0012|     AMENDING SECTION 22-1-2.1 NMSA 1978 (BEING LAWS 1985, CHAPTER

0013|     21, SECTION 2, AS AMENDED) PERTAINING TO THE OPERATION OF HOME

0014|     SCHOOLS.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  Section 22-1-2.1 NMSA 1978 (being Laws 1985,
    |
0018|     Chapter 21, Section 2, as amended by Laws 1993, Chapter 62,
    |
0019|     Section 2 and also by Laws 1993, Chapter 226, Section 1) is
    |
0020|     amended to read:
    |
0021|       "22-1-2.1.  HOME SCHOOL--REQUIREMENTS.--Any person
    |
0022|     operating or intending to operate a home school shall:
    |
0023|            A.  notify the superintendent of schools of the
    |
0024|     school district in which the person is a resident of the
    |
0025|     establishment of a home school within thirty days of its
    |
0001|     establishment and notify the superintendent of schools of the
    |
0002|     school district on or before April 1 of each subsequent year of
    |
0003|     operation;
    |
0004|            B.  maintain records of student attendance and
    |
0005|     disease immunization and furnish such records to the
    |
0006|     superintendent of schools of the school district;
    |
0007|            C.  provide instruction <s>[by a person possessing at
</s>    |
<s></s>0008| <s>    least a high school diploma or its equivalent]</s> <u>in a manner
</u>    |
<u></u>0009| <u>    that is substantially comparable to that required by statute and
</u>    |
<u></u>0010| <u>    regulation for students in public school</u>; and
    |
0011|            D.  test students annually to assess student
    |
0012|     achievement according to the statewide and local school district
    |
0013|     testing programs as determined by the state superintendent.  The
    |
0014|     home school child shall take such achievement tests at a time
    |
0015|     and place and in a manner consistent with the procedures
    |
0016|     established by the state superintendent."
