0022| RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE;

0023| RELATING TO RISK MANAGEMENT; INCLUDING REGIONAL HOUSING

0024| AUTHORITIES IN THE DEFINITION OF STATE OR STATE AGENCY; AMENDING
|
0025| A SECTION OF THE NMSA 1978; DECLARING AN EMERGENCY.

0002| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0003| Section 1. Section 15-7-1 NMSA 1978 (being Laws 1977,
|
0004| Chapter 385, Section 4, as amended) is amended to read:
|
0005| "15-7-1. DEFINITIONS.--As used in [Sections 15-7-1
|
through 15-7-10] Chapter 15, Article 7 NMSA 1978:
|
0007| A. "board" means the risk management advisory board;
|
0008| B. "director" means the director of the risk
|
0009| management division of the general services department;
|
0010| C. "local public body" means all political
|
0011| subdivisions of the state and their agencies, instrumentalities
|
0012| and institutions;
|
0013| D. "public employee" means any officer, employee or
|
0014| servant of a governmental entity, including elected or appointed
|
0015| officials, law enforcement officers and persons acting on behalf
|
0016| or in service of a governmental entity in any official capacity,
|
0017| whether with or without compensation, but the term does not
|
0018| include an independent contractor; and
|
0019| E. "state" or "state agency" means the state of New
|
0020| Mexico or any of its branches, agencies, departments, boards,
|
0021| instrumentalities or institutions, including regional housing
|
0022| authorities."
|
0023| Section 2. EMERGENCY.--It is necessary for the public
|
0024| peace, health and safety that this act take effect immediately.
