0018|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0019|       Section 1.  SEVERANCE TAX BONDS--PURPOSE FOR WHICH ISSUED--APPROPRIATION OF PROCEEDS.--The state board of finance may issue
    |
0020|     and sell severance tax bonds in compliance with the Severance
    |
0021|     Tax Bonding Act in an amount not exceeding one million fifty-nine thousand eight hundred four dollars ($1,059,804) when the
    |
0022|     governing board of Luna vocational-technical institute certifies
    |
0023|     the need for the issuance of the bonds.  The state board of
    |
0024|     finance shall schedule the issuance and sale of the bonds in the
    |
0025|     most expeditious and economical manner possible upon a finding
    |
0001|     by the board that the project has been developed sufficiently to
    |
0002|     justify the issuance and that the project can proceed to
    |
0003|     contract within a reasonable time.  The state board of finance
    |
0004|     shall further take the appropriate steps necessary to comply
    |
0005|     with the Internal Revenue Code of 1986, as amended.  The
    |
0006|     proceeds from the sale of the bonds are appropriated to the
    |
0007|     governing board of Luna vocational-technical institute for the
    |
0008|     purpose of constructing an addition to, remodeling and
    |
0009|     landscaping the existing vocational agriculture facility for use
    |
0010|     as an early childhood education and permaculture center at the
    |
0011|     main campus located in San Miguel county.  Any unexpended or
    |
0012|     unencumbered balance remaining at the end of fiscal year 1999
    |
0013|     shall revert to the severance tax bonding fund.  If the
    |
0014|     governing board of Luna vocational-technical institute has not
    |
0015|     certified the need for the issuance of the bonds by the end of
    |
0016|     fiscal year 1998, the authorization provided in this section
    |
0017|     shall be void.
    |
0018|       Section 2.  EMERGENCY.--It is necessary for the public
    |
0019|     peace, health and safety that this act take effect immediately.

    |
0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|       Section 1.  This act may be cited as the "1996 Capital
    |
0016|     Projects General Obligation Bond Act".
    |
0017|       Section 2.  For the purpose of providing funds for capital
    |
0018|     expenditures as authorized in this act, general obligation
    |
0019|     indebtedness of the state is authorized for the purposes and in
    |
0020|     the amounts set forth in Section 10 of the 1996 Capital Projects
    |
0021|     General Obligation Bond Act.
    |
0022|       Section 3.  The state board of finance, except as limited
    |
0023|     by the 1996 Capital Projects General Obligation Bond Act, shall
    |
0024|     determine the terms, covenants and conditions of bonds issued
    |
0025|     pursuant to that act, including but not limited to:  date or
    |
0001|     dates of issue; denominations; maturities; principal amounts;
    |
0002|     rate or rates of interest; provisions for redemption, including
    |
0003|     premiums, registration, refundability, whether the bonds are
    |
0004|     issued in one or more series and other covenants relating to the
    |
0005|     bonds and the issuance thereof.  The bonds shall be in such form
    |
0006|     as the state board of finance determines with an appropriate
    |
0007|     series designation and shall bear interest payable as set forth
    |
0008|     in the resolution of the state board of finance.  Payment of the
    |
0009|     principal of the bonds shall begin not more than two years after
    |
0010|     the date of their issuance, and the bonds shall mature not later
    |
0011|     than ten years after the date of their issuance.  Both principal
    |
0012|     and interest shall be payable in lawful money of the United
    |
0013|     States at the office of the paying agent within or without the
    |
0014|     state of New Mexico as the state board of finance may direct. 
    |
0015|     The bonds shall be executed with the manual or facsimile
    |
0016|     signature of the governor or the state treasurer, and the seal
    |
0017|     or a facsimile of the seal of the state shall be placed on each
    |
0018|     bond, except for any series of bonds issued in book entry or
    |
0019|     similar form without the delivery of physical securities.  The
    |
0020|     bonds shall be issued in accordance with the provisions of the 1996
    |
0021|     Capital Projects General Obligation Bond Act, the Supplemental
    |
0022|     Public Securities Act and the Uniform Facsimile Signature of Public
    |
0023|     Officials Act and may be issued in accordance with the Public
    |
0024|     Securities Short-Term Interest Rate Act.  The full faith and credit
    |
0025|     of the state of New Mexico are hereby pledged for the prompt
    |
0001|     payment at maturity of the principal of and interest on all bonds
    |
0002|     issued and sold pursuant to the 1996 Capital Projects General
    |
0003|     Obligation Bond Act.
    |
0004|       Section 4.  The proceeds from the sale of the bonds shall be
    |
0005|     expended solely for providing funds to be distributed for the
    |
0006|     purposes and in amounts not to exceed the amounts set forth in
    |
0007|     Section 10 of the 1996 Capital Projects General Obligation Bond Act
    |
0008|     and to pay expenses incurred under Section 6 of that act.  Any
    |
0009|     proceeds from the sale of the bonds that are not required for the
    |
0010|     purposes set forth in Sections 6 and 10 of that act shall be used
    |
0011|     for the purpose of paying the principal of and interest on the
    |
0012|     bonds.
    |
0013|       Section 5.  The bonds authorized under the 1996 Capital
    |
0014|     Projects General Obligation Bond Act shall be sold by the state
    |
0015|     board of finance, at such time and in such manner and amounts as
    |
0016|     the board may elect.  The bonds may be sold at private sale or at
    |
0017|     public sale at not less than par and accrued interest to the date
    |
0018|     of delivery.  If sold at public sale, the state board of finance
    |
0019|     shall publish a notice of the time and place of sale in a newspaper
    |
0020|     of general circulation in the state and may also publish the notice
    |
0021|     in a recognized financial journal outside the state.  The required
    |
0022|     publications shall be made once each week for two consecutive weeks
    |
0023|     prior to the date fixed for the sale, the last publication thereof
    |
0024|     to be at least five days prior to the date of the sale.  The notice
    |
0025|     shall specify the amount, denomination, maturity and description of
    |
0001|     the bonds to be offered for sale and the place, date and hour at
    |
0002|     which the sealed bids shall be received.  At the time and place
    |
0003|     specified in the notice, the state board of finance shall open the
    |
0004|     bids in public and shall award the bonds to the bidder or bidders
    |
0005|     offering the best price for the bonds.  The state board of finance
    |
0006|     may reject any or all bids and readvertise and may waive any
    |
0007|     irregularity in a bid.  All bids, except that of the state, shall
    |
0008|     be accompanied by a deposit of two percent of the bid price.  The
    |
0009|     deposit of an unsuccessful bidder shall be returned upon rejection
    |
0010|     of the bid.  The state board of finance may also sell the bonds or
    |
0011|     any part of the bonds to the state treasurer or state investment
    |
0012|     officer.  The state treasurer or state investment officer is
    |
0013|     authorized to purchase any of the bonds for investment.  The bonds
    |
0014|     are legal investments for any person or board charged with the
    |
0015|     investment of any public funds and may be accepted as security for
    |
0016|     any deposit of public money.
    |
0017|       Section 6.  The expenses incurred by the state board of
    |
0018|     finance in or relating to the preparation and sale of the bonds
    |
0019|     shall be paid out of the proceeds from the sale of the bonds, and
    |
0020|     all rebate, penalty, interest and other obligations of the state
    |
0021|     relating to the bonds and bond proceeds under the Internal Revenue
    |
0022|     Code of 1986, as amended, shall be paid from earnings on bond
    |
0023|     proceeds or other money of the state, legally available therefor.
    |
0024|       Section 7.  To provide for the payment of the principal of
    |
0025|     and interest on the bonds issued and sold pursuant to the
    |
0001|     provisions of the 1996 Capital Projects General Obligation Bond
    |
0002|     Act, there shall be and there is hereby imposed and levied during
    |
0003|     each year in which any of the bonds are outstanding an ad valorem
    |
0004|     tax on all property in the state subject to property taxation for
    |
0005|     state purposes sufficient to pay the interest as it becomes due on
    |
0006|     the bonds, together with an amount sufficient to provide a sinking
    |
0007|     fund to pay the principal of the bonds as it becomes due and, if
    |
0008|     permitted by law, ad valorem taxes may be collected to pay
    |
0009|     administrative costs incident to the collection of such taxes.  The
    |
0010|     taxes shall be imposed, levied, assessed and collected at the times
    |
0011|     and in the manner that other property taxes for state purposes are
    |
0012|     imposed, levied, assessed and collected.  It is the duty of all tax
    |
0013|     officials and authorities to cause these taxes to be imposed,
    |
0014|     levied, assessed and collected.
    |
0015|       Section 8.  The state treasurer shall keep separate accounts
    |
0016|     of all money collected pursuant to the taxes imposed and levied
    |
0017|     pursuant to the provisions of the 1996 Capital Projects General
    |
0018|     Obligation Bond Act and shall use this money only for the purposes
    |
0019|     of paying the principal of and interest on the bonds as they become
    |
0020|     due and any expenses relating thereto.
    |
0021|       Section 9.  Any owner of bonds issued pursuant to the
    |
0022|     provisions of the 1996 Capital Projects General Obligation Bond Act
    |
0023|     may, either at law or in equity, by suit, action or mandamus,
    |
0024|     enforce and compel the performance of the duties required by that
    |
0025|     act of any officer or entity mentioned in that act.  The provisions
    |
0001|     of the 1996 Capital Projects General Obligation Bond Act constitute
    |
0002|     an irrepealable contract with the owners of any of the bonds issued
    |
0003|     pursuant to that act for the faithful performance of which the full
    |
0004|     faith and credit of the state of New Mexico is hereby pledged. 
    |
0005|     Without reference to any other act of the legislature of the state,
    |
0006|     the 1996 Capital Projects General Obligation Bond Act is full
    |
0007|     authority for the issuance and sale of the bonds authorized in that
    |
0008|     act, and such bonds shall have all the qualities of investment
    |
0009|     securities under the Uniform Commercial Code of the state, shall
    |
0010|     not be invalid for any irregularity or defect in the proceedings
    |
0011|     for the issuance and sale of the bonds and shall be incontestable
    |
0012|     in the hands of bona fide purchasers or holders thereof for value. 
    |
0013|     All bonds issued under the provisions of the 1996 Capital Projects
    |
0014|     General Obligation Bond Act, and the interest thereon, are exempt
    |
0015|     from taxation by the state and any subdivision or public body
    |
0016|     thereof.
    |
0017|       Section 10.  The proceeds from the sale of bonds issued under
    |
0018|     the provisions of the 1996 Capital Projects General Obligation Bond
    |
0019|     Act shall be distributed as follows for the purposes and in the
    |
0020|     amounts specified:
    |
0021|            A.  for senior citizen facility construction and
    |
0022|     improvements, to the state agency on aging:
    |
0023|                 (1)  three hundred seventy-six thousand dollars
    |
0024|     ($376,000) for the purpose of renovating and making improvements to
    |
0025|     meet current codes and regulations regarding health, safety and
    |
0001|     accessibility at senior centers and meal sites located throughout
    |
0002|     the state;
    |
0003|                 (2)  one million twenty-nine thousand nine hundred
    |
0004|     dollars ($1,029,900) to be allocated to senior citizen centers and
    |
0005|     programs for the purpose of purchasing vehicles for senior citizen
    |
0006|     centers and programs located throughout the state;
    |
0007|                 (3)  two hundred twenty-one thousand one hundred
    |
0008|     dollars ($221,100) to be allocated to nutrition programs for the
    |
0009|     purpose of purchasing kitchen equipment for nutrition programs
    |
0010|     located throughout the state;
    |
0011|                 (4)  eight hundred two thousand dollars ($802,000)
    |
0012|     for the purpose of renovating and making improvements to senior
    |
0013|     centers and meal sites located throughout the state; and
    |
0014|                 (5)  one hundred thousand dollars ($100,000) for
    |
0015|     the purpose of constructing and equipping a south side senior
    |
0016|     citizen center located in Santa Fe county;
    |
0017|            B.  for public educational capital improvements and
    |
0018|     acquisitions:
    |
0019|                 (1)  to the community college board of Santa Fe
    |
0020|     community college, two million dollars ($2,000,000) for the purpose
    |
0021|     of planning, designing, constructing and equipping an instructional
    |
0022|     technology center at Santa Fe community college located in Santa Fe
    |
0023|     county;
    |
0024|                 (2)  to the board of regents of northern New
    |
0025|     Mexico state school:
    |
0001|                      (a)  five hundred thousand dollars ($500,000)
    |
0002|     for the purpose of renovating, expanding and improving existing
    |
0003|     buildings at northern New Mexico state school at El Rito located in
    |
0004|     Rio Arriba county, including handicap access and infrastructure,
    |
0005|     sewer and water renovation, expansion and equipment; and
    |
0006|                      (b)  three hundred eighteen thousand four
    |
0007|     hundred ninety-five dollars ($318,495) to design, construct and
    |
0008|     equip a center for the arts at the Espanola branch of northern New
    |
0009|     Mexico state school in Rio Arriba county;
    |
0010|                 (3)  to the board of regents of New Mexico
    |
0011|     military institute, two million dollars ($2,000,000) to rebuild,
    |
0012|     expand and equip Saunders barracks;
    |
0013|                 (4)  to the governing board of Luna vocational-technical institute, six hundred fifty thousand dollars ($650,000)
    |
0014|     for the purpose of constructing an addition to, remodeling and
    |
0015|     landscaping the existing vocational agriculture facility for use as
    |
0016|     an early childhood education and permaculture center at the main
    |
0017|     campus located in San Miguel county;
    |
0018|                 (5)  to the board of regents of New Mexico
    |
0019|     highlands university, five hundred thousand dollars ($500,000) to
    |
0020|     renovate and make improvements to the Lora Mangum Shield science
    |
0021|     building at New Mexico highlands university located in San Miguel
    |
0022|     county;
    |
0023|                 (6)  to the board of regents of New Mexico state
    |
0024|     university, nine million dollars ($9,000,000) to design, construct
    |
0025|     and equip the center for sustainable development of arid lands at
    |
0001|     New Mexico state university located in Dona Ana county;
    |
0002|                 (7)  to the board of regents of the university of
    |
0003|     New Mexico, three million five hundred thousand dollars
    |
0004|     ($3,500,000) to plan, design, construct, renovate, equip and make
    |
0005|     improvements to certain instructional facilities on the main campus
    |
0006|     located in Bernalillo county;
    |
0007|                 (8)  to the governing board of New Mexico junior
    |
0008|     college, one million two hundred thousand dollars ($1,200,000) to
    |
0009|     plan, design, construct and equip a transportation training center
    |
0010|     located in Lea county;
    |
0011|                 (9)  to the governing board of San Juan college,
    |
0012|     five hundred thousand dollars ($500,000) to design, construct and
    |
0013|     equip an advanced technology center at San Juan college located in
    |
0014|     San Juan county;
    |
0015|                 (10)  to the board of regents of western New
    |
0016|     Mexico university, nine hundred thousand dollars ($900,000) to
    |
0017|     renovate the Watta classroom building on the campus of western New
    |
0018|     Mexico university located in Grant county;
    |
0019|                 (11)  to the public school capital improvements
    |
0020|     fund, five million dollars ($5,000,000) for the purpose of carrying
    |
0021|     out the provisions of the Public School Capital Improvements Act;
    |
0022|     and
    |
0023|                 (12)  to the public school capital outlay fund,
    |
0024|     twenty-one million five hundred thousand dollars ($21,500,000) to
    |
0025|     be allocated by the public school capital outlay council to carry
    |
0001|     out the provisions of the Public School Capital Outlay Act;
    |
0002|            C.  for state fair renovation and improvements, nine
    |
0003|     hundred thousand dollars ($900,000) for the purpose of renovating
    |
0004|     and making improvements to the state fairgrounds located in
    |
0005|     Bernalillo county;
    |
0006|            D.  for juvenile correctional and rehabilitative
    |
0007|     facilities, five million dollars ($5,000,000) to the property
    |
0008|     control division of the general services department to plan,
    |
0009|     design, construct and equip juvenile correctional and
    |
0010|     rehabilitative facilities; and
    |
0011|            E.  for land acquisition, one million dollars
    |
0012|     ($1,000,000) to the energy, minerals and natural resources
    |
0013|     department for the purpose of acquiring land for Petroglyph
    |
0014|     national monument located in Bernalillo county.
    |
0015|       Section 11.  Except as otherwise provided in the 1996 Capital
    |
0016|     Projects General Obligation Bond Act, bonds issued pursuant to that
    |
0017|     act shall be submitted to the registered voters of the state at the
    |
0018|     general election to be held in November 1996 and, if they receive a
    |
0019|     majority of all the votes cast thereon at such election, shall take
    |
0020|     effect upon certification of the state canvassing board announcing
    |
0021|     the results of that election.  No bonds shall be issued or sold
    |
0022|     under the 1996 Capital Projects General Obligation Bond Act until
    |
0023|     the registered voters of this state have voted upon and approved
    |
0024|     the bonds and property tax imposition as provided in this section. 
    |
0025|     Any bonds issued under that act shall be issued within twenty-six
    |
0001|     months from the date of the general election.  
    |
0002|       The ballots used at the 1996 general election shall contain
    |
0003|     substantially the following language: 
    |
0004|            A.  "The 1996 Capital Projects General Obligation Bond
    |
0005|     Act authorizes the issuance and sale of senior citizen facility
    |
0006|     construction, improvements and equipment bonds.  Shall the state of
    |
0007|     New Mexico be authorized to issue general obligation bonds in an
    |
0008|     amount not to exceed two million five hundred twenty-nine thousand
    |
0009|     dollars ($2,529,000) to make capital expenditures for certain
    |
0010|     senior citizen facility construction improvements and equipment
    |
0011|     projects and provide for a general property tax imposition and levy
    |
0012|     for the payment of principal of, interest on and expenses incurred
    |
0013|     in connection with the issuance of the bonds and the collection of
    |
0014|     the tax as permitted by law?
    |

0010|       Each question set forth in this section includes a specific
    |
0011|     work or object to be financed by the bonds.  If any such question
    |
0012|     is not approved by a majority vote of the electorate at the state's
    |
0013|     1996 general election, the issuance of bonds for the work or object
    |
0014|     specified by the question shall be excluded from and shall not be
    |
0015|     part of the 1996 Capital Projects General Obligation Bond Act.  The
    |
0016|     failure of any question to be approved by the electorate at the
    |
0017|     1996 general election shall not have any effect on the work or
    |
0018|     object specified by any other question approved by the electorate
    |
0019|     or the provisions of the 1996 Capital Projects General Obligation
    |
0020|     Bond Act relating to questions approved at the election.  
    |
0021|       The secretary of state shall include the submission of the
    |
0022|     capital projects general obligation bonds to the people at the 1996
    |
0023|     general election, and it shall be included in the general election
    |
0024|     proclamation of each of the county clerks.
    |
0025|       The secretary of state shall not include the question of
    |
0001|     whether to issue capital projects general obligation bonds for the
    |
0002|     purpose of acquiring land for Petroglyph national monument, as set
    |
0003|     forth in Section 11 of the 1996 Capital Projects General Obligation
    |
0004|     Bond Act, on the general election proclamation or on the general
    |
0005|     election ballot unless, prior to June 1, 1996, the secretary of the
    |
0006|     interior certifies in writing to the secretary of state that the
    |
0007|     United States department of the interior will assist in the
    |
0008|     expedited construction of certain portions of the Paseo del Norte
    |
0009|     extension project and that the United States department of the
    |
0010|     interior will work in good faith to eliminate all federal
    |
0011|     impediments to the construction of that extension.
    |
0012|       The secretary of state shall cause the 1996 Capital Projects
    |
0013|     General Obligation Bond Act to be published in full in at least one
    |
0014|     newspaper in each county of the state, if one is published therein,
    |
0015|     once each week for four successive weeks next proceeding the
    |
0016|     general election as required by the constitution of New Mexico. 
    |
0017|       Section 12.  ART IN PUBLIC PLACES.--Pursuant to Section 
    |
0018|     13-4A-4 NMSA 1978 and where applicable, the appropriations
    |
0019|     authorized in the 1996 Capital Projects General Obligation Bond Act
    |
0020|     include one percent for the art in public places fund.
    |
0021|       Section 13.  SEVERABILITY.--If any part or application of the
    |
0022|     1996 Capital Projects General Obligation Bond Act is held invalid,
    |
0023|     the remainder or its application to other situations or persons
    |
0024|     shall not be affected.
    |
0025|       Section 14.  EMERGENCY.--It is necessary for the public

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|         Section 1.  This act may be cited as the "1996 Capital
    |
0017|     Projects General Obligation Bond Act".
    |
0018|         Section 2.  For the purpose of providing funds for capital
    |
0019|     expenditures as authorized in this act, general obligation
    |
0020|     indebtedness of the state is authorized for the purposes and in
    |
0021|     the amounts set forth in Section 10 of the 1996 Capital
    |
0022|     Projects General Obligation Bond Act.
    |
0023|         Section 3.  The state board of finance, except as limited
    |
0024|     by the 1996 Capital Projects General Obligation Bond Act, shall
    |
0025|     determine the terms, covenants and conditions of bonds issued
    |
0001|     pursuant to that act, including but not limited to:  date or
    |
0002|     dates of issue; denominations; maturities; principal amounts;
    |
0003|     rate or rates of interest; provisions for redemption, including
    |
0004|     premiums, registration, refundability, whether the bonds are
    |
0005|     issued in one or more series and other covenants relating to
    |
0006|     the bonds and the issuance thereof.  The bonds shall be in such
    |
0007|     form as the state board of finance determines with an
    |
0008|     appropriate series designation and shall bear interest payable
    |
0009|     as set forth in the resolution of the state board of finance. 
    |
0010|     Payment of the principal of the bonds shall begin not more than
    |
0011|     two years after the date of their issuance, and the bonds shall
    |
0012|     mature not later than ten years after the date of their
    |
0013|     issuance.  Both principal and interest shall be payable in
    |
0014|     lawful money of the United States at the office of the paying
    |
0015|     agent within or without the state of New Mexico as the state
    |
0016|     board of finance may direct.  The bonds shall be executed with
    |
0017|     the manual or facsimile signature of the governor or the state
    |
0018|     treasurer, and the seal or a facsimile of the seal of the state
    |
0019|     shall be placed on each bond, except for any series of bonds
    |
0020|     issued in book entry or similar form without the delivery of
    |
0021|     physical securities.  The bonds shall be issued in accordance
    |
0022|     with the provisions of the 1996 Capital Projects General
    |
0023|     Obligation Bond Act, the Supplemental Public Securities Act and
    |
0024|     the Uniform Facsimile Signature of Public Officials Act and may
    |
0025|     be issued in accordance with the Public Securities Short-Term
    |
0001|     Interest Rate Act.  The full faith and credit of the state of
    |
0002|     New Mexico are hereby pledged for the prompt payment at
    |
0003|     maturity of the principal of and interest on all bonds issued
    |
0004|     and sold pursuant to the 1996 Capital Projects General
    |
0005|     Obligation Bond Act.
    |
0006|         Section 4.  The proceeds from the sale of the bonds shall
    |
0007|     be expended solely for providing funds to be distributed for
    |
0008|     the purposes and in amounts not to exceed the amounts set forth
    |
0009|     in Section 10 of the 1996 Capital Projects General Obligation
    |
0010|     Bond Act and to pay expenses incurred under Section 6 of that
    |
0011|     act.  Any proceeds from the sale of the bonds that are not
    |
0012|     required for the purposes set forth in Sections 6 and 10 of
    |
0013|     that act shall be used for the purpose of paying the principal
    |
0014|     of and interest on the bonds.
    |
0015|         Section 5.  The bonds authorized under the 1996 Capital
    |
0016|     Projects General Obligation Bond Act shall be sold by the state
    |
0017|     board of finance, at such time and in such manner and amounts
    |
0018|     as the board may elect.  The bonds may be sold at private sale
    |
0019|     or at public sale at not less than par and accrued interest to
    |
0020|     the date of delivery.  If sold at public sale, the state board
    |
0021|     of finance shall publish a notice of the time and place of sale
    |
0022|     in a newspaper of general circulation in the state and may also
    |
0023|     publish the notice in a recognized financial journal outside
    |
0024|     the state.  The required publications shall be made once each
    |
0025|     week for two consecutive weeks prior to the date fixed for the
    |
0001|     sale, the last publication thereof to be at least five days
    |
0002|     prior to the date of the sale.  The notice shall specify the
    |
0003|     amount, denomination, maturity and description of the bonds to
    |
0004|     be offered for sale and the place, date and hour at which the
    |
0005|     sealed bids shall be received.  At the time and place specified
    |
0006|     in the notice, the state board of finance shall open the bids
    |
0007|     in public and shall award the bonds to the bidder or bidders
    |
0008|     offering the best price for the bonds.  The state board of
    |
0009|     finance may reject any or all bids and readvertise and may
    |
0010|     waive any irregularity in a bid.  All bids, except that of the
    |
0011|     state, shall be accompanied by a deposit of two percent of the
    |
0012|     bid price.  The deposit of an unsuccessful bidder shall be
    |
0013|     returned upon rejection of the bid.  The state board of finance
    |
0014|     may also sell the bonds or any part of the bonds to the state
    |
0015|     treasurer or state investment officer.  The state treasurer or
    |
0016|     state investment officer is authorized to purchase any of the
    |
0017|     bonds for investment.  The bonds are legal investments for any
    |
0018|     person or board charged with the investment of any public funds
    |
0019|     and may be accepted as security for any deposit of public
    |
0020|     money.
    |
0021|         Section 6.  The expenses incurred by the state board of
    |
0022|     finance in or relating to the preparation and sale of the bonds
    |
0023|     shall be paid out of the proceeds from the sale of the bonds,
    |
0024|     and all rebate, penalty, interest and other obligations of the
    |
0025|     state relating to the bonds and bond proceeds under the
    |
0001|     Internal Revenue Code of 1986, as amended, shall be paid from
    |
0002|     earnings on bond proceeds or other money of the state, legally
    |
0003|     available therefor.
    |
0004|         Section 7.  To provide for the payment of the principal of
    |
0005|     and interest on the bonds issued and sold pursuant to the
    |
0006|     provisions of the 1996 Capital Projects General Obligation Bond
    |
0007|     Act, there shall be and there is hereby imposed and levied
    |
0008|     during each year in which any of the bonds are outstanding an
    |
0009|     ad valorem tax on all property in the state subject to property
    |
0010|     taxation for state purposes sufficient to pay the interest as
    |
0011|     it becomes due on the bonds, together with an amount sufficient
    |
0012|     to provide a sinking fund to pay the principal of the bonds as
    |
0013|     it becomes due and, if permitted by law, ad valorem taxes may
    |
0014|     be collected to pay administrative costs incident to the
    |
0015|     collection of such taxes.  The taxes shall be imposed, levied,
    |
0016|     assessed and collected at the times and in the manner that
    |
0017|     other property taxes for state purposes are imposed, levied,
    |
0018|     assessed and collected.  It is the duty of all tax officials
    |
0019|     and authorities to cause these taxes to be imposed, levied,
    |
0020|     assessed and collected.
    |
0021|         Section 8.  The state treasurer shall keep separate
    |
0022|     accounts of all money collected pursuant to the taxes imposed
    |
0023|     and levied pursuant to the provisions of the 1996 Capital
    |
0024|     Projects General Obligation Bond Act and shall use this money
    |
0025|     only for the purposes of paying the principal of and interest
    |
0001|     on the bonds as they become due and any expenses relating
    |
0002|     thereto.
    |
0003|         Section 9.  Any owner of bonds issued pursuant to the
    |
0004|     provisions of the 1996 Capital Projects General Obligation Bond
    |
0005|     Act may, either at law or in equity, by suit, action or
    |
0006|     mandamus, enforce and compel the performance of the duties
    |
0007|     required by that act of any officer or entity mentioned in that
    |
0008|     act.  The provisions of the 1996 Capital Projects General
    |
0009|     Obligation Bond Act constitute an irrepealable contract with
    |
0010|     the owners of any of the bonds issued pursuant to that act for
    |
0011|     the faithful performance of which the full faith and credit of
    |
0012|     the state of New Mexico is hereby pledged.  Without reference
    |
0013|     to any other act of the legislature of the state, the 1996
    |
0014|     Capital Projects General Obligation Bond Act is full authority
    |
0015|     for the issuance and sale of the bonds authorized in that act,
    |
0016|     and such bonds shall have all the qualities of investment
    |
0017|     securities under the Uniform Commercial Code of the state,
    |
0018|     shall not be invalid for any irregularity or defect in the
    |
0019|     proceedings for the issuance and sale of the bonds and shall be
    |
0020|     incontestable in the hands of bona fide purchasers or holders
    |
0021|     thereof for value.  All bonds issued under the provisions of
    |
0022|     the 1996 Capital Projects General Obligation Bond Act, and the
    |
0023|     interest thereon, are exempt from taxation by the state and any
    |
0024|     subdivision or public body thereof.
    |
0025|         Section 10.  The proceeds from the sale of bonds issued
    |
0001|     under the provisions of the 1996 Capital Projects General
    |
0002|     Obligation Bond Act shall be distributed as follows for the
    |
0003|     purposes and in the amounts specified:
    |
0004|              A.  for senior citizen facility construction,
    |
0005|     equipment and improvements, to the state agency on aging:
    |
0006|                   (1)  three hundred seventy-six thousand dollars
    |
0007|     ($376,000) for the purpose of renovating and making
    |
0008|     improvements to meet current codes and regulations regarding
    |
0009|     health, safety and accessibility at senior centers and meal
    |
0010|     sites located throughout the state;
    |
0011|                   (2)  one million twenty-nine thousand nine
    |
0012|     hundred dollars ($1,029,900) to be allocated to senior citizen
    |
0013|     centers and programs for the purpose of purchasing vehicles for
    |
0014|     senior citizen centers and programs located throughout the
    |
0015|     state;
    |
0016|                   (3)  two hundred twenty-one thousand one hundred
    |
0017|     dollars ($221,100) to be allocated to nutrition programs for
    |
0018|     the purpose of purchasing kitchen equipment for nutrition
    |
0019|     programs located throughout the state;
    |
0020|                   (4)  eight hundred two thousand dollars
    |
0021|     ($802,000) for the purpose of renovating and making
    |
0022|     improvements to senior centers and meal sites located
    |
0023|     throughout the state; and
    |
0024|                   (5)  one hundred thousand dollars ($100,000) for

0001|     citizen center located in Santa Fe county;
    |
0002|              B.  for public educational capital improvements and
    |

0005|     community college, two million dollars ($2,000,000) for the
    |
0006|     purpose of planning, designing, constructing and equipping an
    |
0007|     instructional technology center at Santa Fe community college
    |
0008|     located in Santa Fe county;
    |
0009|                   (2)  to the board of regents of northern New
    |
0010|     Mexico state school:
    |
0011|                        (a)  five hundred thousand dollars
    |
0012|     ($500,000) for the purpose of renovating, expanding and

    |

    |
0023|     rebuild, expand and equip Saunders barracks;
    |
0024|                   (4)  to the governing board of Luna vocational-technical institute, six hundred fifty thousand dollars

0025|     ($650,000) for the purpose of constructing an addition to,
    |
0001|     remodeling and landscaping the existing vocational agriculture
    |
0002|     facility for use as an early childhood education and
    |
0003|     permaculture center at the main campus located in San Miguel

0006|     facilities, five million dollars ($5,000,000) to the property
    |
0007|     control division of the general services department to plan,
    |
0008|     design, construct and equip juvenile correctional and
    |
0009|     rehabilitative facilities; and
    |
0010|              E.  for land acquisition, one million dollars
    |
0011|     ($1,000,000) to the energy, minerals and natural resources
    |
0012|     department for the purpose of acquiring land for Petroglyph
    |
0013|     national monument located in Bernalillo county.
    |
0014|         Section 11.  Except as otherwise provided in the 1996
    |
0015|     Capital Projects General Obligation Bond Act, bonds issued
    |
0016|     pursuant to that act shall be submitted to the registered
    |
0017|     voters of the state at the general election to be held in
    |
0018|     November 1996 and, if they receive a majority of all the votes
    |
0019|     cast thereon at such election, shall take effect upon
    |
0020|     certification of the state canvassing board announcing the
    |
0021|     results of that election.  No bonds shall be issued or sold
    |
0022|     under the 1996 Capital Projects General Obligation Bond Act
    |
0023|     until the registered voters of this state have voted upon and
    |
0024|     approved the bonds and property tax imposition as provided in
    |
0025|     this section.  Any bonds issued under that act shall be issued
    |
0001|     within twenty-six months from the date of the general election. 
    |
0002|     
    |
0003|         The ballots used at the 1996 general election shall
    |
0004|     contain substantially the following language: 
    |
0005|              A.  "The 1996 Capital Projects General Obligation Bond
    |
0006|     Act authorizes the issuance and sale of senior citizen facility
    |
0007|     construction, improvements and equipment bonds.  Shall the
    |
0008|     state of New Mexico be authorized to issue general obligation
    |
0009|     bonds in an amount not to exceed two million five hundred
    |
0010|     forty-four thousand one hundred five dollars ($2,544,105) to
    |
0011|     make capital expenditures for certain senior citizen facility
    |
0012|     construction improvements and equipment projects and provide
    |

    |
0016|         Each question set forth in this section includes a
    |
0017|     specific work or object to be financed by the bonds.  If any
    |
0018|     such question is not approved by a majority vote of the
    |
0019|     electorate at the state's 1996 general election, the issuance
    |
0020|     of bonds for the work or object specified by the question shall
    |
0021|     be excluded from and shall not be part of the 1996 Capital
    |
0022|     Projects General Obligation Bond Act.  The failure of any
    |
0023|     question to be approved by the electorate at the 1996 general
    |
0024|     election shall not have any effect on the work or object
    |
0025|     specified by any other question approved by the electorate or
    |
0001|     the provisions of the 1996 Capital Projects General Obligation
    |
0002|     Bond Act relating to questions approved at the election.  
    |
0003|         The secretary of state shall include the submission of the
    |
0004|     capital projects general obligation bonds to the people at the
    |
0005|     1996 general election, and it shall be included in the general
    |
0006|     election proclamation of each of the county clerks.
    |
0007|       The secretary of state shall not include the question of
    |
0008|                                                               whether to issue capital projects general obligation bonds for
    |
0009|                                                               the purpose of acquiring land for Petroglyph national monument,
    |
0010|                                                               as set forth in Section 11 of the 1996 Capital Projects General
    |
0011|                                                               Obligation Bond Act, on the general election proclamation or on
    |
0012|                                                               the general election ballot unless, prior to June 1, 1996, the
    |
0013|                                                               secretary of the interior certifies in writing to the secretary
    |
0014|                                                               of state that the United States department of the interior will
    |
0015|                                                               assist in the expedited construction of certain portions of the
    |
0016|                                                               Paseo del Norte extension project and that the United States
    |
0017|                                                               department of the interior will work in good faith to eliminate
    |
0018|                                                               all federal impediments to the construction of that extension.
    |
0019|                                                                   The secretary of state shall cause the 1996 Capital
    |
0020|                                                               Projects General Obligation Bond Act to be published in full in
    |
0021|                                                               at least one newspaper in each county of the state, if one is
    |
0022|                                                               published therein, once each week for four successive weeks
    |
0023|                                                               next preceding the general election as required by the
    |
0024|                                                               constitution of New Mexico. 
    |
0025|                                                                   Section 12.  ART IN PUBLIC PLACES.--Pursuant to Section 
    |
0001|                                                               13-4A-4 NMSA 1978 and where applicable, the appropriations
    |
0002|                                                               authorized in the 1996 Capital Projects General Obligation Bond
    |
0003|                                                               Act include one percent for the art in public places fund.
    |
0004|                                                                   Section 13.  SEVERABILITY.--If any part or application of
    |
0005|                                                               the 1996 Capital Projects General Obligation Bond Act is held
    |
0006|                                                               invalid, the remainder or its application to other situations
    |
0007|                                                               or persons shall not be affected.
    |
0008|                                                                Section 14.  EMERGENCY.--It is necessary for the public
    |
0009|                                                               peace, health and safety that this act take effect immediately.
