0012|     RELATING TO JUDGES; PROVIDING FOR TWO ADDITIONAL MAGISTRATE

0013|     JUDGES IN DONA ANA MAGISTRATE DISTRICT; PROVIDING FOR

0014|     APPOINTMENT AND ELECTION; AMENDING A SECTION OF THE NMSA 1978;

0015|     MAKING AN APPROPRIATION.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|       Section 1.  Section 35-1-10 NMSA 1978 (being Laws 1968,
    |
0019|     Chapter 62, Section 12, as amended) is amended to read:
    |
0020|       "35-1-10.  MAGISTRATE COURT--DONA ANA DISTRICT.--There
    |
0021|     shall be [three] five magistrates in Dona Ana magistrate
    |
0022|     district, with divisions 1, 2 and 3 operating as a single
    |
0023|     court in Las Cruces.  The magistrates in divisions 1, 2 and 3
    |
0024|     shall rotate riding circuit to [Anthony and] Hatch on a
    |
0025|     regularly scheduled basis. The magistrates in divisions 4 and 5
    |
0001|     shall operate as a single court in Anthony."
    |
0002|       Section 2.  TEMPORARY PROVISION--APPOINTMENT--DIVISIONS 4
    |
0003|     AND 5--ELECTION.--
    |
0004|            A.  The office of magistrate in Dona Ana magistrate
    |
0005|     divisions 4 and 5 shall be filled by appointment by the
    |
0006|     governor.  The appointed magistrates shall begin serving January
    |
0007|     1, 1997 and shall serve until succeeded by magistrates elected
    |
0008|     pursuant to Subsection B of this section.
    |
0009|            B.  The first full term of the office of magistrate
    |
0010|     in Dona Ana magistrate divisions 4 and 5 shall be filled by
    |
0011|     election at the general election in 1998, and those terms of
    |
0012|     office shall begin on January 1, 1999.
    |
0013|       Section 3.  APPROPRIATION.--Fifty-eight thousand nine
    |
0014|     hundred eleven dollars ($58,911) is appropriated from the
    |
0015|     general fund to the Dona Ana magistrate district for expenditure
    |
0016|     in fiscal year 1997 for two additional full-time equivalent
    |
0017|     positions.  Any unexpended or unencumbered balance remaining at
    |
0018|     the end of fiscal year 1997 shall revert to the general fund.
    |
0019|       Section 4.  EFFECTIVE DATE.--The effective date of the
    |
0020|     provisions of this act is January 1, 1997.

0012|     shall serve until succeeded by a magistrate elected pursuant to
    |
0013|     Subsection B of this section.

0014|            B.  The first full term of the office of magistrate in
    |
0015|     Dona Ana magistrate division 4 shall be filled by election at
    |
0016|     the general election in 1998, and the term of office shall begin
    |
0017|     on January 1, 1999.
    |
0018|       Section 3.  APPROPRIATION.--
    |
0019|            A.  Seventy-six thousand six hundred dollars ($76,600)
    |
0020|     is appropriated from the general fund to the administrative
    |
0021|     office of the courts for expenditure in fiscal year 1997 for the
    |
0022|     following purposes and in the following amounts:
    |
0023|                 (1)  forty-four thousand eight hundred dollars
    |
0024|     ($44,800) for one additional magistrate judge and support staff
    |
0025|     in Dona Ana magistrate district division 4;
    |
0001|                 (2)  six thousand eight hundred dollars ($6,800)
    |
0002|     for supplies and operating expenses for Dona Ana magistrate
    |
0003|     district division 4; and
    |
0004|                 (3)  twenty-five thousand dollars ($25,000) to
    |
0005|     renovate and expand the magistrate court building in Anthony.
    |
0006|            B.  Any unexpended or unencumbered balance remaining at
    |
0007|     the end of fiscal year 1997 shall revert to the general fund.
    |
0008|       Section 4.  EFFECTIVE DATE.--The effective date of the
    |
0009|     provisions of this act is January 1, 1997.
