0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0013| SEVERANCE TAX BONDS FOR CAPITAL PROJECTS IN SENATE DISTRICT 30
|
0014| IN CIBOLA, VALENCIA AND SOCORRO COUNTIES; MAKING APPROPRIATIONS;
|
0015| DECLARING AN EMERGENCY.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0019| APPROPRIATION OF PROCEEDS.--
|
0020| A. The state board of finance may issue and sell
|
0021| severance tax bonds in compliance with the Severance Tax Bonding
|
0022| Act in an amount not to exceed the total of the amounts
|
0023| authorized for purposes specified in Sections 2 through 6 of
|
0024| this act. The state board of finance shall schedule the
|
0025| issuance and sale of the bonds in the most expeditious and
|
0001| economical manner possible upon a finding by the board that the
|
0002| project has been developed sufficiently to justify the issuance
|
0003| and that the project can proceed to contract within a reasonable
|
0004| time. The state board of finance shall further take the
|
0005| appropriate steps necessary to comply with the Internal Revenue
|
0006| Code of 1986, as amended. Proceeds from the sale of the bonds
|
0007| are appropriated for the purposes specified in Sections 2
|
0008| through 6 of this act.
|
0009| B. The agencies named in Sections 2 through 6 of
|
0010| this act shall certify to the state board of finance when the
|
0011| money from the proceeds of the severance tax bonds authorized in
|
0012| this section is needed for the purposes specified in the
|
0013| applicable section of this act.
|
0014| C. If the specified agency has not certified the
|
0015| need for the issuance of the bonds by the end of fiscal year
|
0016| 1998, the authorization provided in this act shall be void.
|
0017| D. Unless otherwise specified in this act, any
|
0018| unexpended or unencumbered balance remaining from the proceeds
|
0019| of severance tax bonds issued pursuant to Sections 2 through 6
|
0020| of this act at the end of fiscal year 1999 shall revert to the
|
0021| severance tax bonding fund.
|
0022| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0023| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section
|
0024| 1 of this act, upon certification by the local government
|
0025| division of the department of finance and administration that
|
0001| the need exists for the issuance of the bonds, the following
|
0002| amounts are appropriated to the local government division of the
|
0003| department of finance and administration for the following
|
0004| purposes:
|
0005| A. seven hundred fifty-four thousand dollars
|
0006| ($754,000) for renovation and rehabilitation to the reservoir
|
0007| water tank in the city of Grants located in Cibola county;
|
0008| B. one hundred eighty thousand dollars ($180,000) to
|
0009| purchase a fire engine and to upgrade, replace and purchase
|
0010| equipment for the fire division in the city of Grants located in
|
0011| Cibola county;
|
0012| C. one million eight hundred thousand dollars
|
0013| ($1,800,000) to construct a multicultural center in the city of
|
0014| Grants located in Cibola county;
|
0015| D. eight hundred thousand dollars ($800,000) to
|
0016| construct a new city hall building in the city of Grants located
|
0017| in Cibola county;
|
0018| E. one hundred thousand dollars for construction of
|
0019| an expansion to a fire station in the city of Grants located in
|
0020| Cibola county;
|
0021| F. ninety thousand dollars ($90,000) to purchase and
|
0022| replace high mileage police vehicles in the city of Grants
|
0023| located in Cibola county;
|
0024| G. one hundred thousand dollars ($100,000) for
|
0025| renovation and repairs to municipal buildings to comply with
|
0001| federal Americans with Disabilities Act of 1990 requirements in
|
0002| Grants located in Cibola county;
|
0003| H. three hundred thousand dollars ($300,000) for
|
0004| lighting, concession stand, bleachers and construction of a
|
0005| recreational complex at Paddy Martinez ballfield in the city of
|
0006| Grants located in Cibola county;
|
0007| I. one hundred thousand dollars ($100,000) for
|
0008| construction of a convention center in the city of Grants
|
0009| located in Cibola county;
|
0010| J. forty-five thousand dollars ($45,000) to reroof
|
0011| the Cibola senior citizen center metal building in the city of
|
0012| Grants located in Cibola county;
|
0013| K. twenty-five thousand dollars ($25,000) for
|
0014| replacement and relocation of lights for the softball field at
|
0015| Wells Park in the city of Grants located in Cibola county;
|
0016| L. thirty thousand dollars ($30,000) to repair the
|
0017| roof of the animal control shelter in the city of Grants located
|
0018| in Cibola county;
|
0019| M. one hundred fifty thousand dollars ($150,000) for
|
0020| land acquisition and improvements for a cemetery in the city of
|
0021| Grants located in Cibola county; and
|
0022| N. thirty-five thousand dollars ($35,000) to
|
0023| renovate and equip the mining museum in the city of Grants
|
0024| located in Cibola county.
|
0025| Section 3. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF
|
0001| INDIAN AFFAIRS--PURPOSES.--Pursuant to the provisions of Section
|
0002| 1 of this act, upon certification by the New Mexico office of
|
0003| Indian affairs that the need exists for the issuance of the
|
0004| bonds, the following amounts are appropriated to the New Mexico
|
0005| office of Indian affairs for the following purposes:
|
0006| A. one hundred ten thousand dollars ($110,000) for
|
0007| improvements to and resurfacing of the Laguna/Acoma high school
|
0008| track located in Cibola county; and
|
0009| B. three hundred fifty-four thousand dollars
|
0010| ($354,000) to design, construct and equip a court building for
|
0011| the Navajo nation in Alamo in Socorro county.
|
0012| Section 4. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSE.--Pursuant to the provisions of Section 1 of this act,
|
0013| upon certification by the state agency on aging that the need
|
0014| exists for the issuance of the bonds, one hundred fifteen
|
0015| thousand dollars ($115,000) is appropriated to the state agency
|
0016| on aging for planning and designing two senior citizen centers
|
0017| on the Laguna reservation located in Cibola county.
|
0018| Section 5. SEVERANCE TAX BONDS--STATE DEPARTMENT OF PUBLIC
|
0019| EDUCATION--PURPOSES.--Pursuant to the provisions of Section 1 of
|
0020| this act, upon certification by the state department of public
|
0021| education that the need exists for the issuance of the bonds,
|
0022| the following amounts are appropriated to the state department
|
0023| of public education for the following purposes:
|
0024| A. two hundred thousand dollars ($200,000) for
|
0025| lighting, sprinklers, sodding, fencing and resurfacing of the
|
0001| community outdoor recreational facility located on the Grants
|
0002| high school campus in Grants located in Cibola county; and
|
0003| B. one hundred thousand dollars ($100,000) for
|
0004| planning a comprehensive junior/senior high school for the
|
0005| Grants/Cibola county schools in cooperation with Laguna pueblo
|
0006| to be located in Cibola county.
|
0007| Section 6. SEVERANCE TAX BONDS--STATE HIGHWAY AND
|
0008| TRANSPORTATION DEPARTMENT--PURPOSE.--Pursuant to the provisions
|
0009| of Section 1 of this act, upon certification by the state
|
0010| highway and transportation department that the need exists for
|
0011| the issuance of the bonds, eighty-eight thousand dollars
|
0012| ($88,000) is appropriated to the state highway and
|
0013| transportation department to make improvements to Quail road in
|
0014| Valencia county.
|
0015| Section 7. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect immediately.
