0012| RELATING TO SCHOOL DISTRICTS; PROVIDING SCHOOL DISTRICTS WITH

0013| THE AUTHORITY TO ISSUE GENERAL OBLIGATION BONDS TO PURCHASE

0014| COMPUTER EQUIPMENT; INCLUDING THE PURCHASE OF COMPUTER EQUIPMENT
|
0015| WITHIN THE DEFINITION OF PUBLIC SCHOOL CAPITAL IMPROVEMENTS;
|
0016| AMENDING THE PUBLIC SCHOOL CODE.
|

0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. Section 22-18-1 NMSA 1978 (being Laws 1967,
|
0020| Chapter 16, Section 228) is amended to read:
|
0021| "22-18-1. GENERAL OBLIGATION BONDS--AUTHORITY TO ISSUE.--Subject to the provisions of Article 9, Section 11 of the
|
0022| constitution of New Mexico and Sections [11-6-13 and 11-6-14
|
0023| New Mexico Statutes Annotated, 1953 Compilation] 6-15-1 and 6-15-2 NMSA 1978, a school district may issue general obligation
|
0024| bonds for the purpose of erecting, remodeling, making additions
|
0025| to and furnishing school buildings [or], purchasing or
|
0001| improving school grounds, purchasing computer software and
|
0002| hardware for student use in public schools or any combination
|
0003| of these purposes. [Such] The bonds shall be fully
|
0004| negotiable and constitute negotiable instruments within the
|
0005| meaning and for all purposes of the Uniform Commercial Code."
|
0006| Section 2. Section 22-25-2 NMSA 1978 (being Laws 1975
|
0007| (S.S.), Chapter 5, Section 2, as amended) is amended to read:
|
0008| "22-25-2. DEFINITIONS.--As used in the Public School
|
0009| Capital Improvements Act:
|
0010| A. "program unit" means the product of the program
|
0011| element multiplied by the applicable cost differential factor,
|
0012| as defined in Section 22-8-2 NMSA 1978; and
|
0013| B. "capital improvements" means expenditures,
|
0014| exclusive of any debt service expenses, for:
|
0015| (1) erecting, remodeling, making additions to,
|
0016| providing equipment for or furnishing public school buildings;
|
0017| (2) purchasing or improving public school
|
0018| grounds;
|
0019| (3) maintenance of public school buildings or
|
0020| public school grounds, exclusive of salary expenses of school
|
0021| district employees; [and]
|
0022| (4) purchasing activity vehicles for
|
0023| transporting students to extracurricular school activities;
|
0024| and
|
0025| (5) purchasing computer software and hardware
|
0001| for student use in public school classrooms."
