0012| REQUESTING THE OFFICE OF CULTURAL AFFAIRS AND THE LOCAL

0013| GOVERNMENT DIVISION OF THE DEPARTMENT OF FINANCE AND

0014| ADMINISTRATION TO COOPERATE IN DEVELOPING LEGISLATION TO EXTEND
|
0015| PROTECTION FOR TRADITIONAL HISTORIC COMMUNITIES TO ALL COUNTIES
|
0016| AND TO PROVIDE TRADITIONAL HISTORIC COMMUNITIES WITH THE
|
0017| AUTHORITY TO PRESERVE THEIR IDENTITIES AND HERITAGE AND TO PLAN
|
0018| FOR THEIR FUTURES.

0020| WHEREAS, traditional New Mexico land use and planning law
|
0021| deny residents of extraterritorial zones representation on
|
0022| municipal planning boards that make policy for extraterritorial
|
0023| zones; and
|
0024| WHEREAS, traditional historic communities close to
|
0025| municipalities feel threatened by annexation against their will;
|
0001| and
|
0002| WHEREAS, traditional historic communities have limited
|
0003| potential revenues, limiting the potential for municipal
|
0004| incorporation; and
|
0005| WHEREAS, there are about two hundred traditional historic
|
0006| communities statewide that are threatened by municipal expansion
|
0007| and loss of their historic and cultural identities;
|
0008| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0009| STATE OF NEW MEXICO that the office of cultural affairs and the
|
0010| local government division of the department of finance and
|
0011| administration be requested to cooperate in developing
|
0012| legislative proposals to extend the provisions in Section
|
0013| 3-7-1.1 NMSA 1978 for traditional historic communities to all
|
0014| counties; and
|
0015| BE IT FURTHER RESOLVED that the study include alternative
|
0016| mechanisms for traditional historic communities to preserve
|
0017| their identities and heritage and to plan for their own futures;
|
0018| and
|
0019| BE IT FURTHER RESOLVED that copies of this memorial be
|
0020| transmitted to the state cultural affairs officer and the
|
0021| secretary of finance and administration.
