0013| CERTAIN POST-SECONDARY STATE EDUCATIONAL INSTITUTIONS;

0014| AMENDING AND ENACTING CERTAIN SECTIONS OF THE NMSA 1978.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW
|
0017| MEXICO:
|
0018| Section 1. Section 21-1-2 NMSA 1978 (being Laws
|
0019| 1970, Chapter 9, Section 1, as amended by Laws 1989,
|
0020| Chapter 44, Section 3 and by Laws 1989, Chapter 45,
|
0021| Section 3 and also by Laws 1989, Chapter 68, Section 1) is
|
0022| amended to read:
|
0023| "21-1-2. MATRICULATION AND TUITION FEES.--
|
0024| A. Except as otherwise provided in this section
|
0025| and in Section 21-1-4.3 NMSA 1978, the boards of regents
|
0001| of the university of New Mexico, New Mexico state univer-
|
0002| sity, New Mexico highlands university, western New Mexico
|
0003| university, eastern New Mexico university, New Mexico
|
0004| military institute, New Mexico institute of mining and
|
0005| technology and New Mexico junior college shall establish
|
0006| and charge matriculation fees and tuition fees as follows:
|
0007| (1) each student shall be charged a
|
0008| matriculation fee of not less than five dollars ($5.00)
|
0009| upon enrolling in each institution;
|
0010| (2) each student who is a resident of New
|
0011| Mexico shall be charged a tuition fee of not less than
|
0012| twenty dollars ($20.00) a year;
|
0013| (3) each student who is not a resident of
|
0014| New Mexico shall be charged a tuition fee of not less than
|
0015| fifty dollars ($50.00) a year;
|
0016| (4) each student shall be charged a
|
0017| tuition fee of not less than ten dollars ($10.00) for each
|
0018| summer session; and
|
0019| (5) each student may be charged a tuition
|
0020| fee for extension courses.
|
0021| B. Except as otherwise provided in this section
|
0022| and in Section 21-1-4.3 NMSA 1978, the board of regents
|
0023| of northern New Mexico state school shall establish and
|
0024| charge each student a matriculation fee and a tuition fee.
|
0025| C. The board of regents of each institution may
|
0001| establish and grant gratis scholarships to students who
|
0002| are residents of New Mexico [by waiving] in an amount
|
0003| not to exceed the matriculation fee or tuition and fees,
|
0004| or both. Except as provided in Section 21-1-4.3 NMSA
|
0005| 1978, the number of scholarships established and granted
|
0006| shall not exceed three percent of the preceding fall
|
0007| semester enrollment in each institution and shall not be
|
0008| established and granted for summer sessions. The
|
0009| president of each institution shall select and recommend
|
0010| to the board of regents of his institution, as recipients
|
0011| of scholarships, students who possess good moral character
|
0012| and satisfactory initiative, scholastic standing and
|
0013| personality. At least thirty-three and one-third percent
|
0014| of the gratis scholarships established and granted by each
|
0015| board of regents each year shall be granted on the basis
|
0016| of financial need.
|
0017| D. The board of regents of each institution set
|
0018| out in this subsection may establish and grant, in
|
0019| addition to those scholarships provided for in Subsection
|
0020| C of this section, athletic scholarships [by waiving]
|
0021| for tuition and fees. In no event shall the board of
|
0022| regents of any institution be allowed to [waive the]
|
0023| award scholarships for tuition and fees for more than
|
0024| the number of athletic scholarships set out in this
|
0025| subsection and in no event shall more than seventy-five
|
0001| percent of the [waivers] scholarships granted be for
|
0002| out-of-state residents:
|
0003| (1) the board of regents of the university
|
0004| of New Mexico may grant up to two hundred ninety-three
|
0005| athletic scholarships;
|
0006| (2) the board of regents of New Mexico
|
0007| state university may grant up to two hundred seventy
|
0008| athletic scholarships;
|
0009| (3) the boards of regents of New Mexico
|
0010| highlands university, eastern New Mexico university and
|
0011| western New Mexico university may each grant up to one
|
0012| hundred forty athletic scholarships; and
|
0013| (4) the board of regents of New Mexico
|
0014| junior college [board] may grant up to fifty-two
|
0015| athletic scholarships.
|
0016| E. Notwithstanding the provisions of Subsection
|
0017| D of this section, in computing tuition credits the
|
0018| commission on higher education shall accept the value of
|
0019| [waivers of] scholarships for tuition and fees
|
0020| established by the boards of regents of the university of
|
0021| New Mexico, New Mexico state university, eastern New
|
0022| Mexico university, western New Mexico university and New
|
0023| Mexico highlands university for athletes for the seventy-eighth fiscal year and all fiscal years thereafter. In no
|
0024| event shall the board of regents of any such institution
|
0025| be allowed to [waive the] establish scholarships for
|
0001| tuition and fees for more than the number of athletic
|
0002| scholarships permitted that institution by regulations and
|
0003| bylaws of the national collegiate athletic association or
|
0004| the national association of intercollegiate athletics of
|
0005| which that institution is a member.
|
0006| F. Matriculation fees and tuition fees shall be
|
0007| fixed and made payable as directed by the board of regents
|
0008| of each institution, collected by the officers of each
|
0009| institution and accounted for as are other funds of the
|
0010| institutions. Matriculation fees shall be charged only
|
0011| once for each institution in which a student enrolls."
|
0012| Section 2. Section 21-1-4 NMSA 1978 (being Laws
|
0013| 1971, Chapter 235, Section 1) is amended to read:
|
0014| "21-1-4. TUITION CHARGES--DEFINITIONS.--
|
0015| A. Except as provided in Section 21-1-4.3 NMSA
|
0016| 1978, the state educational institutions set forth in
|
0017| Article 12, Section 11 of the [state] constitution of
|
0018| New Mexico shall charge tuition, which is in addition to
|
0019| earmarked fees, at rates provided by law.
|
0020| B. During the regular academic year, "full-time
|
0021| student" means a student who is taking twelve or more
|
0022| credit-hours in one semester or quarter. Full-time
|
0023| students during the academic year shall be charged tuition
|
0024| at rates provided by law.
|
0025| C. During the summer session, "full-time
|
0001| student" means a student who is taking at least a minimum
|
0002| number of credit-hours, which minimum is in the same
|
0003| proportion to twelve credit-hours as the duration and
|
0004| normal credit-hour load of the summer session in the
|
0005| particular institution is to the duration and normal
|
0006| credit-hour load of the institution's regular semester or
|
0007| quarter. Full-time students in the summer session shall
|
0008| be charged tuition at resident and nonresident rates in
|
0009| each institution, which rates shall be in the same
|
0010| proportion to the full-time resident and nonresident rates
|
0011| of that institution for the regular semester or quarter as
|
0012| the minimum number of credit-hours is to twelve hours.
|
0013| D. "Part-time student" means a student who is
|
0014| taking less than the minimum number of credit-hours in a
|
0015| semester, quarter or summer session than that required for
|
0016| full-time student status. Part-time students shall be
|
0017| charged tuition at rates per semester- or quarter-credit-hour as provided by law.
|
0018| E. The [board of educational finance]
|
0019| commission on higher education shall define resident and
|
0020| nonresident students for the purpose of administering
|
0021| tuition charges in accordance with the constitution and
|
0022| statutes of the state and after consultation with the
|
0023| appropriate officials of the institutions concerned. Each
|
0024| institution shall use the uniform definitions so
|
0025| established in assessing and collecting tuition charges
|
0001| from students."
|
0002| Section 3. A new Section 21-1-4.3 NMSA 1978 is
|
0003| enacted to read:
|
0004| "21-1-4.3. [NEW MATERIAL] TUITION SCHOLARSHIPS
|
0005| AUTHORIZED--CERTAIN EDUCATIONAL INSTITUTIONS.--
|
0006| A. To the extent that funds are made available
|
0007| by the legislature from the lottery tuition fund, the
|
0008| boards of regents of New Mexico state university, New
|
0009| Mexico institute of mining and technology, eastern New
|
0010| Mexico university, western New Mexico university, the
|
0011| university of New Mexico, New Mexico highlands university
|
0012| and northern New Mexico state school shall award tuition
|
0013| scholarships for qualified resident students attending
|
0014| their respective institutions and branches of those
|
0015| institutions.
|
0016| B. Except as authorized in Subsection C of this
|
0017| section, the tuition scholarships authorized in this
|
0018| section shall apply only to full-time resident students
|
0019| who, immediately upon completion of a high school
|
0020| curriculum at a public or accredited private New Mexico
|
0021| high school, are accepted for entrance to and attend one
|
0022| of the state educational institutions set forth in this
|
0023| section or one of the branches of those institutions.
|
0024| Each tuition scholarship shall be awarded for up to four
|
0025| consecutive years beginning the second semester of the
|
0001| recipient's first year of enrollment, provided that the
|
0002| recipient has maintained residency in New Mexico and
|
0003| maintained a grade point average of 2.5 or higher on a 4.0
|
0004| scale during his first semester of full-time enrollment.
|
0005| C. The tuition scholarships authorized in this
|
0006| section shall also apply to full-time resident students
|
0007| who, immediately upon completion of a high school
|
0008| curriculum at a public or accredited private New Mexico
|
0009| high school, attend a two-year public post-secondary
|
0010| educational institution in New Mexico and who, upon the
|
0011| completion of that curriculum or at the end of two years,
|
0012| whichever is sooner, transfer to one of the post-secondary
|
0013| state educational institutions set forth in this section.
|
0014| Those students shall be eligible for a tuition scholarship
|
0015| for two consecutive years, provided that those students
|
0016| maintain residency in New Mexico, maintain a grade-point
|
0017| average of 2.5 or higher on a 4.0 scale and attend the
|
0018| institution full time during the regular academic year.
|
0019| D. The commission on higher education shall
|
0020| prepare guidelines setting forth explicit student
|
0021| continuing eligibility criteria and guidelines for
|
0022| administration of the tuition scholarship program.
|
0023| Guidelines shall be distributed to the board of regents of
|
0024| each institution to enable a uniform availability of the
|
0025| resident student tuition scholarships."
|
0001| Section 4. A new Section 21-1-4.4 NMSA 1978 is
|
0002| enacted to read:
|
0003| "21-1-4.4. [NEW MATERIAL] COMMISSION ON HIGHER
|
0004| EDUCATION--DETERMINATION OF TUITION SCHOLARSHIPS--USE OF
|
0005| LOTTERY TUITION FUND.--Prior to June 1 of each year, the
|
0006| commission on higher education shall determine the amount
|
0007| of money available for tuition scholarships at state
|
0008| public post-secondary educational institutions. Based on
|
0009| the amount appropriated by the legislature from the
|
0010| lottery tuition fund and on the projected enrollment at
|
0011| all public post-secondary educational institutions, the
|
0012| commission on higher education shall establish the
|
0013| percentage of tuition that shall be awarded for qualified
|
0014| resident students attending New Mexico public post-secondary educational institutions. The percentage of
|
0015| tuition awarded shall be the same for each institution,
|
0016| regardless of the actual cost of tuition at each
|
0017| institution."
|
0018| Section 5. Section 21-13-10 NMSA 1978 (being Laws
|
0019| 1963, Chapter 17, Section 9, as amended) is amended to
|
0020| read:
|
0021| "21-13-10. BOARD DUTIES.--
|
0022| A. It shall be the duty of the community
|
0023| college board to determine financial and educational
|
0024| policies of the community college. The community college
|
0025| board shall provide for the management of the community
|
0001| college and execution of these policies by selecting a
|
0002| competent president for the
|
0003| community college, and, upon the president's recommenda-
|
0004| tion, the board shall employ other administrative
|
0005| personnel, instructional staff or other personnel as may
|
0006| be needed for the operation, maintenance and
|
0007| administration of the community college.
|
0008| B. The community college board shall have the
|
0009| power to fix tuition and fee rates for resident and
|
0010| nonresident students of the district, to accept gifts, to
|
0011| accept federal aid, to purchase, hold, sell and rent
|
0012| property and equipment and to promote the general welfare
|
0013| of the institution for the best interest of educational
|
0014| service to the people of the community college district.
|
0015| C. To the extent that funds are made available
|
0016| by the legislature from the lottery tuition fund, the
|
0017| community college board shall award tuition scholarships
|
0018| for qualified resident students attending their respective
|
0019| institutions.
|
0020| D. The tuition scholarships authorized in this
|
0021| section shall apply only to full-time resident students
|
0022| who, immediately upon completion of a high school
|
0023| curriculum at a public or accredited private New Mexico
|
0024| high school, are accepted for entrance to and attend a
|
0025| community college. Each tuition scholarship shall be
|
0001| awarded for up to two consecutive years beginning the
|
0002| second semester of the recipient's first year of
|
0003| enrollment, provided that the recipient has maintained
|
0004| residency in New Mexico and maintained a grade-point
|
0005| average of 2.5 or higher on a 4.0 scale during his first
|
0006| semester of full-time enrollment.
|
0007| E. The commission on higher education shall
|
0008| prepare guidelines setting forth explicit student
|
0009| continuing eligibility criteria and guidelines for
|
0010| administration of the tuition scholarship program.
|
0011| Guidelines shall be distributed to community college
|
0012| boards to enable a uniform availability of the resident
|
0013| student tuition scholarship."
|
0014| Section 6. A new section of the Technical and
|
0015| Vocational Institute Act is enacted to read:
|
0016| "[NEW MATERIAL] TUITION SCHOLARSHIPS AUTHORIZED.--
|
0017| A. To the extent that funds are made available
|
0018| by the legislature from the lottery tuition fund, the
|
0019| board of a technical and vocational institute shall award
|
0020| tuition scholarships for qualified resident students
|
0021| attending a technical and vocational institute.
|
0022| B. The tuition scholarships authorized in this
|
0023| section shall apply only to full-time resident students
|
0024| who, immediately upon completion of a high school
|
0025| curriculum at a public or accredited private New Mexico
|
0001| high school, are accepted for entrance to and attend a
|
0002| technical and vocational institute. Each tuition
|
0003| scholarship shall be awarded for up to two consecutive
|
0004| years beginning the second semester of the recipient's
|
0005| first year of enrollment, provided that the recipient has
|
0006| maintained residency in New Mexico and maintained a grade-point average of 2.5 or higher on a 4.0 scale during his
|
0007| first semester of full-time enrollment.
|

0015| Section 7. A new section of Chapter 21, Article 17
|
0016| NMSA 1978 is enacted to read:
|
0017| "[NEW MATERIAL] TUITION SCHOLARSHIPS AUTHORIZED.--
|
0018| A. To the extent that funds are made available
|
0019| by the legislature from the lottery tuition fund, the
|
0020| board of an area vocational school shall award tuition
|
0021| scholarships for qualified resident students attending its
|
0022| area vocational school.
|
0023| B. The tuition scholarships authorized in this
|
0024| section shall apply only to full-time resident students
|
0025| who, immediately upon completion of a high school
|
0001| curriculum at a public or accredited private New Mexico
|
0002| high school, are accepted for entrance to and attend an
|
0003| area vocational school. Each tuition scholarship shall be
|
0004| awarded for up to two consecutive years beginning the
|
0005| second semester of the recipient's first year of
|
0006| enrollment, provided that the recipient has maintained
|
0007| residency in New Mexico and maintained a grade-point
|
0008| average of 2.5 or higher on a 4.0 scale during his first
|
0009| semester of full-time enrollment.
|
0010| C. The commission on higher education shall
