GONZALES | 0006| | 0007| | 0008| | 0009| | 0010| | 0011| A MEMORIAL | 0012| REQUESTING THAT THE STATE BOARD OF EDUCATION STUDY THE | 0013| FEASIBILITY OF ALLOCATING ALL STATE BILINGUAL EDUCATION FUNDING | 0014| TO THEIR BILINGUAL EDUCATION PROGRAMS. | 0015| | 0016| WHEREAS, minority students represent sixty and five-tenths | 0017| percent of the total New Mexico public school enrollment, and | 0018| forty-two percent of that minority student population has | 0019| limited proficiency in English; and | 0020| WHEREAS, bilingual education is an instructional | 0021| methodology used by school districts to address the educational | 0022| needs of limited-English-proficient students; and | 0023| WHEREAS, the United States department of education's office | 0024| for civil rights, in 1995, found that programs for limited-English-proficient students in several New Mexico school | 0025| districts were not in compliance with a number of requirements | 0001| under Title 6 of the Civil Rights Act of 1964, Section 504 of | 0002| the Rehabilitation Act of 1973 or Title 2 of the Americans with | 0003| Disabilities Act of 1990; and | 0004| WHEREAS, among the findings of the office for civil rights' | 0005| report concerning programs for students with limited English | 0006| proficiency was the failure to provide adequate resources, such | 0007| as instructional material and equipment, the failure to provide | 0008| enough teachers who are qualified to teach the programs selected | 0009| by the district and the failure to provide sufficient in-service | 0010| training; and | 0011| WHEREAS, school districts are not currently required to | 0012| allocate all bilingual education funding provided by the state | 0013| and generated by the number of identified limited-English-proficient students in a district to their bilingual education | 0014| programs; | 0015| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0016| STATE OF NEW MEXICO that the state board of education, in | 0017| cooperation with the legislative education study committee and | 0018| school district representatives, be requested to study the | 0019| feasibility of requiring school districts to allocate all state | 0020| bilingual education funding generated by the number of limited-English-proficient students in their districts to their | 0021| bilingual education programs; and | 0022| BE IT FURTHER RESOLVED that the state department of public | 0023| education be requested to report to the legislative education | 0024| study committee by October 1, 1996 concerning the allocation of | 0025| state funding for bilingual education at the school district | 0001| level; and | 0002| BE IT FURTHER RESOLVED that copies of this memorial be | 0003| transmitted to the superintendent of public instruction and the | 0004| director of the legislative education study committee for | 0005| appropriate distribution. | 0006|  State of New Mexico | 0007| House of Representatives | 0008| | 0009| FORTY-SECOND LEGISLATURE | 0010| SECOND SESSION, 1996 | 0011| | 0012| February 8, l996 | 0013| | 0014| | 0015| Mr. Speaker: | 0016| | 0017| Your RULES AND ORDER OF BUSINESS COMMITTEE, to | 0018| whom has been referred | 0019| | 0020| HOUSE JOINT MEMORIAL 55 | 0021| | 0022| has had it under consideration and finds same to be | 0023| GERMANE in accordance with constitutional provisions. | 0024| | 0025| Respectfully submitted, | 0001| | 0002| | 0003| | 0004| | 0005| Barbara A.
