0012| REQUESTING THE HUMAN SERVICES DEPARTMENT TO SUPPLEMENT CURRENT

0013| AVAILABLE MEDICAID SERVICES TO INCLUDE PROVISION OF CERTAIN
|
0014| SERVICES AVAILABLE TO THE STATE PURSUANT TO THE HOME- AND
|
0015| COMMUNITY-BASED WAIVER PROVISIONS OF THE FEDERAL REGULATIONS
|
0016| GOVERNING THE MEDICAID PROGRAM.

0018| WHEREAS, the federal medicaid program regulations provide
|
0019| for a state to apply for a home- and community-based waiver in
|
0020| its medicaid program to enable the state to provide certain
|
0021| additional services to medicaid beneficiaries; and
|
0022| WHEREAS, the aforesaid waiver provisions include as
|
0023| additional services specialized medical equipment and supplies
|
0024| and environmental modifications for persons needing those
|
0025| services to:
|
0001| A. remain as independent as possible in their daily
|
0002| living situations;
|
0003| B. increase their abilities to perform activities of
|
0004| daily living; and
|
0005| C. perceive, control or communicate with the
|
0006| environment in which they live; and
|
0007| WHEREAS, even though federal matching funds are available
|
0008| for these eligible services if a state chooses to apply for a
|
0009| waiver to modify its state plan, the human services department
|
0010| has chosen not to do so; and
|
0011| WHEREAS, making the indicated services available to
|
0012| eligible individuals in many cases would substantially decrease
|
0013| the possibility of greater costs of medical assistance for those
|
0014| individuals in the future because the services are designed to
|
0015| counteract the deteriorating effect upon such individuals of the
|
0016| inability to communicate effectively with persons in their homes
|
0017| and communities;
|
0018| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0019| STATE OF NEW MEXICO that the human services department take the
|
0020| necessary action to implement provisions of the available
|
0021| medicaid home- and community-based waiver to enable New Mexico's
|
0022| medicaid program to provide specialized medical equipment and
|
0023| supplies and environmental modification services to those
|
0024| individuals who would be eligible for the services pursuant to
|
0025| the federal regulations governing granting of the waiver; and
|
0001| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0002| transmitted to the governor and the secretary of human services.
