0012| RELATING TO EDUCATION; ENACTING THE PROFESSIONAL DEVELOPMENT

0013| ACT; MAKING APPROPRIATIONS.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Public School Code is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0019| the "Professional Development Act"."
|
0020| Section 2. A new section of the Public School Code is
|
0021| enacted to read:
|
0022| "[NEW MATERIAL] PURPOSE OF ACT.--It is the purpose of
|
0023| the Professional Development Act to:
|
0024| A. establish a framework for professional
|
0025| development within the department of education to facilitate
|
0001| statewide planning and adoption of professional development
|
0002| programs in school districts to ensure that New Mexico schools
|
0003| have a quality work force;
|
0004| B. provide school personnel with a variety of
|
0005| professional development opportunities and ongoing support to
|
0006| ensure integration of effective teaching strategies, learning
|
0007| technologies and utilization of resources in the educational
|
0008| process to enhance student learning and performance; and
|
0009| C. establish a funding mechanism that will support
|
0010| the development of an effective school personnel work force for
|
0011| the benefit of all learners in New Mexico."
|
0012| Section 3. A new section of the Public School Code is
|
0013| enacted to read:
|
0014| "[NEW MATERIAL] STATE BOARD DUTIES--PROFESSIONAL
|
0015| DEVELOPMENT PLANS.--The state board shall:
|
0016| A. administer the provisions of the Professional
|
0017| Development Act;
|
0018| B. develop and adopt, in cooperation with local
|
0019| school districts and their communities, a professional
|
0020| development framework with criteria for schools and districts to
|
0021| use in creating plans for professional development consistent
|
0022| with school, district, state and national goals that will
|
0023| enhance achievement and performance of students;
|
0024| C. assist schools and school districts to develop a
|
0025| comprehensive plan based on the common planning framework;
|
0001| D. develop and administer a process for the review
|
0002| and approval of local school district professional development
|
0003| plans; and
|
0004| E. distribute funds to local school districts upon
|
0005| approval of the district's professional development plan."
|
0006| Section 4. A new section of the Public School Code is
|
0007| enacted to read:
|
0008| "[NEW MATERIAL] LOCAL SCHOOL DISTRICTS--PROFESSIONAL
|
0009| DEVELOPMENT PLANS.--
|
0010| A. Each school district shall adopt and implement a
|
0011| professional development plan for its local school board and all
|
0012| administrators, teachers and other personnel employed by the
|
0013| district. The plan shall be annually updated to ensure that the
|
0014| proposed plan is consistent with national, state and school
|
0015| district goals and objectives.
|
0016| B. Each school district shall submit a proposed
|
0017| professional development plan for the district that meets state
|
0018| board professional development guidelines and standards.
|
0019| C. Proposed school district plans shall be developed
|
0020| in collaboration with certified and noncertified school
|
0021| personnel and shall show evidence of how the plans will enhance
|
0022| student academic achievement and support the attainment of
|
0023| district, state and national goals and shall include a parent
|
0024| and community involvement component and appropriate evaluation
|
0025| procedures.
|
0001| D. Proposed plans shall be designed to respond to
|
0002| local needs and may include the following:
|
0003| (1) current educational reform innovations that
|
0004| will assist in the attainment of national and state educational
|
0005| goals and standards, such as site-based management, cooperative
|
0006| learning, alternative assessment, learning technologies and
|
0007| interdisciplinary and integrated curricular approaches;
|
0008| (2) knowledge and skills to assist teachers in
|
0009| meeting the individual needs of students, the needs of limited
|
0010| language-proficient students and the complex challenges
|
0011| encountered in the classroom;
|
0012| (3) knowledge and skills to assist in the use
|
0013| of technology in education and technology applications that will
|
0014| enhance student learning and professional development, such as
|
0015| technology-enhanced curriculum and instruction and
|
0016| administrative resources and services for the public schools;
|
0017| (4) professional development activities to
|
0018| assist teachers in preparing for national certification through
|
0019| the national board for professional teaching standards;
|
0020| (5) career ladder programs for educational
|
0021| assistants and noncertified school employees to improve job-related skills; and
|
0022| (6) methods to successfully implement
|
0023| inclusion, transition and unified systems to meet the local
|
0024| needs of all students with developmental disabilities." Section 5. APPROPRIATIONS.--
|
0025| A. Four million four hundred fifty-five thousand
|
0001| dollars ($4,455,000) is appropriated from the general fund to
|
0002| the state department of public education for expenditure in
|
0003| fiscal year 1997 for the purpose of making distributions on a
|
0004| per unit basis to local school districts with approved
|
0005| professional development plans. Any unexpended or unencumbered
|
0006| balance remaining at the end of fiscal year 1997 shall not
|
0007| revert to the general fund.
|
0008| B. Four hundred forty-five thousand dollars
|
0009| ($445,000) is appropriated from the general fund to the state
|
0010| department of public education for expenditure in fiscal year
|
0011| 1997 for the purpose of making an equal distribution to each
|
0012| local school district to design a professional development plan.
|
0013| Any unexpended or unencumbered balance remaining at the end of
|
0014| fiscal year 1997 shall revert to the general fund.
|
0015| Section 6. EFFECTIVE DATE.--The effective date of the
|
0016| provisions of this act is July 1, 1996.
