0012|     PROPOSING AN AMENDMENT TO ARTICLE 4 OF THE CONSTITUTION OF NEW

0013|     MEXICO TO LIMIT THE TERMS OF STATE LEGISLATORS.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|       Section 1.  It is proposed to amend Article 4, Section 4 of
    |
0017|     the constitution of New Mexico to read:
    |
0018|       "Members of the legislature shall be elected as follows: 
    |
0019|     <s>[those senators from Bernalillo, Chaves, Curry, DeBaca, Grant,
</s>    |
<s></s>0020| <s>    Lea, Lincoln, Luna, Sandoval, San Juan, San Miguel, Socorro,
</s>    |
<s></s>0021| <s>    Taos, Torrance, Union and Valencia counties for a term of six
</s>    |
<s></s>0022| <s>    years starting January 1, 1961, and after serving such terms
</s>    |
<s></s>0023| <s>    shall be elected for a term of four years thereafter; those
</s>    |
<s></s>0024| <s>    senators from all other counties for the terms]</s> <u>senators for
</u>    |
<u></u>0025| <u>    terms</u> of four years, and members of the house of
    |
0001|     representatives for <s>[a term]</s> <u>terms</u> of two years.  <s>[They]</s>

0002|     <u>Excluding service in the legislature prior to the first session
</u>    |
<u></u>0003| <u>    of the forty-third legislature, or an appointment to a vacant
</u>    |
<u></u>0004| <u>    office, no legislator shall serve more than three consecutive
</u>    |
<u></u>0005| <u>    terms in the senate and six consecutive terms in the house of
</u>    |
<u></u>0006| <u>    representatives.  Senators and members of the house of
</u>    |
<u></u>0007| <u>    representatives</u> shall be elected on the day provided by law for
    |
0008|     holding the general election of state officers or
    |
0009|     representatives in congress.  If a vacancy occurs in the office
    |
0010|     of senator or member of the house of representatives, for any
    |
0011|     reason, the county commissioners of the county wherein the
    |
0012|     vacancy occurs shall fill such vacancy by appointment.
    |
0013|       Such legislative appointments as provided in this section
    |
0014|     shall be for a term ending on December 31, subsequent to the
    |
0015|     next succeeding general election."
    |
0016|       Section 2.  The amendment proposed by this resolution shall
    |
0017|     be submitted to the people for their approval or rejection at
    |
0018|     the next general election or at any special election prior to
    |
0019|     that date which may be called for that purpose.
