistrate]~~ two magistrates in Quay magistrate district | 0022| ~~[whose principal court is]~~ one for division 1 in Tucumcari | 0023| ~~[The magistrate shall ride circuit to]~~ and one for division | 0024| 2 in San Jon ~~[on a regularly scheduled basis]~~." | 0025| Section 2. TEMPORARY PROVISION--APPOINTMENT--DIVISION 2--ELECTION.-- | 0001| A. The office of magistrate in Quay magistrate | 0002| division 2 shall be filled by appointment by the governor. The | 0003| appointed magistrate shall begin serving January 1, 1997 and | 0004| shall serve until succeeded by a magistrate elected pursuant to | 0005| Subsection B of this section. | 0006| B. The first full term of the office of magistrate | 0007| in Quay magistrate division 2 shall be filled by election at the | 0008| general election in 1998, and that term of office shall begin on | 0009| January 1, 1999. | 0010| Section 3. APPROPRIATION.--Thirty-five thousand six | 0011| hundred twenty-three dollars ($35,623) is appropriated from the | 0012| general fund to the Quay magistrate district for expenditure in | 0013| fiscal year 1997 for one additional full-time-equivalent | 0014| position. Any unexpended or unencumbered balance remaining at | 0015| the end of fiscal year 1997 shall revert to the general fund. | 0016| Section 4.
