0012| RELATING TO EDUCATION; PROVIDING THAT TECHNICAL AND VOCATIONAL

0013| INSTITUTE DISTRICTS BE LIMITED TO CERTAIN CLASS A COUNTIES;

0014| PROVIDING FOR TRANSFER OF SPECIAL ASSESSMENT PROCEEDS; MAKING AN
|
0015| APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. A new section of the Technical and Vocational
|
0019| Institute Act is enacted to read:
|
0020| "[NEW MATERIAL] TECHNICAL AND VOCATIONAL INSTITUTE IN
|
0021| CERTAIN CLASS A COUNTIES.--Notwithstanding any other provisions
|
0022| of the Technical and Vocational Institute Act, no technical and
|
0023| vocational institute district that includes a class A county
|
0024| with assessed valuation in excess of four hundred million
|
0025| dollars ($400,000,000) shall include any territory outside the
|
0001| class A county."
|
0002| Section 2. TEMPORARY PROVISION--TRANSFER OF SPECIAL
|
0003| ASSESSMENT.--Proceeds derived from any special assessment levy
|
0004| in any county that, pursuant to this act, can no longer be
|
0005| included in a technical and vocational institute district in a
|
0006| class A county with an assessed valuation in excess of four
|
0007| hundred million dollars ($400,000,000) shall be held in a
|
0008| segregated trust fund by the district. The trust fund shall be
|
0009| used for development of a community college or similar
|
0010| facilities in any county that is excluded from the district
|
0011| pursuant to this act. The fund shall be expended upon
|
0012| certification by the school boards located in any such counties.
