0012|     RELATING TO EXPENDITURE OF PUBLIC FUNDS; IMPOSING RESTRICTIONS
    |
0013|     ON OUT-OF-STATE TRAVEL BY PUBLIC OFFICERS, OFFICIALS AND
    |
0014|     EMPLOYEES.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  A new section of the Per Diem and Mileage Act
    |
0018|     is enacted to read:
    |
0019|       "[NEW MATERIAL]  PRIOR APPROVAL OF OUT-OF-STATE TRAVEL
    |
0020|     REIMBURSEMENT REQUIRED.--
    |
0021|            A.  No public officer, public official or employee of
    |
0022|     a state agency shall be reimbursed for any expense of out-of-state travel by that officer, official or employee unless the
    |
0023|     state agency has received prior approval of the travel from the
    |
0024|     state board of finance.  The board shall adopt regulations
    |
0025|     establishing the contents of an application for approval and the
    |
0001|     criteria that will be applied to a request for approval in
    |
0002|     considering the action to be taken, which criteria shall include
    |
0003|     requirements that the requesting agency:
    |
0004|                 (1)  show specific budgetary authorization and
    |
0005|     availability of funds for the requested travel; and
    |
0006|                 (2)  demonstrate to the board's satisfaction
    |
0007|     that the requested travel will produce specific benefits to the
    |
0008|     agency that are reasonable when subjected to a cost-benefit
    |
0009|     analysis.
    |
0010|            B.  No public officer, public official or employee of
    |
0011|     a public post-secondary educational institution shall be
    |
0012|     reimbursed for any expense of out-of-state travel by that
    |
0013|     officer, official or employee unless the institution has
    |
0014|     received prior approval of the travel from the commission on
    |
0015|     higher education.  The commission shall adopt regulations
    |
0016|     establishing the contents of an application for approval and the
    |
0017|     criteria that will be applied to a request for approval in
    |
0018|     considering the action to be taken, which criteria shall include
    |
0019|     requirements that the requesting institution:
    |
0020|                 (1)  show specific budgetary authorization and
    |
0021|     availability of funds for the requested travel; and
    |
0022|                 (2)  demonstrate to the commission's
    |
0023|     satisfaction that the requested travel will produce specific
    |
0024|     benefits to the institution that are reasonable when subjected
    |

0001|       Section 2.  EFFECTIVE DATE.--The effective date of the
