0012|     REQUESTING THE COURTS, CORRECTIONS AND CRIMINAL JUSTICE

0013|     COMMITTEE TO STUDY RECENT COURT DECISIONS NULLIFYING SECTION

0014|     42A-1-26 NMSA 1978 (BEING LAWS 1981, CHAPTER 125, SECTION 22)

0015|     AND RECOMMEND LEGISLATION TO ACHIEVE THE LEGISLATURE'S INTENT.

0017|       WHEREAS, the fifth amendment of the United States
    |
0018|     constitution says "nor shall private property be taken for
    |
0019|     public use, without just compensation"; and
    |
0020|       WHEREAS, Section 42A-1-26 NMSA 1978 provides for
    |
0021|     compensation of fair market value of property lost as a result
    |
0022|     of condemnation; and
    |
0023|       WHEREAS, courts have ignored the express intent of this
    |
0024|     section of the NMSA 1978; 
    |
0025|       NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0001|     STATE OF NEW MEXICO that the courts, corrections and criminal
    |
0002|     justice committee be requested to study the issues regarding
    |
0003|     Section 42A-1-26 NMSA 1978 to determine why the courts have
    |
0004|     rules against the section and to recommend legislation by
    |
0005|     December 1, 1996 to correct any deficiencies in the law so as to
    |
0006|     carry out the legislature's intent pursuant to Section 42A-1-26
    |
0007|     NMSA 1978; and
    |
0008|       BE IT FURTHER RESOLVED that copies of this memorial be
    |
0009|     transmitted to the courts, corrections and criminal justice
    |
0010|     committee.
