0012| RELATING TO INSURANCE; ENACTING A NEW SECTION OF THE NEW MEXICO

0013| INSURANCE CODE TO MANDATE FREEDOM OF CHOICE OF PRIMARY CARE

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of the New Mexico Insurance Code,
|
0018| Section 59A-18-32 NMSA 1978, is enacted to read:
|
0019| "59A-18-32. [NEW MATERIAL] FREEDOM OF CHOICE OF PRIMARY
|
0020| CARE PROVIDER.--
|
0021| A. If a policy allows a patient to see a licensed
|
0022| physician or osteopathic physician for diagnosis and treatment
|
0023| of a covered condition or complaint under coverage of his
|
0024| policy, that patient shall also be allowed under coverage of
|
0025| that policy the same freedom to choose any other class of
|
0001| primary care provider for diagnosis and treatment of that
|
0002| covered condition, regardless of the nomenclature used to
|
0003| describe the condition, complaint or service, if the diagnosis
|
0004| and treatment of the condition or complaint falls within the
|
0005| legal scope of practice of that primary care provider. Nothing
|
0006| in this section shall be construed to prohibit the application
|
0007| of deductibles, co-insurance or co-payments, preferred provider
|
0008| requirements, cost-containment measures or quality assurance
|
0009| measures if they are applied to all classes of practitioners of
|
0010| the healing arts. Freedom of choice and provider discrimination
|
0011| prohibition laws applicable to workers' compensation, health
|
0012| maintenance organizations, medicaid and nonprofit health care
|
0013| plans shall not be changed by this section, and this section
|
0014| shall not apply to medicaid, the Workers' Compensation Act, the
|
0015| Health Maintenance Organization Law and the Nonprofit Health
|
0016| Care Plan Law.
|
0017| B. As used in this section, "primary care provider"
|
0018| means any physician holding a license or certificate authorized
|
0019| in Chapter 61, Article 4, 6, 10 or 14A NMSA 1978 authorizing the
|
0020| licensee to offer or undertake to diagnose, treat, operate on or
|
0021| prescribe for any human pain, injury, disease, deformity or
|
0022| physical or mental condition."

0010| of that primary care provider. Nothing in this section shall

0011| restrict or prohibit the policy issuer from having the freedom
|
0012| to choose the application of deductibles, co-insurance or co-payments, preferred provider requirements, cost containment
|
0013| measures or quality assurance measures if such measures are
|
0014| applied equally to all classes of primary care providers. The
|
0015| provisions of this section do not modify or amend freedom of
|
0016| choice and provider discrimination prohibition laws applicable
|
0017| to workers' compensation, health maintenance organizations,
|
0018| medicaid and nonprofit health care plans.
|
0019| B. As used in this section, a "primary care provider"
|
0020| means any physician licensed under Chapter 61, Article 6, 10 or
|
0021| 14A NMSA 1978 authorizing the licensee to offer or undertake to

0022| diagnose, prevent, treat, operate on or prescribe for any human
|
0023| pain, injury, disease, deformity, physical or mental condition."
