0012|     RELATING TO INDIAN CULTURE; ABOLISHING THE STATE AGENCY STATUS

0013|     OF THE INTERTRIBAL INDIAN CEREMONIAL ASSOCIATION; TRANSFERRING
    |
0014|     PROPERTY AND PERSONNEL; AMENDING, REPEALING AND ENACTING
    |
0015|     SECTIONS OF THE NMSA 1978; MAKING AN APPROPRIATION.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|       Section 1.  A new section of the Tourism Department Act is
    |
0019|     enacted to read:
    |
0020|       "[NEW MATERIAL]  SECRETARY--ADDITIONAL DUTIES--PROMOTION
    |
0021|     OF INDIAN ARTS, CRAFTS AND CULTURE.--In addition to the
    |
0022|     secretary's responsibility for the overall supervision of the
    |
0023|     department, the secretary shall:
    |
0024|            A.  encourage the preservation and development of
    |
0025|     Indian arts and crafts among the Indian tribes and pueblos of
    |
0001|     the state;
    |
0002|            B.  encourage the preservation of traditional rites
    |
0003|     and ceremonials of Indian tribes and pueblos to increase
    |
0004|     knowledge and appreciation of those arts, crafts, rites and
    |
0005|     ceremonials; and
    |
0006|            C.  promote the intertribal Indian ceremonial
    |
0007|     association, incorporated, located in Gallup."
    |
0008|       Section 2.  Section 13-1-99 NMSA 1978 (being Laws 1984,
    |
0009|     Chapter 65, Section 72, as amended) is amended to read:
    |
0010|       "13-1-99.  EXCLUDED FROM CENTRAL PURCHASING THROUGH THE
    |
0011|     STATE PURCHASING AGENT.--Excluded from the requirement of
    |
0012|     procurement through the state purchasing agent but not from the
    |
0013|     requirements of the Procurement Code are the following:
    |
0014|            A.  procurement of professional services;
    |
0015|            B.  small purchases having a value not exceeding two
    |
0016|     hundred fifty dollars ($250);
    |
0017|            C.  emergency procurement;
    |
0018|            D.  procurement of highway construction or
    |
0019|     reconstruction by the state highway and transportation
    |
0020|     department;
    |
0021|            E.  procurement by the judicial branch of state
    |
0022|     government;
    |
0023|            F.  procurement by the legislative branch of state
    |
0024|     government;
    |
0025|            G.  procurement by the boards of regents of state
    |
0001|     educational institutions named in Article 12, Section 11 of the
    |
0002|     constitution of New Mexico;
    |
0003|            H.  procurement of information processing resources
    |
0004|     procured through the commission on information and communication
    |
0005|     management;
    |
0006|            I.  procurement by the state fair commission of
    |
0007|     tangible personal property, services and construction under five
    |
0008|     thousand dollars ($5,000);
    |
0009|            [J.  procurement by the intertribal Indian
    |
0010|     ceremonial association;
    |
0011|            K.] J.  purchases from the instructional material
    |
0012|     fund;
    |
0013|            [L.] K.  procurement by all local public bodies;
    |
0014|            [M.] L.  procurement by regional education
    |
0015|     cooperatives; and
    |
0016|            [N.] M.  procurement by each state health care
    |
0017|     institution that provides direct patient care and that is, or a
    |
0018|     part of which is, medicaid certified and participating in the
    |
0019|     New Mexico medicaid program."
    |
0020|       Section 3.  TEMPORARY PROVISION--TRANSFER OF PERSONNEL,
    |
0021|     APPROPRIATIONS AND ASSETS.--On the effective date of this act,
    |
0022|     all personnel, money, appropriations, records, property,
    |
0023|     equipment and supplies belonging to the intertribal Indian
    |
0024|     ceremonial association, a state agency, are transferred to the
    |
0025|     city of Gallup for the exclusive use by the intertribal Indian
    |
0001|     ceremonial association, incorporated, a nonprofit corporation.
    |
0002|       Section 4.  APPROPRIATION.--Three hundred forty-five
    |
0003|     thousand dollars ($345,000) is appropriated from the general
    |
0004|     fund to the tourism department for expenditure in fiscal years
    |
0005|     1997 through 1999 for promoting Indian arts, crafts and culture
    |
0006|     through the intertribal Indian ceremonial association,
    |
0007|     incorporated, located in Gallup.  Any unexpended or unencumbered
    |
0008|     balance remaining at the end of fiscal year 1999 shall revert to
    |
0009|     the general fund.
    |
0010|       Section 5.  REPEAL.--Sections 28-12-1 through 28-12-3 NMSA
    |
0011|     1978 (being Laws 1939, Chapter 42, Section 1 and Laws, 1967,
    |
0012|     Chapter 299, Sections 1 and 2) are repealed.
    |
0013|       Section 6.  EFFECTIVE DATE.--The effective date of the
    |
0014|     provisions of this act is July 1, 1996.
