0012| RELATING TO PUBLIC ASSISTANCE; ESTABLISHING A PILOT PROJECT

0013| REQUIRING SCHOOL ATTENDANCE FOR CERTAIN RECIPIENTS.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new Section 27-2-6.3 NMSA 1978 is enacted to
|
0017| read:
|
0018| "27-2-6.3. [NEW MATERIAL] AID TO FAMILIES WITH
|
0019| DEPENDENT CHILDREN--MANDATORY SCHOOL ATTENDANCE.--
|
0020| A. The secretary of human services shall adopt
|
0021| regulations governing and shall implement a pilot project
|
0022| providing for loss of public assistance benefits under AFDC
|
0023| programs by any eligible person subject to compulsory school
|
0024| attendance who is absent from school without authorized excuse
|
0025| more than ten full days or the equivalent thereof during a
|
0001| semester or five full days or the equivalent thereof during any
|
0002| nine-week grading period. The pilot project may apply generally
|
0003| or to specified age groups and specified political subdivisions.
|
0004| The pilot project shall provide that loss of AFDC benefits may
|
0005| be suspended under specified conditions based on active
|
0006| participation in programs under the Family in Need of Services
|
0007| Act.
|
0008| B. Following adoption of pilot project regulations,
|
0009| but before implementation, the secretary of human services shall
|
0010| seek a waiver from the secretary of the United States department
|
0011| of health and human services pursuant to 42 U.S.C. Section 1315
|
0012| to the extent necessary to permit implementation of the pilot
|
0013| project. The pilot project regulations shall not take effect
|
0014| and the pilot project shall not be implemented until the wavier
|
0015| is granted.
|
0016| C. As used in this section, "AFDC" means the public
|
0017| assistance plan authorized pursuant to 42 U.S.C. Section 601, et
|
0018| seq., and Section 27-2-6 NMSA 1978."
