DURAN | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0013| SEVERANCE TAX BONDS FOR CAPITAL PROJECTS IN THE VILLAGE OF | 0014| TULAROSA IN OTERO COUNTY; MAKING APPROPRIATIONS; DECLARING AN | 0015| EMERGENCY. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0019| APPROPRIATION OF PROCEEDS.-- | 0020| A. The state board of finance may issue and sell | 0021| severance tax bonds in compliance with the Severance Tax Bonding | 0022| Act in an amount not to exceed the total of the amounts | 0023| authorized for purposes specified in Sections 2 through 6 of | 0024| this act. The state board of finance shall schedule the | 0025| issuance and sale of the bonds in the most expeditious and | 0001| economical manner possible upon a finding by the board that the | 0002| project has been developed sufficiently to justify the issuance | 0003| and that the project can proceed to contract within a reasonable | 0004| time. The state board of finance shall further take the | 0005| appropriate steps necessary to comply with the Internal Revenue | 0006| Code of 1986, as amended. Proceeds from the sale of the bonds | 0007| are appropriated for the purposes specified in Sections 2 | 0008| through 6 of this act. | 0009| B. The agencies named in Sections 2 through 6 of | 0010| this act shall certify to the state board of finance when the | 0011| money from the proceeds of the severance tax bonds authorized in | 0012| this section is needed for the purposes specified in the | 0013| applicable section of this act. | 0014| C. If the specified agency has not certified the | 0015| need for the issuance of the bonds by the end of fiscal year | 0016| 1998, the authorization provided in this act shall be void. | 0017| D. Unless otherwise specified in this act, any | 0018| unexpended or unencumbered balance remaining from the proceeds | 0019| of severance tax bonds issued pursuant to Sections 2 through 6 | 0020| of this act at the end of fiscal year 1999 shall revert to the | 0021| severance tax bonding fund. | 0022| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF HEALTH--PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0023| upon certification by the department of health that the need | 0024| exists for the issuance of the bonds, four hundred thousand | 0025| dollars ($400,000) is appropriated to the department of health | 0001| to plan, design and construct a medical facility and purchase | 0002| equipment and furnishings for the medical facility in the | 0003| village of Tularosa located in Otero county. | 0004| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF | 0005| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1 | 0006| of this act, upon certification by the department of environment | 0007| that the need exists for the issuance of the bonds, the | 0008| following amounts are appropriated to the department of | 0009| environment for the following purposes: | 0010| A. two hundred fifty thousand dollars ($250,000) to | 0011| make improvements to the water filter plant in the village of | 0012| Tularosa in Otero county; | 0013| B. two hundred seventy-five thousand dollars | 0014| ($275,000) to replace the water lines in the village of Tularosa | 0015| in Otero county; and | 0016| C. two hundred thirty thousand dollars ($230,000) to | 0017| purchase equipment for and to make improvements to the | 0018| wastewater plant in the village of Tularosa in Otero county to | 0019| comply with standards set by the federal Occupation Safety and | 0020| Health Act. | 0021| Section 4. SEVERANCE TAX BONDS--LOCAL GOVERNMENT DIVISION | 0022| OF THE DEPARTMENT OF FINANCE AND ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section 1 of this act, upon | 0023| certification by the local government division of the department | 0024| of finance and administration that the need exists for the | 0025| issuance of the bonds, the following amounts are appropriated to | 0001| the local government division of the department of finance and | 0002| administration for the following purposes: | 0003| A. two hundred seventy-five thousand dollars | 0004| ($275,000) to purchase equipment for and to complete the | 0005| rehabilitation and expansion of the police department building | 0006| in the village of Tularosa in Otero county; | 0007| B. one hundred twelve thousand dollars ($112,000) to | 0008| purchase equipment for and to renovate the fire department | 0009| building in the village of Tularosa in Otero county; | 0010| C. two hundred fifty thousand dollars ($250,000) to | 0011| purchase village yard equipment for the village of Tularosa in | 0012| Otero county; | 0013| D. one hundred thirty-nine thousand dollars | 0014| ($139,000) to purchase equipment and increase office space in | 0015| the Tularosa municipal office in Otero county. | 0016| Section 5. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0017| upon certification by the state agency on aging that the need | 0018| exists for the issuance of the bonds, the following amounts are | 0019| appropriated to the state agency on aging for the following | 0020| purposes: | 0021| A. one hundred fifty thousand dollars ($150,000) to | 0022| repair the roof and the heating and cooling system and expand | 0023| the supply space at the Tularosa community senior center in the | 0024| village of Tularosa in Otero county; and | 0025| B. one hundred thousand dollars ($100,000) to | 0001| purchase recreation equipment and make improvements to the | 0002| baseball and basketball playing fields at the Tularosa community | 0003| senior center in the village of Tularosa in Otero county. | 0004| Section 6. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0005| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the provisions | 0006| of Section 1 of this act, upon certification by the state | 0007| highway and transportation department that the need exists for | 0008| the issuance of the bonds, the following amounts are | 0009| appropriated to the state highway and transportation department | 0010| for the following purposes: | 0011| A. three hundred twenty-five thousand dollars | 0012| ($325,000) to repair streets in the village of Tularosa in Otero | 0013| county; and | 0014| B. two hundred seventy-five thousand dollars | 0015| ($275,000) to make improvements to west Monterey street between | 0016| First and Sixth streets in the village of Tularosa in Otero | 0017| county. | 0018| Section 7.
