DAVID PEDERSON | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO JUVENILE SERVICES; AUTHORIZING DETENTION OF A | 0013| JUVENILE IN A MULTIPURPOSE REGIONAL FACILITY PURSUANT TO A COURT | 0014| ORDER ISSUED BY AN INDIAN TRIBE OR PUEBLO; ENACTING A NEW | 0015| SECTION OF THE REGIONAL JUVENILE SERVICES ACT. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. A new section of the Regional Juvenile Services | 0019| Act is enacted to read: | 0020| "[NEW MATERIAL] DETENTION OF A JUVENILE IN A | 0021| MULTIPURPOSE REGIONAL FACILITY PURSUANT TO A COURT ORDER ISSUED | 0022| BY AN INDIAN TRIBE OR PUEBLO.-- | 0023| A. The administrator of a multipurpose regional | 0024| facility may receive a juvenile placed in detention in the | 0025| facility pursuant to a court order issued by an Indian tribe or | 0001| pueblo, in accordance with a joint powers agreement entered into | 0002| by the administrator of the multipurpose regional facility and | 0003| the Indian tribe or pueblo. The administrator shall keep the | 0004| juvenile detained in the multipurpose regional facility until | 0005| the juvenile is released pursuant to a court order issued by the | 0006| Indian tribal court or the pueblo court. | 0007| B. If a lawsuit is filed challenging the detention | 0008| of a juvenile in a multipurpose regional facility pursuant to a | 0009| court order issued by an Indian tribal court or a pueblo court, | 0010| the administrator of the facility, the state of New Mexico and | 0011| any municipality or county using the facility shall not be made | 0012| a party to the lawsuit. The Indian tribe or pueblo that placed | 0013| the juvenile in detention shall defend the lawsuit, and | 0014| adjudication of the lawsuit shall take place in the Indian | 0015| tribal court or the pueblo court. | 0016| C. The provisions of this section shall not be | 0017| interpreted as: | 0018| (1) a waiver of sovereign immunity by any | 0019| governmental entity; | 0020| (2) consent by an Indian tribe or pueblo to the | 0021| jurisdiction of a state court; or | 0022| (3) consent by the state of New Mexico or any | 0023| political subdivision thereof to the jurisdiction of an Indian | 0024| tribal court or a pueblo court." | 0025| Section 2. EFFECTIVE DATE.--The effective date of the | 0001| provisions of this act is July 1, 1996.
