0012|     REQUESTING THE MOTOR VEHICLE DIVISION NOT TO DISCLOSE SOCIAL

0013|     SECURITY NUMBERS ON DRIVER'S LICENSES AND INSTRUCTION PERMITS.

0015|       WHEREAS, social security numbers are currently printed on
    |
0016|     motor vehicle driver's licenses, commercial driver's licenses
    |
0017|     and instruction permits; and
    |
0018|       WHEREAS, social security numbers can be used to obtain
    |
0019|     credit in the form of cash, goods and services; and
    |
0020|       WHEREAS, the ready availability of a social security number
    |
0021|     on a driver's license and instruction permit increases the
    |
0022|     opportunity for fraudulent use of credit by affording
    |
0023|     unscrupulous persons access to information used to verify
    |
0024|     identity for credit purposes; and
    |
0025|       WHEREAS, social security numbers are not required by law to
    |
0001|     appear on driver's licenses and instruction permits; and
    |
0002|       WHEREAS, there are reports of consumer fraud occurring in
    |
0003|     New Mexico based on improper use of a consumer's social security
    |
0004|     number obtained from normal review of a consumer's driver's
    |
0005|     license for check cashing purposes; and
    |
0006|       WHEREAS, a number of other states have reportedly changed
    |
0007|     their practice and now delete social security numbers from
    |
0008|     driver's licenses precisely because of consumer fraud problems;
    |
0009|     and
    |
0010|       WHEREAS, the motor vehicle division of the department of
    |
0011|     taxation and revenue apparently has the authority under current
    |
0012|     law to change by regulation the current practice and not
    |
0013|     disclose social security numbers on driver's licenses and
    |
0014|     instruction permits; and
    |
0015|       WHEREAS, prohibiting the disclosure of social security
    |
0016|     numbers on driver's licenses and instruction permits does not
    |
0017|     prohibit the motor vehicle division from requesting and
    |
0018|     maintaining records of social security numbers for
    |
0019|     administrative and law enforcement purposes or from
    |
0020|     incorporating social security numbers in driver's licenses and
    |
0021|     instruction permits in a magnetic or other coded form that is
    |
0022|     not readable by the general public;
    |
0023|       NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0024|     STATE OF NEW MEXICO that the motor vehicle division of the
    |
0025|     taxation and revenue department be requested not to disclose
    |
0001|     social security numbers on driver's licenses, commercial
    |
0002|     driver's licenses and instruction permits; and
    |
0003|       BE IT FURTHER RESOLVED that copies of this memorial be
    |
0004|     transmitted to the governor, the secretary of taxation and
    |
0005|     revenue and the director of the motor vehicle division.
