SHORT TITLE.--This act may be cited as the | 0020| "Occupational Therapy Act". | 0021| Section 2. PURPOSE.--It is the purpose of the Occupational | 0022| Therapy Act to provide for the regulation of persons offering | 0023| occupational therapy services to the public in order to | 0024| safeguard the public health, safety and welfare, to protect the | 0025| public from being misled by incompetent and unauthorized | 0001| persons, to assure the highest degree of professional conduct on | 0002| the part of registered occupational therapists and certified | 0003| occupational therapy assistants and to assure the availability | 0004| of occupational therapy services of high quality to persons in | 0005| need of such services. | 0006| Section 3. DEFINITIONS.--As used in the Occupational | 0007| Therapy Act: | 0008| A. "board" means the board of examiners for | 0009| occupational therapy; | 0010| B. "censure" means a formal expression of | 0011| disapproval that is publicly announced; | 0012| C. "certified occupational therapy assistant" means | 0013| a person having no less than an associate degree in occupational | 0014| therapy who is certified by the American occupational therapy | 0015| certification board and licensed in New Mexico to assist a | 0016| registered occupational therapist in occupational therapy under | 0017| the supervision of the registered occupational therapist; | 0018| D. "denial of license" means that a person is barred | 0019| from becoming licensed to practice in accordance with the | 0020| provisions of the Occupational Therapy Act either indefinitely | 0021| or for a certain period; | 0022| E. "licensee" means a registered occupational | 0023| therapist or certified occupational therapy assistant, as | 0024| appropriate; | 0025| F. "occupational therapy" means the use of | 0001| purposeful activity or intervention designed to achieve | 0002| functional outcomes that promote health, prevent injury or | 0003| disability and develop, improve, sustain or restore to the | 0004| highest possible level of independence a person who has an | 0005| injury, illness, psychosocial dysfunction, mental illness, | 0006| developmental or learning disability, physical disability or | 0007| other disorder or condition; | 0008| G. "occupational therapy aide or technician" means | 0009| an unlicensed person who assists in occupational therapy, who | 0010| works under direct supervision of a registered occupational | 0011| therapist or certified occupational therapy assistant; | 0012| H. "person" means an individual, association, | 0013| partnership, unincorporated organization or corporate body; | 0014| I. "probation" means continued licensure is subject | 0015| to fulfillment of specified conditions such as monitoring, | 0016| education, supervision or counseling; | 0017| J. "registered occupational therapist" means a | 0018| person having no less than a baccalaureate degree in | 0019| occupational therapy who is registered by the American | 0020| occupational therapy certification board and licensed in New | 0021| Mexico to practice occupational therapy; | 0022| K. "reprimand" means a formal expression of | 0023| disapproval that shall be retained in the licensee's file but | 0024| shall not be publicly announced; | 0025| L. "revocation" means permanent loss of licensure; | 0001| and | 0002| M. "suspension" means the loss of licensure for | 0003| a certain period, after which the person may be required to | 0004| apply for reinstatement. | 0005| Section 4. OCCUPATIONAL THERAPY SERVICES.-- | 0006| A. Occupational therapy services include the | 0007| assessment, reassessment, planning and discontinuation of: | 0008| (1) the provision of treatment in consultation | 0009| with the individual, family or other appropriate persons; | 0010| (2) treatment directed toward developing, | 0011| improving or restoring daily living skills, including self-care | 0012| skills and activities that involve interactions with others and | 0013| the environment, work readiness or work performance, play skills | 0014| or leisure capacities or enhancing educational performance | 0015| skills; | 0016| (3) the development, improvement or restoration | 0017| of sensorimotor, perceptual or neuromuscular functioning; or | 0018| emotional, motivational, cognitive or psychosocial components of | 0019| performance; and | 0020| (4) education of individuals, families or the | 0021| appropriate persons in carrying out appropriate treatment | 0022| objectives. | 0023| B. The services provided for in Subsection A of this | 0024| section shall encompass the assessment of needs and the design, | 0025| development, adaptation, application or training in the use of | 0001| assistive technology devices; the design, fabrication or | 0002| application of rehabilitative technology such as selected | 0003| orthotic devices; training in the use of orthotic devices; the | 0004| application and training in the use of physical agent modalities | 0005| as an adjunct to or in preparation for purposeful activity; the | 0006| application of ergonomic principles; the adaptation of | 0007| environments and processes to enhance functional performance; | 0008| and the promotion of health and wellness. | 0009| Section 5. SUPERVISION--REQUIRED--DEFINED.--No | 0010| occupational therapy shall be performed by any certified | 0011| occupational therapy assistant, occupational therapy aide or | 0012| technician, or by any person practicing on a provisional permit, | 0013| unless such therapy is supervised by a registered occupational | 0014| therapist. The board shall adopt regulations defining | 0015| supervision, which definitions may include various categories | 0016| such as "close supervision", "routine supervision" and "general | 0017| supervision". | 0018| Section 6. LICENSE REQUIRED.-- | 0019| A. Unless licensed to practice the level of | 0020| occupational therapy provided in the Occupational Therapy Act, | 0021| no person shall practice as a registered occupational therapist | 0022| or certified occupational therapy assistant. | 0023| B. It is unlawful for any person not licensed | 0024| pursuant to the Occupational Therapy Act or whose license has | 0025| been denied, suspended or revoked in this or another state to | 0001| hold himself out as a registered occupational therapist or | 0002| certified occupational therapy assistant or to use words or | 0003| titles containing "occupational therapist", "registered | 0004| occupational therapist", "occupational therapy assistant" or | 0005| "certified occupational therapy assistant" that would indicate | 0006| or imply that the person is licensed as a registered | 0007| occupational therapist or certified occupational therapy | 0008| assistant. | 0009| C. No facility or employer shall represent that it | 0010| offers occupational therapy unless it utilizes the services of a | 0011| licensee pursuant to the provisions of the Occupational Therapy | 0012| Act. | 0013| D. A person offering or assisting in the offering of | 0014| occupational therapy shall be properly identified by a name | 0015| badge or other identification indicating whether he is a | 0016| registered occupational therapist, certified occupational | 0017| therapy assistant, an occupational therapy aide or technician or | 0018| a person practicing under a provisional permit. | 0019| Section 7. EXEMPTIONS.--Nothing in the Occupational | 0020| Therapy Act shall be construed as preventing or restricting the | 0021| practice, services or activities of: | 0022| A. a person engaged in the profession or occupation | 0023| for which he is licensed in New Mexico; | 0024| B. a person lawfully engaged in a profession or | 0025| occupation known by a name other than occupational therapy when | 0001| engaged in that profession or occupation; | 0002| C. a person pursuing a course of study leading to a | 0003| degree or certificate in occupational therapy in an educational | 0004| program accredited or seeking accreditation by the accreditation | 0005| council of occupational therapy education if the activities and | 0006| services constitute part of the supervised course of study and | 0007| if that person is designated by a title that clearly indicates | 0008| his status as a student or trainee; | 0009| D. a person fulfilling the supervised student field | 0010| work experience requirement pursuant to the Occupational Therapy | 0011| Act if the activities and services constitute part of the | 0012| experience necessary to meet that requirement; and | 0013| E. an occupational therapist or occupational therapy | 0014| assistant licensed in another state from conducting continuing | 0015| education, workshops or seminars in New Mexico. | 0016| Section 8. BOARD CREATED.-- | 0017| A. The "board of examiners for occupational therapy" | 0018| is created. | 0019| B. The board shall consist of five members appointed | 0020| by the governor who have been residents of the state for two | 0021| years preceding the appointment. | 0022| C. Three members shall be licensed under the | 0023| provisions of the Occupational Therapy Act; have a minimum of | 0024| five years' professional experience, with two years' experience | 0025| in New Mexico; and have not had their licenses suspended or | 0001| revoked by this or any other state. One of the professional | 0002| members may be a certified occupational therapy assistant; one | 0003| of the professional members may be a retired registered | 0004| occupational therapist. | 0005| D. The two public members shall have no direct | 0006| interest in the profession of occupational therapy. The public | 0007| members shall not: | 0008| (1) have been convicted of a felony; | 0009| (2) be habitually intemperate or be addicted to | 0010| the use of habit-forming drugs or be addicted to any vice to | 0011| such a degree as to render him unfit to fulfill his board duties | 0012| and responsibilities; or | 0013| (3) be guilty of any violation of the | 0014| Controlled Substances Act. | 0015| E. Appointments shall be made for staggered terms of | 0016| three years with no more than two terms ending at any one time. | 0017| No board member shall serve more than two consecutive terms. | 0018| Vacancies shall be filled for the unexpired term by appointment | 0019| by the governor prior to the next scheduled board meeting. | 0020| F. No individual member of the board is liable in a | 0021| civil or criminal action for any act performed in good faith in | 0022| the execution of his duties as a member of the board. | 0023| G. Members of the board shall be reimbursed for per | 0024| diem and travel expenses as provided in the Per Diem and Mileage | 0025| Act and shall receive no other compensation, perquisite or | 0001| allowance. | 0002| H. A simple majority of the board members currently | 0003| serving shall constitute a quorum of the board for the conduct | 0004| of business. | 0005| I. The board shall meet at least four times a year | 0006| and at such other times as it deems necessary. Additional | 0007| meetings may be convened at the call of the president of the | 0008| board or on the written request of any two board members to the | 0009| president. Meetings of the board shall be conducted in | 0010| accordance with the provisions of the Open Meetings Act. | 0011| J. Any member failing to attend three consecutive | 0012| meetings, unless excused as provided by board policy, shall | 0013| automatically be recommended for removal as a member of the | 0014| board. | 0015| K. At the beginning of each fiscal year, the board | 0016| shall elect a president, vice president and a secretary-treasurer. | 0017| Section 9. BOARD--POWERS AND DUTIES.-- | 0018| A. The board shall: | 0019| (1) adopt, file, amend or repeal rules and | 0020| regulations in accordance with the Uniform Licensing Act to | 0021| carry out the provisions of the Occupational Therapy Act; | 0022| (2) use funds for the purpose of meeting the | 0023| necessary expenses incurred in carrying out the provisions of | 0024| the Occupational Therapy Act; | 0025| (3) adopt a code of ethics; | 0001| (4) enforce the provisions of the Occupational | 0002| Therapy Act to protect the public by conducting hearings on | 0003| charges relating to the discipline of licensees, including the | 0004| denial, suspension or revocation of a license; | 0005| (5) establish and collect fees; | 0006| (6) provide for examination for and issuance, | 0007| renewal and reinstatement of licenses; | 0008| (7) establish, impose and collect fines for | 0009| violations of the Occupational Therapy Act; | 0010| (8) appoint a registrar to keep records and | 0011| minutes necessary to carry out the functions of the board; and | 0012| (9) obtain the legal assistance of the attorney | 0013| general. | 0014| B. The board may: | 0015| (1) hire or contract with an attorney to give | 0016| advice and counsel in regard to any matter connected with the | 0017| duties of the board, to represent the board in any legal | 0018| proceedings and to aid in the enforcement of the Occupational | 0019| Therapy Act; the board shall set the compensation of the | 0020| attorney to be paid from the funds of the board; | 0021| (2) issue investigative subpoenas for the | 0022| purpose of investigating complaints against licensees prior to | 0023| the issuance of a notice of contemplated action; | 0024| (3) hire or contract with an investigator to | 0025| investigate complaints that have been filed with the board; the | 0001| board shall set the compensation of the investigator to be paid | 0002| from the funds of the board; | 0003| (4) inspect establishments; and | 0004| (5) designate hearing officers. | 0005| Section 10. BOARD--ADMINISTRATIVE PROCEDURES.-- | 0006| A. The board may employ and discharge such employees | 0007| as it deems necessary and shall determine their duties and set | 0008| their compensation. | 0009| B. The board shall appoint a registrar who is either | 0010| the board member elected as the secretary-treasurer or such | 0011| other person as the board may designate who is an employee of | 0012| the board or the state. The registrar of the board may receive | 0013| reimbursement for necessary expenses incurred in carrying out | 0014| his duties and, if he is an employee, such compensation as the | 0015| board may set. The registrar shall keep a written record in | 0016| which shall be registered the name, license number, date of | 0017| license issuance, current address, record of annual license fee | 0018| payments, minutes and any other data as the board deems | 0019| necessary regarding licensees. | 0020| Section 11. REQUIREMENTS FOR LICENSURE.-- | 0021| A. A license to practice as a registered | 0022| occupational therapist or a certified occupational therapy | 0023| assistant shall be issued to any person who files a completed | 0024| application, accompanied by the required fees and documentation, | 0025| and who submits satisfactory evidence that the applicant has: | 0001| (1) successfully completed the academic | 0002| requirements of an educational program in occupational therapy | 0003| that is either: | 0004| (a) accredited by the American | 0005| occupational therapy association's accreditation council for | 0006| occupational therapy education; or | 0007| (b) in the case of a foreign-trained | 0008| occupational therapist, accepted by the American occupational | 0009| therapy certification board when the therapist applies to take | 0010| that board's examination; | 0011| (2) successfully completed a period of | 0012| supervised field work experience at a recognized educational | 0013| institution or a training program approved by the educational | 0014| institution where the registered occupational therapist or the | 0015| certified occupational therapy assistant has met the academic | 0016| requirements of Paragraph (1) of this subsection; | 0017| (3) has passed an examination prescribed by the | 0018| American occupational therapy certification board or the board | 0019| of examiners for occupational therapy; and | 0020| (4) has no record of unprofessional conduct or | 0021| incompetency. | 0022| B. In the case of a certified occupational therapy | 0023| assistant or a person practicing on a provisional permit, the | 0024| applicant shall file with the board a signed, current statement | 0025| of supervision by the registered occupational therapist who will | 0001| be the responsible supervisor. | 0002| C. The board shall verify, as necessary, information | 0003| contained on the completed application and any supporting | 0004| documentation required to obtain a license. | 0005| Section 12. EXAMINATIONS.--The board shall require proof | 0006| of passage of the American occupational therapy certification | 0007| board examination. The board may require each applicant to pass | 0008| an examination on the state laws, rules and regulations that | 0009| pertain to the practice of occupational therapy. | 0010| Section 13. PROVISIONAL PERMITS.--A provisional permit may | 0011| be granted to a person who has completed the education and | 0012| experience requirements of the Occupational Therapy Act. The | 0013| permit shall allow the person to practice occupational therapy | 0014| under the supervision of a registered occupational therapist. | 0015| The provisional permit shall be valid until the date on which | 0016| the results of the next qualifying examination have been made | 0017| public. The provisional permit shall not be renewed if the | 0018| applicant has failed the examination. The board shall verify, | 0019| as necessary, information contained on the completed application | 0020| and any supporting documentation required to obtain a license. | 0021| Section 14. LICENSURE BY ENDORSEMENT.--Upon verification, | 0022| the board may grant a license to any applicant who presents a | 0023| current license in good standing as a registered occupational | 0024| therapist or a certified occupational therapy assistant in | 0025| another state, the District of Columbia or a territory of the | 0001| United States that meets the requirements of Section 11 of the | 0002| Occupational Therapy Act. | 0003| Section 15. LICENSE RENEWAL.-- | 0004| A. Each renewal request shall contain the person's | 0005| name, address and license number. After receipt of information | 0006| and fees as prescribed by this section, the board shall issue a | 0007| license certificate. | 0008| B. Licenses issued pursuant to the Occupational | 0009| Therapy Act are subject to annual renewal upon submission of a | 0010| renewal form provided by the board, payment of the annual | 0011| renewal fee and the required proof of continuing education units | 0012| or proof of competency as prescribed by the board. A license | 0013| not renewed on the annual renewal date is expired. | 0014| C. If a person's license has been expired for five | 0015| years or less, the person may renew the license upon submission | 0016| of a renewal form provided by the board, the payment of the | 0017| annual renewal fee, a late fee and the required proof of | 0018| continuing education units for the period the license has been | 0019| expired or proof of competency as prescribed by the board. If a | 0020| person's license has been expired for more than five years, the | 0021| person may not renew the license. The person may obtain a new | 0022| license by compliance with the requirements and procedures for | 0023| obtaining an original license and any additional proof of | 0024| competency requested by the board. | 0025| D. If a person's license has been suspended, it | 0001| shall not be renewed until it has been reinstated by the board. | 0002| If a person's license has been suspended it is still subject to | 0003| annual renewal. The person may renew the license as provided in | 0004| this section, but renewal does not entitle the licensee, while | 0005| the license is suspended, to engage in the licensed activity or | 0006| in any other conduct or activity in violation of the order or | 0007| judgment by which the license was suspended. | 0008| E. If a person's license has been revoked on | 0009| disciplinary grounds, and has been reinstated by the board, the | 0010| licensee shall pay the annual renewal fee and any applicable | 0011| late fee as a condition of reinstatement. | 0012| Section 16. DISPLAY OF LICENSE.-- | 0013| A. Each licensee shall display his current license | 0014| certificate in a conspicuous place in the principal office where | 0015| he practices occupational therapy. At secondary places of | 0016| employment, documentation of license shall be verified by | 0017| photocopy with a note attached indicating where the current | 0018| license certificate is posted. | 0019| B. A consumer information sign shall be displayed in | 0020| the principal place of practice. The consumer information sign | 0021| shall read: | 0022| "Complaints regarding noncompliance with | 0023| the Occupational Therapy Act can be | 0024| directed to the board of examiners for | 0025| occupational therapy". | 0001| Section 17. INACTIVE LICENSES.--A license in good standing | 0002| may be transferred to inactive status upon written request to | 0003| the board and payment of an annual inactive status fee as set by | 0004| the board. Such request shall be made prior to the expiration | 0005| of the license. The licensee shall not practice in New Mexico | 0006| during the time the license is inactive. A licensee may | 0007| reactivate his license upon submission of a renewal form | 0008| provided by the board, the payment of the annual renewal fee for | 0009| the current year, proof of continuing education units for the | 0010| period of inactive status and any additional proof of competency | 0011| requested and prescribed by the board. | 0012| Section 18. FEES.--The board shall establish a schedule of | 0013| reasonable fees, including an initial licensure fee, an annual | 0014| renewal fee, an examination fee, a late renewal fee and an | 0015| inactive status fee. The initial licensure fee is not | 0016| refundable and shall cover the cost of processing the | 0017| application and shall include, for successful applicants, the | 0018| initial annual renewal fee. The board may impose reasonable | 0019| administration and duplicating fees or any penalties deemed | 0020| appropriate. | 0021| Section 19. UNIFORM LICENSING ACT.--The Occupational | 0022| Therapy Act is enforceable according to the procedures set forth | 0023| in the Uniform Licensing Act. | 0024| Section 20. FUND CREATED.-- | 0025| A. The "board of examiners for occupational therapy | 0001| fund" is created in the state treasury. | 0002| B. Money received by the board pursuant to the | 0003| Occupational Therapy Act shall be deposited in the fund. Money | 0004| in the fund shall not revert to the general fund at the end of | 0005| any fiscal year. | 0006| C. Money in the fund is appropriated solely to the | 0007| board for the purpose of meeting the necessary expenses incurred | 0008| in carrying out the provisions of the Occupational Therapy Act. | 0009| Section 21. PENALTIES.-- | 0010| A. An unlicensed person, other than an occupational | 0011| therapy aide or technician, occupational therapy student or | 0012| occupational therapy assistant student or person practicing | 0013| under a provisional permit, who practices occupational therapy | 0014| is guilty of a misdemeanor and upon conviction shall be | 0015| sentenced pursuant to Section 31-19-1 NMSA 1978. | 0016| B. A person who represents that he offers | 0017| occupational therapy services without utilizing a licensee is in | 0018| violation of the Occupational Therapy Act and shall be subject | 0019| to a fine equal to ten percent of billed charges for those | 0020| services. In addition, the violator shall be required to | 0021| utilize the services of a licensee in order to provide | 0022| occupational therapy services. | 0023| C. The board shall deny an application for licensure | 0024| if it finds that the applicant made false statements or provided | 0025| false information in connection with an application for | 0001| licensure. | 0002| Section 22. DISCIPLINARY ACTION--DENIAL, SUSPENSION OR | 0003| REVOCATION.--In accordance with procedures established by the | 0004| Uniform Licensing Act, the board may deny, suspend or revoke any | 0005| license or permit held or applied for under the Occupational | 0006| Therapy Act upon the grounds that the licensee or applicant is | 0007| incompetent, impaired or has engaged in unethical behavior. The | 0008| board shall define such grounds by regulation. Disciplinary | 0009| sanctions may also include probation, censure or reprimand, | 0010| according to board regulations. | 0011| Section 23. CRIMINAL OFFENDER EMPLOYMENT ACT.--The | 0012| provisions of the Criminal Offender Employment Act shall govern | 0013| any consideration of criminal records required or permitted by | 0014| the Occupational Therapy Act. | 0015| Section 24. TERMINATION OF AGENCY LIFE--DELAYED | 0016| REPEAL.--The board of examiners for occupational therapy is | 0017| terminated on July 1, 1997 pursuant to the provisions of the | 0018| Sunset Act. The board shall continue to operate according to | 0019| the provisions of the Occupational Therapy Act until July 1, | 0020| 1998. Effective July 1, 1998, the Occupational Therapy Act is | 0021| repealed. | 0022| Section 25. TEMPORARY PROVISION--TRANSFER.--Upon the | 0023| effective date of the Occupational Therapy Act all property, | 0024| funds, records, responsibilities and duties of the board of | 0025| occupational therapy practice are transferred to the board of | 0001| examiners for occupational therapy. | 0002| Section 26. TEMPORARY PROVISION--EXISTING REGULATIONS--LICENSURE UNDER PRIOR LAW.-- | 0003| A. Existing regulations regarding occupational | 0004| therapy services shall remain in effect until new regulations | 0005| are adopted pursuant to the provisions of the Occupational | 0006| Therapy Act. | 0007| B. Any person licensed to perform occupational | 0008| therapy services pursuant to the provisions of prior law, whose | 0009| license is valid on July 1, 1996, is entitled to renew his | 0010| license pursuant to the provisions of the Occupational Therapy | 0011| Act. | 0012| Section 27. REPEAL.--Sections 61-12A-1 through 61-12A-20 | 0013| NMSA 1978 (being Laws 1983, Chapter 267, Sections 1 through 19 | 0014| and 21, as amended) are repealed. | 0015| Section 28.
