0012| REQUESTING THE STATE CORPORATION COMMISSION AND THE DEPARTMENT

0013| OF INSURANCE TO STUDY DISCREPANCIES IN THE NEW MEXICO INSURANCE

0014| CODE RELATED TO INSURANCE COVERAGE FOR SERVICES PROVIDED BY
|
0015| QUALIFIED ADVANCED PRACTICE NURSES.

0017| WHEREAS, advanced practice nurses are providing valuable
|
0018| health care services to the citizens of New Mexico; and
|
0019| WHEREAS, advanced practice nurses are providers of choice
|
0020| of many citizens of New Mexico; and
|
0021| WHEREAS, insurance coverage for health care services
|
0022| provided by advanced practice nurses is included in the New
|
0023| Mexico Insurance Code under Chapter 59A, Article 22 NMSA 1978
|
0024| health insurance contracts; and
|
0025| WHEREAS, insurance coverage for health care services
|
0001| provided by advanced practice nurses is not included in the New
|
0002| Mexico Insurance Code under Chapter 59A, Article 47 NMSA 1978
|
0003| nonprofit health care plans; and
|
0004| WHEREAS, advanced practice nurses are included in the
|
0005| Health Maintenance Organization Law under Section 59A-46-2 NMSA
|
0006| 1978, but excluded from Section 59A-46-32 NMSA 1978; and
|
0007| WHEREAS, the lack of insurance coverage provided in the New
|
0008| Mexico Insurance Code for advanced practice nurses results in
|
0009| loss of effective utilization of qualified, competent health
|
0010| care providers that, in turn, directly impacts access to health
|
0011| care services for New Mexico citizens;
|
0012| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0013| STATE OF NEW MEXICO that the state corporation commission and
|
0014| the department of insurance study and propose corrections in the
|
0015| discrepancies that exist in the New Mexico Insurance Code that
|
0016| relate to insurance coverage through insurance contracts,
|
0017| nonprofit health care plans and health maintenance organizations
|
0018| for health care services provided by qualified advanced practice
|
0019| nurses; and
|
0020| BE IT FURTHER RESOLVED that copies of this memorial be
|
0021| transmitted to the commissioners of the state corporation
|
0022| commission and the superintendent of insurance.
