0012| RELATING TO INDIAN CULTURE; ABOLISHING THE INTERTRIBAL INDIAN

0013| CEREMONIAL ASSOCIATION; AMENDING, REPEALING AND ENACTING
|
0014| SECTIONS OF THE NMSA 1978; MAKING AN APPROPRIATION.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of the Tourism Department Act is
|
0018| enacted to read:
|
0019| "[NEW MATERIAL] ADDITIONAL DUTIES OF SECRETARY--PROMOTION OF INDIAN ARTS, CRAFTS AND CULTURE.--In addition to
|
0020| the secretary's responsibility for the overall supervision of
|
0021| the department, the secretary shall encourage the preservation
|
0022| and development of Indian arts and crafts among the Indian
|
0023| tribes and pueblos of the state, as well as preservation of
|
0024| traditional rites and ceremonials of Indian tribes and pueblos
|
0025| to increase knowledge and appreciation of those arts, crafts,
|
0001| rites and ceremonials."

0002| Section 2. Section 13-1-99 NMSA 1978 (being Laws 1984,
|
0003| Chapter 65, Section 72, as amended) is amended to read:
|
0004| "13-1-99. EXCLUDED FROM CENTRAL PURCHASING THROUGH THE
|
0005| STATE PURCHASING AGENT.--Excluded from the requirement of
|
0006| procurement through the state purchasing agent but not from the
|
0007| requirements of the Procurement Code are the following:
|
0008| A. procurement of professional services;
|
0009| B. small purchases having a value not exceeding two
|
0010| hundred fifty dollars ($250);
|
0011| C. emergency procurement;
|
0012| D. procurement of highway construction or
|
0013| reconstruction by the state highway and transportation
|
0014| department;
|
0015| E. procurement by the judicial branch of state
|
0016| government;
|
0017| F. procurement by the legislative branch of state
|
0018| government;
|
0019| G. procurement by the boards of regents of state
|
0020| educational institutions named in Article 12, Section 11 of the
|
0021| constitution of New Mexico;
|
0022| H. procurement of information processing resources
|
0023| procured through the commission on information and communication
|
0024| management;
|
0025| I. procurement by the state fair commission of
|
0001| tangible personal property, services and construction under five
|
0002| thousand dollars ($5,000);
|
0003| [J. procurement by the intertribal Indian
|
0004| ceremonial association;
|
0005| K.] J. purchases from the instructional material
|
0006| fund;
|
0007| [L.] K. procurement by all local public bodies;
|
0008| [M.] L. procurement by regional education
|
0009| cooperatives; and
|
0010| [N.] M. procurement by each state health care
|
0011| institution that provides direct patient care and that is, or a
|
0012| part of which is, medicaid certified and participating in the
|
0013| New Mexico medicaid program."

0014| Section 3. APPROPRIATION.--One hundred fifteen thousand
|
0015| dollars ($115,000) is appropriated from the general fund to the
|
0016| tourism department for expenditure in fiscal year 1997 to carry
|
0017| out the provisions of Section 1 of this act, including
|
0018| assistance of Indian tribes and pueblos in promoting the annual
|
0019| intertribal Indian ceremonial week in Gallup. Any unexpended or
|
0020| unencumbered balance remaining at the end of fiscal year 1997
|
0021| shall revert to the general fund.
|
0022| Section 4. REPEAL.--Sections 28-12-1 through 28-12-3 NMSA
|
0023| 1978 (being Laws 1939, Chapter 42, Section 1 and Laws 1967,
|
0024| Chapter 299, Sections 1 and 2) are repealed.
|
0025| Section 5. EFFECTIVE DATE.--The effective date of the
|
0001| provisions of this act is July 1, 1996.
