0012| REQUESTING THE CREATION OF A TASK FORCE TO STUDY MANDATORY
|
0013| TRAINING OF AND EDUCATION OF HEALTH CARE PROVIDERS ON THE HUMAN
|
0014| IMMUNODEFICIENCY VIRUS AND OTHER INFECTIOUS DISEASES AND THE
|
0015| LAWS RELATIVE TO THEIR TREATMENT.

0017| WHEREAS, human immunodeficiency virus (HIV)-related illness
|
0018| is the leading cause of death among young adults twenty-five to
|
0019| forty-four years old; and
|
0020| WHEREAS, nearly one-half million Americans have AIDS, and
|
0021| approximately forty thousand new HIV infections occur each year
|
0022| in the United States; and
|
0023| WHEREAS, over one thousand two hundred New Mexicans have
|
0024| AIDS, and estimates are that at least twice that many
|
0025| individuals have been infected with the HIV virus; and
|
0001| WHEREAS, the second community-defined need for HIV services
|
0002| in New Mexico, as determined by the HIV coordinating council for
|
0003| the state, is professional education; and
|
0004| WHEREAS, from the perspective of many of New Mexico's
|
0005| smaller communities, New Mexicans continue to face unlawful
|
0006| discrimination by health care providers, including circumstances
|
0007| in which such professionals, on the basis of an individual's
|
0008| being HIV seropositive, decline to provide services ordinarily
|
0009| offered within the scope of the professional's practice and
|
0010| instead refer the individual to another comparable provider or
|
0011| provide a different level of care to the individual; and
|
0012| WHEREAS, federal and state laws exist to protect and
|
0013| promote the human and civil rights of people with disabilities,
|
0014| including people with HIV or AIDS;
|
0015| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0016| STATE OF NEW MEXICO that the department of health create a task
|
0017| force to study mandatory training of and education for health
|
0018| care providers concerning HIV or AIDS and other infectious
|
0019| diseases and applicable laws; and
|
0020| BE IT FURTHER RESOLVED that the task force be headed by the
|
0021| department of health and be comprised of representatives from
|
0022| the New Mexico medical society, board of medical examiners, New
|
0023| Mexico board of dental health care, New Mexico state board of
|
0024| nursing, New Mexico nurses association, New Mexico AIDS
|
0025| education and training center, HIV coordinating council,
|
0001| protection and advocacy system and consumers; and
|
0002| BE IT FURTHER RESOLVED that the task force report its
|
0003| findings to the governor and the appropriate legislative interim
|
0004| committee by December 1996; and
|
0005| BE IT FURTHER RESOLVED that copies of this memorial be
|
0006| transmitted to the following entities: the regulation and
|
0007| licensing department, secretary of health, New Mexico medical
|
0008| society, board of medical examiners, New Mexico board of dental
|
0009| health care, New Mexico state board of nursing, New Mexico
|
0010| nurses association, protection and advocacy system and HIV
|
0011| coordinating council.
