    |
0012|     RELATING TO EDUCATION; CREATING THE PUBLIC EDUCATION STRATEGIC
    |
0013|     PLANNING TEAM; PRESCRIBING POWERS AND DUTIES; ENACTING THE
    |
0014|     STRATEGIC PLANNING FOR PUBLIC EDUCATION ACT; MAKING AN
    |
0015|     APPROPRIATION; DECLARING AN EMERGENCY.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|       Section 1.  SHORT TITLE.--This act may be cited as the
    |
0019|     "Strategic Planning for Public Education Act".
    |
0020|       Section 2.  FINDINGS AND PURPOSE.--
    |
0021|            A.  The legislature finds that New Mexico has been
    |
0022|     involved in multiple restructuring and systemic change
    |
0023|     initiatives to improve the elementary and secondary educational
    |
0024|     system and that a comprehensive framework for education that can
    |
0025|     sustain targeted goals and objectives is necessary for long-term
    |
0001|     support from all branches of government and the public.
    |
0002|            B.  The legislature finds that a comprehensive
    |
0003|     elementary and secondary education framework can be established
    |
0004|     through a strategic planning process that provides the
    |
0005|     opportunity for all branches of government and the public to
    |
0006|     reach consensus about the purpose of schooling and to
    |
0007|     concentrate all efforts, resources, activities and energies
    |
0008|     toward maximizing the efficiency and effectiveness of the
    |
0009|     educational system to best prepare New Mexico's students for the
    |
0010|     future.
    |
0011|            C.  It is the purpose of the Strategic Planning for
    |
0012|     Public Education Act to:
    |
0013|                 (1)  develop a statewide strategic plan for
    |
0014|     public school education that provides a well-defined vision and
    |
0015|     articulated steps to achieve national preeminence in education;
    |
0016|                 (2)  gain statewide consensus by encouraging the
    |
0017|     governor's office and related state agencies, the legislature,
    |
0018|     the state board of education, the state department of public
    |
0019|     education, local boards of education, school personnel, parents,
    |
0020|     students, the business community and each school district's
    |
0021|     community to work together toward the common goal of improving
    |
0022|     educational opportunities and performance of all New Mexico's
    |
0023|     children and youth; and
    |
0024|                 (3)  develop a plan to coordinate the state-level planning cycle with the budgeting cycle to ensure that the
    |
0025|     strategic plan drives state-level funding decisions.
    |
0001|       Section 3.  PUBLIC EDUCATION STRATEGIC PLANNING TEAM.--
    |
0002|            A.  There is created a "public education strategic
    |
0003|     planning team", which shall function from the date of its
    |
0004|     appointment until December 31, 1996.
    |
0005|            B.  The public education strategic planning team 
    |
0006|     shall be composed of thirty members representative of the
    |
0007|     different geographical areas of the state and reflective of the
    |
0008|     diverse population of the state and shall be appointed as
    |
0009|     follows:
    |
0010|                 (1) two members from the house of
    |
0011|     representatives, one from each party, appointed by the speaker
    |
0012|     of the house;
    |
0013|                 (2) two members from the senate, one from each
    |
0014|     party, appointed by the president pro tempore of the senate;
    |
0015|                 (3) two members from the state board of
    |
0016|     education appointed by the president of the state board of
    |
0017|     education;
    |
0018|                 (4)  three members appointed by the governor
    |
0019|     from the executive branch, of whom one shall be from the
    |
0020|     children, youth and families department and one of whom shall be
    |
0021|     from the department of health; 
    |
0022|                 (5)  nine members from the educational system
    |
0023|     who shall include a local school board member, a superintendent,
    |
0024|     a principal, a student, a classified staff member, a
    |
0025|     representative from higher education and three teachers
    |
0001|     appointed jointly by the governor, the speaker of the house, the
    |
0002|     president pro tempore of the senate and the president of the
    |
0003|     state board of education; and
    |
0004|                 (6)  twelve members of the public who shall
    |
0005|     include parents and members of the business community appointed
    |
0006|     jointly by the governor, the speaker of the house, the 
    |
0007|     president pro tempore of the senate and the president of the
    |
0008|     state board of education.   
    |
0009|            B.  The legislative education study committee shall
    |
0010|     solicit recommendations from the public and organizations
    |
0011|     representative of the categories specified in Paragraphs (5) and
    |
0012|     (6) of Subsection A of this section to compile a list of names
    |
0013|     from each of the categories listed.  The governor, the speaker
    |
0014|     of the house, the president pro tempore of the senate and the
    |
0015|     president of the state board of education shall jointly appoint
    |
0016|     the members from the educational system and members of the
    |
0017|     public from the list provided by the legislative education study
    |
0018|     committee.
    |
0019|            C.  Appointed members of the public education
    |
0020|     strategic planning team shall be reimbursed as provided in the
    |
0021|     Per Diem and Mileage Act and shall receive no other
    |
0022|     compensation, perquisite or allowance.
    |
0023|       Section 4.  DUTIES.--
    |
0024|            A.  The public education strategic planning team
    |
0025|     shall:
    |
0001|                 (1)  develop and reach consensus on a statewide
    |
0002|     strategic plan for New Mexico public schools that makes New
    |
0003|     Mexico preeminent in education in the nation.  The plan shall 
    |
0004|     include the development of a mission statement focused on
    |
0005|     objectives and strategies that may include issues such as
    |
0006|     professional development, accountability and resource planning;
    |
0007|                 (2)  review and approve action plans to ensure
    |
0008|     that each action plan is aligned with the vision and goals of
    |
0009|     the statewide strategic plan and clearly delineates timelines,
    |
0010|     expected outcomes and parties responsible for carrying out the
    |
0011|     action plans;
    |
0012|                 (3)  develop a consensus-building strategy to
    |
0013|     inform the public and develop consensus among New Mexicans about
    |
0014|     the strategic plan; and
    |
0015|                 (4)  develop and recommend a schedule of
    |
0016|     implementation for the strategies and action plans that includes
    |
0017|     a program budgeting system having a year-by-year cost projection
    |
0018|     for implementing the plans.
    |
0019|            B.  In developing the statewide strategic plan, the
    |
0020|     public education strategic planning team shall allow for the
    |
0021|     autonomy of local districts and shall take into account existing
    |
0022|     initiatives that the state has been involved in, including the
    |
0023|     legislative education study committee's initiatives, the state
    |
0024|     board of education's consolidating initiatives for tomorrow's
    |
0025|     education, school-to-work and other state agency initiatives and
    |
0001|     state and local district initiatives.
    |
0002|       Section 5.  REPORT.--The public education strategic
    |
0003|     planning team shall make a report of its findings and
    |
0004|     recommendations to the first session of the forty-third
    |
0005|     legislature regarding necessary legislation to begin
    |
0006|     implementation of the statewide strategic plan, including in its
    |
0007|     recommendations a plan for annual updates of the strategic
    |
0008|     statewide plan on ways to coordinate the planning cycle with the
    |
0009|     budgeting cycle to ensure that the strategic plan drives state
    |
0010|     funding decisions; to assess progress as measured by the
    |
0011|     strategies and action plans; and to make modifications and
    |
0012|     adjustments to the statewide strategic plan.  The report of
    |
0013|     findings and recommendations shall be made available to the
    |
0014|     speaker of the house, the president pro tempore of the senate,
    |
0015|     the legislative education study committee, the governor and the
    |
0016|     state board of education no later than November 15, 1996.
    |
0017|       Section 6.  STAFF.--The staff for the public education
    |
0018|     strategic planning team and action teams shall be provided by
    |
0019|     the legislative education study committee, the governor's office
    |
0020|     and the state board of education.  The staff shall be
    |
0021|     responsible for compilation of current education data and
    |
0022|     information for review and use by the planning teams,
    |
0023|     coordination of meetings and overall management of the project. 
    |
0024|     The legislative education study committee in cooperation with
    |
0025|     the state board of education and the governor's office shall
    |
0001|     coordinate the project.  The legislative education study
    |
0002|     committee, in consultation with the state board of education and
    |
0003|     the governor's office, may contract for strategic planning
    |
0004|     assistance.
    |
0005|       Section 7.  APPROPRIATION.--One hundred thousand dollars
    |
0006|     ($100,000) is appropriated from the general fund to the
    |
0007|     legislative education study committee for expenditure in fiscal
    |
0008|     years 1996 and 1997 for the purpose of carrying out the
    |
0009|     provisions of the Strategic Planning for Public Education Act. 
    |
0010|     Any unexpended or unencumbered balance remaining at the end of
    |
0011|     fiscal year 1997 shall revert to the general fund.
    |
0012|       Section 8.  EMERGENCY.--It is necessary for the public
    |
0013|     peace, health and safety that this act take effect immediately.
