0012|     REQUESTING THE LEGISLATIVE COUNCIL TO DIRECT AN APPROPRIATE
    |
0013|     JOINT LEGISLATIVE INTERIM COMMITTEE TO CONTINUE STUDIES OF WATER
    |
0014|     RESOURCES, RIGHTS AND REGULATION AND OF THE POTENTIAL
    |
0015|     RESTRUCTURING OF THE ELECTRIC UTILITY INDUSTRY.

0017|       WHEREAS, during 1995, the integrated water and resource
    |
0018|     planning committee studied, evaluated and investigated issues
    |
0019|     related to water resources, rights and regulation, as well as
    |
0020|     issues related to the potential restructuring of the electric
    |
0021|     power industry due to the infusion of competitive influences and
    |
0022|     factors into the industry; and 
    |
0023|       WHEREAS, numerous and vital concerns compel legislative
    |
0024|     attention and action with respect to the state's water rights,
    |
0025|     resources and regulation and further, the integrated water and
    |
0001|     resource planning committee has recommended its continuation
    |
0002|     with respect to water and its associated issues, matters and
    |
0003|     concerns; and
    |
0004|       WHEREAS, the integrated water and resource planning
    |
0005|     committee has directed the New Mexico public utility commission
    |
0006|     to monitor and evaluate the potential restructuring of the
    |
0007|     electric power industry, subject to legislative guidance,
    |
0008|     direction and oversight, and to report its findings, conclusions
    |
0009|     and recommendations to the legislature for approval and action,
    |
0010|     as necessary, before any proposed restructuring may be
    |
0011|     implemented; and
    |
0012|       WHEREAS, the integrated water and resource planning
    |
0013|     committee has further recommended its continuation with respect
    |
0014|     to the electric utility industry in order to retain and continue
    |
0015|     the knowledge, information and experience acquired by the
    |
0016|     committee in this area to better provide oversight, guidance and
    |
0017|     direction to the New Mexico public utility commission in its
    |
0018|     work with respect to any potential restructuring of the electric
    |
0019|     utility industry and to continue proper and full legislative
    |
0020|     attention to and oversight of the rapidly changing aspects of
    |
0021|     this industry nationwide;
    |
0022|       NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0023|     STATE OF NEW MEXICO that the legislative council direct an
    |
0024|     appropriate joint legislative interim committee to continue the
    |
0025|     work of the integrated water and resource planning committee to
    |
0001|     study and evaluate the state's water rights, resources and
    |
0002|     regulation and the potential restructuring of the electric
    |
0003|     utility industry; and 
    |
0004|       BE IT FURTHER RESOLVED that the appropriate joint
    |
0005|     legislative interim committee directed by the legislative
    |
0006|     council to study and evaluate the state's water rights,
    |
0007|     resources and regulation and the potential restructuring of the
    |
0008|     electric utility industry present its findings and
    |
0009|     recommendations to the first session of the forty-third
    |
0010|     legislature; and 
    |
0011|       BE IT FURTHER RESOLVED that copies of this memorial be sent
    |
0012|     to the president pro tempore of the senate, the speaker of the
    |
0013|     house of representatives and the members of the legislative
    |
0014|     council.
