0012| RELATING TO GAME AND FISH; INCREASING THE AMOUNT OF CERTAIN

0013| NONRESIDENT GAME FEES; CREATING A FUND; PROVIDING COMPENSATION

0014| FOR DEPREDATION CAUSED BY WILDLIFE OR PREDATORS; MAKING AN

0015| APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 17-3-13 NMSA 1978 (being Laws 1964 (1st
|
0019| S.S.), Chapter 17, Section 5, as amended) is amended to read:
|
0020| "17-3-13. LICENSE FEES.--
|
0021| A. The director of the department of game and fish
|
0022| shall keep a record of all money received and licenses and
|
0023| permits issued by him, numbering each class separately. Upon
|
0024| satisfactory proof that any license or permit has been lost
|
0025| before its expiration, he may issue a duplicate and collect a
|
0001| just and reasonable fee for it as determined by regulation of
|
0002| the state game commission.
|
0003| B. The director of the department of game and fish
|
0004| shall collect the following fees for each license of the class
|
0005| indicated:
|
0006| Resident, fishing . . . . . . . . . . . $ 17.50

0007| Section 2. A new section of Chapter 17 NMSA 1978 is

0008| enacted to read:
|
0009| "[NEW MATERIAL] DEPREDATION FUND--ADMINISTRATION--REGULATIONS--DISTRIBUTION.--
|
0010| A. There is created in the state treasury the
|
0011| "depredation fund" to be administered by the state game
|
0012| commission.
|
0013| B. The state game commission shall place into the
|
0014| depredation fund the sum of fifty dollars ($50.00) from each
|
0015| license enumerated in this subsection that is sold after July 1,
|
0016| 1996:
|
0017| (1) nonresident, deer;
|
0018| (2) nonresident, quality deer;
|
0019| (3) nonresident, antelope;
|
0020| (4) nonresident, elk cow;
|
0021| (5) nonresident, elk bull or either sex;
|
0022| (6) nonresident, quality elk;
|
0023| (7) nonresident, bighorn sheep;
|
0024| (8) nonresident, Barbary sheep;
|
0025| (9) nonresident, bison;
|
0001| (10) nonresident, oryx;
|
0002| (11) nonresident, ibex;
|
0003| (12) nonresident, gazelle; and
|
0004| (13) nonresident, javelina.
|
0005| C. The state game commission shall adopt regulations
|
0006| establishing procedures for making disbursements from the
|
0007| depredation fund to compensate persons whose primary business
|
0008| activity is ranching or farming for damage that is caused by
|
0009| wildlife or predators.
|
0010| D. Payments from the depredation fund shall be made
|
0011| upon vouchers issued and signed by the chairman of the state
|
0012| game commission upon warrants drawn by the secretary of finance
|
0013| and administration."
|
0014| Section 3. EFFECTIVE DATE.--The effective date of the
|
0015| provisions of the is act is July 1, 1996.
