0012| REQUESTING THE LOCAL GOVERNMENT DIVISION OF THE DEPARTMENT OF

0013| FINANCE AND ADMINISTRATION TO CONDUCT A COMPREHENSIVE STUDY OF

0014| THE COSTS OF SPRAWL AND EVALUATION OF GROWTH MANAGEMENT

0015| ALTERNATIVES.

0017| WHEREAS, New Mexico is the sixth fastest-growing state in
|
0018| the country with a three and two-tenths percent population
|
0019| increase from 1993 to 1994; and
|
0020| WHEREAS, growth and development provide opportunities and
|
0021| challenges for the future of the land of enchantment; and
|
0022| WHEREAS, many of our decisions affecting growth and
|
0023| development are fragmented, inconsistent and contradict
|
0024| community-wide goals; and
|
0025| WHEREAS, piecemeal and fragmented development decisions
|
0001| engender unintended costs to the state and local government
|
0002| treasuries and unintended consequences that are long-term and
|
0003| often irreversible; and
|
0004| WHEREAS, sprawl changes our communities forever, imposing
|
0005| economic, social and environmental costs for all New Mexicans;
|
0006| and
|
0007| WHEREAS, coordinated planning can address the effects of
|
0008| growth, maximizing its benefits and minimizing its costs, while
|
0009| balancing the interests of rural and urban communities, public
|
0010| and private sectors and new and ancient cultures; and
|
0011| WHEREAS, planning and cooperation for quality development
|
0012| can integrate social values, market values and ecological values
|
0013| to guide us toward a healthy and sustainable future;
|
0014| WHEREAS, planning is critical to protecting property
|
0015| values, preventing nuisances and reducing public costs; and
|
0016| WHEREAS, New Mexico's planning and zoning statutes were
|
0017| first enacted in 1965 and have not been substantially revised
|
0018| since then;
|
0019| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0020| STATE OF NEW MEXICO that the local government division of the
|
0021| department of finance and administration be requested to perform
|
0022| a comprehensive evaluation of the costs of sprawl; and
|
0023| BE IT FURTHER RESOLVED that the following areas be
|
0024| specifically evaluated:
|
0025| A. the role and function of state, regional and
|
0001| local agencies in the planning and development process;
|
0002| B. land-use and planning laws as well as the
|
0003| procedural aspects of policy formulation and implementation;
|
0004| C. the fiscal costs to the state and local
|
0005| government treasuries of growth; and
|
0006| D. statutory land-use and planning reforms of other
|
0007| states, including Colorado, Georgia, Washington, Virginia,
|
0008| Maryland, Utah, Oregon, Florida, Vermont, Maine and Hawaii; and
|
0009| BE IT FURTHER RESOLVED that the local government division
|
0010| of the department of finance and administration be requested to
|
0011| report its findings and recommendations to the appropriate
|
0012| interim legislative committee by December 1, 1996; and
|
0013| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0014| transmitted to the secretary of finance and administration.
