0012| REQUESTING THE DEPARTMENT OF INSURANCE OF THE STATE CORPORATION

0013| COMMISSION TO INVESTIGATE AND REPORT ON HEALTH AND LIFE
|
0014| INSURANCE AVAILABILITY TO DOMESTIC VIOLENCE VICTIMS.
|

0016| WHEREAS, twenty to thirty percent of all women are
|
0017| physically abused in their own homes during their lifetimes,
|
0018| showing that violence is as American and homemade as apple pie;
|
0019| and
|
0020| WHEREAS, New Mexico's domestic violence shelters care for
|
0021| about one thousand victims each month, one in five pregnant
|
0022| women suffer domestic abuse and twenty percent of the women
|
0023| using hospital emergency rooms do so because of having been
|
0024| abused; and
|
0025| WHEREAS, the emotional costs and productivity costs are
|
0001| high, estimates running as much as ten billion dollars a year
|
0002| nationally; and
|
0003| WHEREAS, evidence shows that about twenty-five percent of
|
0004| insurance companies deny health or life insurance to battered
|
0005| women if they report their injuries to the police, seek a
|
0006| judicial remedy or if their doctors report the injuries; and
|
0007| WHEREAS, domestic violence is a public health problem as
|
0008| well as a criminal justice problem and deserves appropriate
|
0009| health care and coverage by health care insurance, including
|
0010| universal coverage and comprehensive benefits packages;
|
0011| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0012| STATE OF NEW MEXICO that the department of insurance of the
|
0013| state corporation commission be requested to investigate and
|
0014| report on the lack of health or life insurance coverage for
|
0015| victims of domestic violence; and
|
0016| BE IT FURTHER RESOLVED that the department of insurance of
|
0017| the state corporation commission be requested to form a working
|
0018| group composed of representatives from the commission on the
|
0019| status of women, the domestic violence coalition, a shelter for
|
0020| battered women, the insurance industry and the New Mexico health
|
0021| policy commission to assist in the department's investigation;
|
0022| and
|
0023| BE IT FURTHER RESOLVED that the state corporation
|
0024| commission hold public hearings and submit a report with
|
0025| recommendations to the courts, corrections and criminal justice
|
0001| committee and to the interim legislative health and human
|
0002| services committee before December 1, 1996; and
|
0003| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0004| transmitted to the department of insurance of the state
|
0005| corporation commission.
