0012|     REQUESTING THE UNITED STATES DEPARTMENT OF ENERGY TO OPEN THE
    |
0013|     MANAGEMENT CONTRACT FOR LOS ALAMOS NATIONAL LABORATORY TO
    |
0014|     COMPETITIVE BIDDING AND ALLOW A CONSORTIUM THAT INCLUDES THE
    |
0015|     UNIVERSITY OF NEW MEXICO AND OTHER ENTITIES REPRESENTING NEW
    |
0016|     MEXICO'S INTERESTS TO SUBMIT BIDS FOR THE CONTRACT.
    |

    |
0018|       WHEREAS, the university of California has managed Los
    |
0019|     Alamos national laboratory (LANL) since 1943, earning as much as
    |
0020|     twenty-five million dollars ($25,000,000) annually from the
    |
0021|     contract; and
    |
0022|       WHEREAS, LANL is the fourth largest single employer in New
    |
0023|     Mexico, with more than nine thousand employees; and
    |
0024|       WHEREAS, new employees of LANL are required to pledge their
    |
0025|     allegiance to the state of California; and
    |
0001|       WHEREAS, the deputy director of LANL recently proclaimed
    |
0002|     that LANL and the community of Los Alamos are one in the same;
    |
0003|     and
    |
0004|       WHEREAS, LANL was founded in secrecy, isolation and
    |
0005|     privilege, and from this legacy evolved the community of Los
    |
0006|     Alamos; and
    |
0007|       WHEREAS, Los Alamos as a community was recently ranked
    |
0008|     among the most affluent communities in the nation in terms of
    |
0009|     education, employment and household income, yet neighboring
    |
0010|     communities surrounding Los Alamos remain among the poorest in
    |
0011|     the nation; and
    |
0012|       WHEREAS, the importance of LANL to New Mexico's economy is
    |
0013|     such that LANL's management should not be solely in the hands of
    |
0014|     an organization, the university of California, whose financial
    |
0015|     interests are clearly independent of the welfare of New Mexico;
    |
0016|     and
    |
0017|       WHEREAS, many employees of LANL and residents of New Mexico
    |
0018|     believe the management of LANL is insensitive to the needs of
    |
0019|     New Mexico; and
    |
0020|       WHEREAS, New Mexico is largely populated by people of
    |
0021|     Spanish and Native American descent, and the university of 
    |
0022|     California, as indicated by its repudiation of affirmative
    |
0023|     action on July 20, 1995, has shown disregard and indifference
    |
0024|     for concerns of minorities in general; and
    |
0025|       WHEREAS, the current LANL restructuring plan reflects
    |
0001|     disregard and indifference towards New Mexicans in particular,
    |
0002|     since most employees in the recent layoffs were native New
    |
0003|     Mexicans; and
    |
0004|       WHEREAS, three university of California panels have
    |
0005|     previously challenged the appropriateness of the university of
    |
0006|     California's continued management of LANL, namely the 1970
    |
0007|     Zinner report, the 1978 Gerberding report and the 1989 Jendresen
    |
0008|     report; and
    |
0009|       WHEREAS, the state of New Mexico might earn as much as
    |
0010|     fifteen to twenty million dollars ($15,000,000 to $20,000,000)
    |
0011|     in management fees as a member of a management consortium, a
    |
0012|     large sum considering the state's current budget problems; and
    |
0013|       WHEREAS, the university of New Mexico has imminent
    |
0014|     scientific and administrative capabilities reflected by the
    |
0015|     calibre of its faculty in the engineering school, the
    |
0016|     engineering research institute, the Robert O. Anderson school of
    |
0017|     business and other science- and management-related departments;
    |
0018|     and
    |
0019|       WHEREAS, a consortium composed of the university of
    |
0020|     California, the university of New Mexico and perhaps expertise
    |
0021|     from other New Mexico-based institutions might strengthen LANL's
    |
0022|     role in the nation's scientific and defense community, serve the
    |
0023|     economic needs of northern New Mexico and stimulate greater
    |
0024|     opportunities for technology transfer and business spinoffs
    |
0025|     throughout the state's economy;
    |
0001|       NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0002|     STATE OF NEW MEXICO that the United States department of energy
    |
0003|     be requested to open the management contract of LANL to
    |
0004|     competitive bidding when the contract expires in 1997; and
    |
0005|       BE IT FURTHER RESOLVED that the university of New Mexico be
    |
0006|     requested to negotiate with the university of California and
    |
0007|     other New Mexico institutions to form a consortium to bid on the
    |
0008|     LANL management contract; and
    |
0009|       BE IT FURTHER RESOLVED that copies of this memorial be
    |
0010|     transmitted to the secretary of energy, the president of the
    |
0011|     university of New Mexico, the chancellor of the university of
    |
0012|     California and New Mexico's congressional delegation.
