0012| REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO DIRECT THE

0013| APPROPRIATE COMMITTEE TO STUDY PRO BONO SERVICES BY ATTORNEYS.

0015| WHEREAS, access to legal services by a large segment of the
|
0016| population is constrained by the cost of legal services; and
|
0017| WHEREAS, the supreme court, in Gideon v. Wainwright,
|
0018| held that every defendant has a right to legal representation;
|
0019| and
|
0020| WHEREAS, this decision has placed a severe burden on
|
0021| taxpayers to guarantee adequate legal defense of indigent
|
0022| criminals; and
|
0023| WHEREAS, other citizens who have been hurt cannot seek
|
0024| redress through the courts because of the high costs of legal
|
0025| services; and
|
0001| WHEREAS, every citizen should be served and protected by
|
0002| the law; and
|
0003| WHEREAS, criminals have more access to legal representation
|
0004| than do most law-abiding citizens; and
|
0005| WHEREAS, ordinary citizens should have reasonable access to
|
0006| the law;
|
0007| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0008| STATE OF NEW MEXICO that the New Mexico legislative council be
|
0009| requested to direct the appropriate committee to study the issue
|
0010| of pro bono services, the extent of mandatory pro bono service
|
0011| by other states and access to the law by ordinary citizens and
|
0012| make recommendations to the legislature by December 1, 1996; and
|
0013| BE IT FURTHER RESOLVED that copies of this memorial be
|
0014| transmitted to the New Mexico legislative council.
