0012| REQUESTING THAT THE LEGISLATIVE COUNCIL ESTABLISH A TASK FORCE

0013| TO STUDY AUTOMOBILE INSURANCE PROBLEMS AND PREMIUM RATES IN NEW
|
0014| MEXICO.

0016| WHEREAS, automobile insurance problems are prevalent
|
0017| throughout New Mexico; and
|
0018| WHEREAS, automobile insurance problems include the
|
0019| automobile insurance premium rates charged and the apparently
|
0020| low percentage of New Mexicans who have automobile insurance in
|
0021| compliance with the Mandatory Financial Responsibility Act; and
|
0022| WHEREAS, a number of options may be available to lower
|
0023| automobile insurance premium rates, increase the percentage of
|
0024| New Mexicans who are insured and otherwise provide for a fairer
|
0025| and more effective system to improve driver safety and
|
0001| compensate victims promptly and equitably for property and other
|
0002| damages sustained as a result of automobile accidents or
|
0003| operations; and
|
0004| WHEREAS, a study of automobile insurance problems and
|
0005| system operations in New Mexico and elsewhere would serve the
|
0006| public interest and could result in significant reforms being
|
0007| enacted into law;
|
0008| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0009| STATE OF NEW MEXICO that the legislative council be requested to
|
0010| establish a task force of legislators and interested persons
|
0011| representing consumer and other affected interests to study
|
0012| automobile insurance laws and operations in New Mexico and seek
|
0013| to determine why automobile insurance rates are at the level
|
0014| they are in New Mexico; investigate whether, and, if so, why,
|
0015| those rates are disproportionately high; assess what options are
|
0016| reasonably available to lower the rates; determine what
|
0017| percentage of New Mexicans are uninsured and what options may be
|
0018| pursued to decrease that percentage; consider what options are
|
0019| in general available to address automobile insurance problems in
|
0020| New Mexico, including the advantages and disadvantages of each;
|
0021| address concerns about competition in the marketplace,
|
0022| fraudulent practices and their impact on rates; and review how
|
0023| enforcement of effective automobile insurance laws can be
|
0024| achieved, including consideration of effective methods working
|
0025| in other states; and
|
0001| BE IT FURTHER RESOLVED that the task force report the
|
0002| results of its study to the legislative council by December 1,
|
0003| 1996; and
|
0004| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0005| transmitted to the co-chairmen of the legislative council, the
|
0006| speaker of the house of representatives and the president pro
|
0007| tempore of the senate.
