LYONS | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0013| SEVERANCE TAX BONDS FOR CAPITAL PROJECTS IN SENATE DISTRICT 7; | 0014| MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0018| APPROPRIATION OF PROCEEDS.-- | 0019| A. The state board of finance may issue and sell | 0020| severance tax bonds in compliance with the Severance Tax Bonding | 0021| Act in an amount not to exceed the total of the amounts | 0022| authorized for purposes specified in Sections 2 through 7 of | 0023| this act. The state board of finance shall schedule the | 0024| issuance and sale of the bonds in the most expeditious and | 0025| economical manner possible upon a finding by the board that the | 0001| project has been developed sufficiently to justify the issuance | 0002| and that the project can proceed to contract within a reasonable | 0003| time. The state board of finance shall further take the | 0004| appropriate steps necessary to comply with the Internal Revenue | 0005| Code of 1986, as amended. Proceeds from the sale of the bonds | 0006| are appropriated for the purposes specified in Sections 2 | 0007| through 7 of this act. | 0008| B. The agencies named in Sections 2 through 7 of | 0009| this act shall certify to the state board of finance when the | 0010| money from the proceeds of the severance tax bonds authorized in | 0011| this section is needed for the purposes specified in the | 0012| applicable section of this act. | 0013| C. If the specified agency has not certified the | 0014| need for the issuance of the bonds by the end of fiscal year | 0015| 1998, the authorization provided in this act shall be void. | 0016| D. Unless otherwise specified in this act, any | 0017| unexpended or unencumbered balance remaining from the proceeds | 0018| of severance tax bonds issued pursuant to Sections 2 through 7 | 0019| of this act at the end of fiscal year 1999 shall revert to the | 0020| severance tax bonding fund. | 0021| Section 2. SEVERANCE TAX BONDS--STATE DEPARTMENT OF PUBLIC | 0022| EDUCATION--PURPOSES.--Pursuant to the provisions of Section 1 of | 0023| this act, upon certification by the state department of public | 0024| education that the need exists for the issuance of the bonds, | 0025| the following amounts are appropriated to the state department | 0001| of public education for the following purposes: | 0002| A. eight million four hundred seven thousand one | 0003| hundred seventy-eight dollars ($8,407,178) to erect and furnish | 0004| school buildings or purchase or improve school grounds or any | 0005| combination of these purposes for elementary schools in | 0006| Tucumcari located in Quay county; | 0007| B. one hundred two thousand dollars ($102,000) to | 0008| renovate the visitors' locker room in the House municipal school | 0009| in Quay county; | 0010| C. ten thousand dollars ($10,000) to purchase and | 0011| install computer equipment in the House municipal school in Quay | 0012| county; | 0013| D. five million six thousand one hundred twenty-three dollars ($5,006,123) to design, construct, repair, | 0014| renovate, make improvements to, equip or furnish various school | 0015| facilities in the Raton independent school district in Colfax | 0016| county; and | 0017| E. ninety-seven thousand six hundred seventy-nine | 0018| dollars ($97,679) to make improvements to, purchase computer | 0019| equipment for, equip or furnish facilities at the Des Moines | 0020| municipal schools in Union county. | 0021| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0022| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section | 0023| 1 of this act, upon certification by the local government | 0024| division of the department of finance and administration that | 0025| the need exists for the issuance of the bonds, the following | 0001| amounts are appropriated to the local government division of the | 0002| department of finance and administration for the following | 0003| purposes: | 0004| A. one hundred thousand dollars ($100,000) to | 0005| design, construct, equip or furnish the French Tract fire | 0006| district station in Colfax county; | 0007| B. fifty thousand dollars ($50,000) to purchase an | 0008| emergency vehicle for the Rosebud rescue facility in Harding | 0009| county; | 0010| C. two hundred fifty thousand dollars ($250,000) to | 0011| design, construct, equip or furnish a multipurpose building in | 0012| Eagle Nest in Colfax county; | 0013| D. one hundred thousand dollars ($100,000) to | 0014| construct, equip or furnish a fire station in Grady in Curry | 0015| county; | 0016| E. one hundred fifty thousand dollars ($150,000) to | 0017| make improvements to the recreation facilities and equipment at | 0018| the Clayton air park in Union county; | 0019| F. one hundred fifty thousand dollars ($150,000) to | 0020| make improvements to the Armex plaza in Raton in Colfax county; | 0021| and | 0022| G. one hundred fifty-two thousand dollars ($152,000) | 0023| to renovate, equip, furnish or make improvements to the county | 0024| courthouse in Raton in Colfax county. | 0025| Section 4. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0001| upon certification by the state agency on aging that the need | 0002| exists for the issuance of the bonds, the following amounts are | 0003| appropriated to the state agency on aging for the following | 0004| purposes: | 0005| A. one hundred fifty-six thousand eighty-five | 0006| dollars ($156,085) to design, construct, equip or furnish the | 0007| Des Moines senior citizen center and purchase a new vehicle for | 0008| the center in Union county; | 0009| B. one hundred fifty thousand dollars ($150,000) to | 0010| design, construct, equip or furnish improvements to the Cimarron | 0011| senior citizen center and recreational facility in Colfax | 0012| county; and | 0013| C. one hundred thousand dollars ($100,000) to | 0014| construct the Angel Fire senior citizen center in Colfax county. | 0015| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF | 0016| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1 | 0017| of this act, upon certification by the department of environment | 0018| that the need exists for the issuance of the bonds, the | 0019| following amounts are appropriated to the department of | 0020| environment for the following purposes: | 0021| A. six hundred thousand dollars ($600,000) to design | 0022| or construct a composting facility in Clovis in Curry county; | 0023| B. three hundred seventy-six thousand six hundred | 0024| twenty-two dollars ($376,622) to design, construct and inspect | 0025| water system improvements in Springer in Colfax county; and | 0001| C. fifty thousand dollars ($50,000) to design, | 0002| construct and inspect sewer system improvements in Mosquero in | 0003| Harding county. | 0004| Section 6. SEVERANCE TAX BONDS--BOARD OF REGENTS OF NEW | 0005| MEXICO STATE UNIVERSITY--PURPOSE.--Pursuant to the provisions of | 0006| Section 1 of this act, upon certification by the board of | 0007| regents of New Mexico state university that the need exists for | 0008| the issuance of the bonds, one hundred six thousand two hundred | 0009| fifty dollars ($106,250) is appropriated to the board of regents | 0010| of New Mexico state university for the purpose of repairing, | 0011| renovating and equipping the Clayton livestock research center | 0012| located in Union county. | 0013| Section 7. SEVERANCE TAX BONDS--STATE ENGINEER--PURPOSE.--Pursuant to the provisions of Section 1 of this act, upon | 0014| certification by the state engineer that the need exists for the | 0015| issuance of the bonds, eighty thousand dollars ($80,000) is | 0016| appropriated to the state engineer for the purpose of designing | 0017| and constructing improvements to the Antelope valley irrigation | 0018| district located in Colfax county. | 0019| Section 8.
