ARAGON | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| AN ACT | 0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0013| SEVERANCE TAX BONDS FOR CAPITAL IMPROVEMENTS; DECLARING AN | 0014| EMERGENCY. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0018| APPROPRIATION OF PROCEEDS.-- | 0019| A. The state board of finance may issue and sell | 0020| severance tax bonds in compliance with the Severance Tax Bonding | 0021| Act in an amount not to exceed the total of the amounts | 0022| authorized for purposes specified in Sections 2 through 24 of | 0023| this act. The state board of finance shall schedule the | 0024| issuance and sale of the bonds in the most expeditious and | 0025| economical manner possible upon a finding by the board that the | 0001| project has been developed sufficiently to justify the issuance | 0002| and that the project can proceed to contract within a reasonable | 0003| time. The state board of finance shall further take the | 0004| appropriate steps necessary to comply with the Internal Revenue | 0005| Code of 1986, as amended. Proceeds from the sale of the bonds | 0006| are appropriated for the purposes specified in Sections 2 | 0007| through 24 of this act. | 0008| B. The agencies named in Sections 2 through 24 of | 0009| this act shall certify to the state board of finance when the | 0010| money from the proceeds of the severance tax bonds authorized in | 0011| this section is needed for the purposes specified in the | 0012| applicable sections of this act. | 0013| C. If the specified agency has not certified the | 0014| need for the issuance of the bonds by the end of fiscal year | 0015| 1998, the authorization provided in this act shall be void. | 0016| D. Unless otherwise specified in this act, any | 0017| unexpended or unencumbered balance remaining from the proceeds | 0018| from severance tax bonds issued pursuant to Sections 2 through | 0019| 24 of this act after fiscal year 1999 shall revert to the | 0020| severance tax bonding fund. | 0021| Section 2. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0022| upon certification by the state agency on aging that the need | 0023| exists for the issuance of the bonds, the following amounts are | 0024| appropriated to the state agency on aging for the following | 0025| purposes: | 0001| A. three hundred seventy thousand dollars ($370,000) | 0002| for renovation and improvement of the existing structure and | 0003| designing, constructing, equipping and furnishing an addition to | 0004| the North Mesa senior citizen center in Carlsbad in Eddy county; | 0005| B. sixty-five thousand dollars ($65,000) to complete | 0006| construction of additions or improvements to or to equip and | 0007| furnish the Corona senior citizen center in Lincoln county; | 0008| C. one hundred fifty thousand dollars ($150,000) to | 0009| plan, design, construct or renovate the senior citizen center in | 0010| Deming located in Luna county; | 0011| D. one hundred thousand dollars ($100,000) for the | 0012| purpose of planning, designing, constructing or equipping a | 0013| senior citizen meal site in Artesia in Eddy county; | 0014| E. fifty thousand eight hundred ninety-five dollars | 0015| ($50,895) for the purchase of vehicles or equipment for the | 0016| Dulce senior citizen center in Rio Arriba county; | 0017| F. thirty-nine thousand two hundred forty dollars | 0018| ($39,240) for purchasing and equipping vehicles for handicapped | 0019| and elderly persons for the senior citizen center at Dulce in | 0020| Rio Arriba county; | 0021| G. forty-five thousand dollars ($45,000) to plan, | 0022| design or construct the Arrey senior center in Sierra county and | 0023| to make other improvements in order to comply with the federal | 0024| Americans with Disabilities Act of 1990; | 0025| H. one hundred five thousand dollars ($105,000) to | 0001| plan, design or construct the McIntosh senior citizen center | 0002| located in Torrance county; | 0003| I. fifty thousand dollars ($50,000) for the purpose | 0004| of designing, constructing, including infrastructure work, and | 0005| equipping a senior citizen center in Shiprock located in San | 0006| Juan county; | 0007| J. one hundred thousand dollars ($100,000) for the | 0008| purpose of designing, constructing and equipping a senior | 0009| citizen center in Sanostee located in San Juan county; | 0010| K. one hundred thousand dollars ($100,000) to | 0011| design, construct and equip a new permanent meal site building | 0012| for senior citizens in the vicinity of Wyoming and Paseo del | 0013| Norte in the northeast heights section of Albuquerque in | 0014| Bernalillo county; | 0015| L. twenty-five thousand dollars ($25,000) to | 0016| purchase a handicapped-equipped van with a wheelchair lift that | 0017| complies with the federal Americans with Disabilities Act of | 0018| 1990 for the city of Grants located in Cibola county; | 0019| M. one hundred seventy-five thousand dollars | 0020| ($175,000) for renovations and to purchase vehicles and meal | 0021| site and other equipment for the Isleta pueblo senior center | 0022| located in Bernalillo county; | 0023| N. fifty thousand dollars ($50,000) to design, | 0024| construct or equip a senior citizen center in the town of | 0025| Springer in Colfax county; and | 0001| O. thirty-four thousand dollars ($34,000) for | 0002| recreational equipment for the San Jose senior citizen center in | 0003| Carlsbad in Eddy county. | 0004| Section 3. SEVERANCE TAX BONDS--OFFICE OF CULTURAL | 0005| AFFAIRS--PURPOSES.--Pursuant to the provisions of Section 1 of | 0006| this act, upon certification by the office of cultural affairs | 0007| that the need exists for the issuance of the bonds, the | 0008| following amounts are appropriated to the office of cultural | 0009| affairs for the following purposes: | 0010| A. two hundred thousand dollars ($200,000) to plan, | 0011| design, renovate, construct improvements to, equip or furnish | 0012| the New Mexico museum of natural history and science and its | 0013| annex in Bernalillo county; | 0014| B. one million six hundred thousand dollars | 0015| ($1,600,000) to house and exhibit the Neutrogena collection in | 0016| Santa Fe county; | 0017| C. one million dollars ($1,000,000) to plan, design, | 0018| construct or equip a Hispanic cultural center located in | 0019| Bernalillo county; and | 0020| D. two hundred thousand dollars ($200,000) for the | 0021| purpose of conducting a facilities plan for a new museum complex | 0022| in Santa Fe to include structural analysis and schematic design | 0023| and to develop a plan for a new museum administration building | 0024| for the museum of New Mexico located in Santa Fe county. | 0025| Section 4. SEVERANCE TAX BONDS--ALBUQUERQUE TECHNICAL-VOCATIONAL INSTITUTE--PURPOSE.--Pursuant to the provisions of | 0001| Section 1 of this act, upon certification by the governing board | 0002| of Albuquerque technical-vocational institute that the need | 0003| exists for the issuance of the bonds, three hundred fifty | 0004| thousand dollars ($350,000) is appropriated to the governing | 0005| board of the Albuquerque technical-vocational institute to | 0006| purchase and renovate Pajarito elementary school in the | 0007| Albuquerque public school district located in Bernalillo county. | 0008| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0009| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section | 0010| 1 of this act, upon certification by the local government | 0011| division of the department of finance and administration that | 0012| the need exists for the issuance of the bonds, the following | 0013| amounts are appropriated to the local government division of the | 0014| department of finance and administration for the following | 0015| purposes: | 0016| A. fifty thousand dollars ($50,000) for the purpose | 0017| of planning or constructing phase II of the youth sports complex | 0018| located in Sandoval county; CONFLICT WITH EXISTING LAW--LAW CONTROLLING--REVERSIONS.--If the amount and purpose of any appropriation in | 0020| this act is identical to the amount and purpose of any | 0021| appropriation in Laws 1995, Chapter 222, Sections 21 through 44, | 0022| then, in regard to any such appropriations: | 0023| A. the provisions of this act are controlling and | 0024| the appropriation is made pursuant to the provisions of this | 0025| act; | 0001| B. the appropriation in Laws 1995, Chapter 222, | 0002| Sections 21 through 44 is repealed; and | 0003| C. notwithstanding the provisions of Laws 1995, | 0004| Chapter 222, Section 20, the balance of the appropriation in | 0005| Laws 1995, Chapter 222, Sections 21 through 44 shall revert to | 0006| the general fund on June 30, 1996. | 0007| Section 26.
