0012| REQUESTING THE STATE LAND OFFICE TO CONTINUE ITS COMPREHENSIVE

0013| STUDY AND APPRAISAL REGARDING THE ACQUISITION AND MANAGEMENT OF
|
0014| UTE MOUNTAIN OR OTHER INTERESTS IN UTE MOUNTAIN IN TAOS COUNTY,
|
0015| NEW MEXICO.

0017| WHEREAS, because New Mexico is the eighth fastest-growing
|
0018| state in the nation in terms of population and because rural New
|
0019| Mexico is heavily impacted by development, those unique
|
0020| undeveloped areas that make this the "Land of Enchantment" are
|
0021| few in number and threatened with extinction; and
|
0022| WHEREAS, one very unique area, known as Ute mountain,
|
0023| located deep in northern New Mexico, has valuable ground water
|
0024| resources, wildlife habitat, scenic and recreational value and
|
0025| significant cultural and archaeological sites; and
|
0001| WHEREAS, one of the most valuable natural resources at Ute
|
0002| mountain is the ground water, which is estimated to supply
|
0003| twenty-five percent of the water to the Rio Grande between the
|
0004| Colorado line and the junction with Red river; and
|
0005| WHEREAS, the pristine and pure Ute mountain ground water
|
0006| system is sensitive and fractured, making it very susceptible to
|
0007| pollution from both point and nonpoint sources that could
|
0008| further contaminate the water used by thousands of New Mexicans
|
0009| who rely upon the Rio Grande; and
|
0010| WHEREAS, used annually as a wintering ground by large herds
|
0011| of deer and antelope and year round by raptors and many other
|
0012| species, the fifteen-thousand-acre Ute mountain qualifies as a
|
0013| true nature reserve and wilderness area with its values of
|
0014| naturalness and solitude; and
|
0015| WHEREAS, while both remote and wild, Ute mountain has had
|
0016| limited but continuous human contact for several thousand years,
|
0017| including grazing of livestock by early indigenous peoples and
|
0018| hiking, fishing and rafting by modern people on the adjacent Rio
|
0019| Grande; and
|
0020| WHEREAS, the citizens of New Mexico would benefit from the
|
0021| protection and preservation of Ute mountain in its natural
|
0022| state;
|
0023| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0024| STATE OF NEW MEXICO that the state land office continue its
|
0025| efforts to conduct an assessment and study of the preservation,
|
0001| management and public ownership of Ute mountain, or an interest
|
0002| in Ute mountain, and coordinate its activities as necessary with
|
0003| the property owner and any private and public sector land
|
0004| agencies; and
|
0005| BE IT FURTHER RESOLVED that the members of New Mexico's
|
0006| congressional delegation be requested to sponsor legislation
|
0007| authorizing the acquisition of Ute mountain for the public
|
0008| benefit through purchase or exchange by the bureau of land
|
0009| management; and
|
0010| BE IT FURTHER RESOLVED that the state land office be
|
0011| requested to report its findings to the first session of the
|
0012| forty-third legislature; and
|
0013| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0014| transmitted to the commissioner of public lands and to all
|
0015| members of New Mexico's congressional delegation.
