CAPITAL PROGRAM FUND--CHANGE IN AGENCY--CONTINUED AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The capital program fund appropriation, pursuant to Paragraph | 0020| (2) of Subsection U of Section 2 of Chapter 6 of Laws 1990 (1st | 0021| S.S.), for the construction of a home for homeless children | 0022| shall be appropriated to the local government division of the | 0023| department of finance and administration to plan, design, | 0024| construct and furnish a home for homeless children in | 0025| Albuquerque located in Bernalillo county, provided that the city | 0001| of Albuquerque receives a donation from a private or public | 0002| organization of a minimum of ten acres of land for constructing | 0003| the home and that the city of Albuquerque, through its child | 0004| development office, executes a contract with the private or | 0005| public organization donating the land requiring that the | 0006| organization agree to operate the home for a minimum of ten | 0007| years. Notwithstanding the provisions of Laws 1995, Chapter | 0008| 218, Section 27, any unexpended or unencumbered balance | 0009| remaining at the end of fiscal year 1999 shall revert to the | 0010| capital program fund. | 0011| Section 2. SEVERANCE TAX BONDS--CHANGE IN AGENCY--CONTINUED AUTHORIZATION--CHANGE IN CONTINGENCY--APPROPRIATION.--The balance of the proceeds from severance tax bonds | 0012| appropriated to the general services department, pursuant to | 0013| Laws 1992, Chapter 113, Section 20, for the New Day shelter for | 0014| troubled youth in Albuquerque located in Bernalillo county shall | 0015| not be expended by that agency nor be subject to the contingency | 0016| imposed but is reauthorized and appropriated to the local | 0017| government division of the department of finance and | 0018| administration and shall be contingent upon the city of | 0019| Albuquerque receiving a donation from a private or public | 0020| organization of a minimum of ten acres of land for building the | 0021| home, and the city of Albuquerque, through its child development | 0022| office, executing a contract with the private or public | 0023| organization donating the land requiring that the organization | 0024| agree to operate the home for a minimum of ten years. | 0025| Notwithstanding the provisions of Laws 1995, Chapter 218, | 0001| Section 27, any unexpended or unencumbered balance remaining at | 0002| the end of fiscal year 1999 shall revert to the severance tax | 0003| bonding fund. | 0004| Section 3.
