Section 35-6-1 NMSA 1978 (being Laws 1968, | 0008| Chapter 62, Section 92, as amended) is amended to read: | 0009| "35-6-1. MAGISTRATE COSTS--SCHEDULE--DEFINITION OF | 0010| "CONVICTED".-- | 0011| A. Magistrate judges, including metropolitan | 0012| court judges, shall collect the following costs: | 0013| Docket fee, criminal actions under Section 29-5-1 NMSA | 0014| 1978 . . . . . . . . . . . . . . . . . . . . $ 1.00 | 0015| Docket fee, to be collected prior to docketing any other | 0016| criminal action, except as provided in Subsection B | 0017| of Section 35-6-3 NMSA 1978. . . . . . . . . 20.00 | 0018| Docket fee, ten dollars ($10.00) of which shall be | 0019| deposited in the court automation fund, to be | 0020| collected prior to docketing any civil action, | 0021| except | 0022| as provided in Subsection A of Section 35-6-3 NMSA | 0023| 1978 . . . . . . . . . . . . . . . . . . . . 47.00 | 0024| Jury fee, to be collected from the party demanding trial | 0025| by jury in any civil action at the time the demand | 0001| is | 0002| filed or made. . . . . . . . . . . . . . . . 25.00 | 0003| Copying fee, for making and certifying copies of any | 0004| records in the court, for each page copied by | 0005| photographic process . . . . . . . . . . . . . .50 | 0006| Copying fee, for computer-generated or electronically | 0007| transferred copies, per page . . . . . . . . . 1.00. | 0008| Proceeds from this copying fee shall be transferred | 0009| to the administrative office of the courts for | 0010| deposit in the court automation fund. Except as | 0011| otherwise specifically provided by law, docket fees | 0012| shall be paid into the general fund. | 0013| B. Except as otherwise provided by law, no other | 0014| costs or fees shall be charged or collected in the magistrate | 0015| or metropolitan court. | 0016| C. The magistrate or metropolitan court may grant | 0017| free process to any party in any civil proceeding or special | 0018| statutory proceeding upon a proper showing of indigency. The | 0019| magistrate or metropolitan court may deny free process if it | 0020| finds that the complaint on its face does not state a cause | 0021| of action. | 0022| D. As used in this subsection, "convicted" means | 0023| the defendant has been found guilty of a criminal charge by | 0024| the magistrate or metropolitan judge, either after trial, a | 0025| plea of guilty or a plea of nolo contendere. Magistrate | 0001| judges, including metropolitan court judges, shall collect | 0002| the following costs: | 0003| (1) corrections fee, to be collected upon | 0004| conviction from persons convicted of violating any provision | 0005| of the Motor Vehicle Code involving the operation of a motor | 0006| vehicle, convicted of a crime constituting a misdemeanor or a | 0007| petty misdemeanor or convicted of violating any ordinance | 0008| that may be enforced by the imposition of a term of | 0009| imprisonment | 0010| . . . . . . . . . . . . . . . . . . . . . . . . $10.00; | 0011| (2) court automation fee, to be collected | 0012| upon conviction from persons convicted of violating any | 0013| provision of the Motor Vehicle Code involving the operation | 0014| of a motor vehicle, convicted of a crime constituting a | 0015| misdemeanor or a petty misdemeanor or convicted of violating | 0016| any ordinance that may be enforced by the imposition of a | 0017| term of imprisonment . . . . . . . . . . . . . . . . . . . 10.00; | 0018| (3) traffic safety fee, to be collected upon | 0019| conviction from persons convicted of violating any provision | 0020| of the Motor Vehicle Code involving the operation of a motor | 0021| vehicle. . . . . . . . . . . . . . . . . . . . . 3.00; | 0022| (4) judicial education fee, to be collected | 0023| upon conviction from persons convicted of operating a motor | 0024| vehicle in violation of the Motor Vehicle Code, convicted of | 0025| a crime constituting a misdemeanor or a petty misdemeanor or | 0001| convicted of violating any ordinance punishable by a term of | 0002| imprisonment . . . . . . . . . . . . . . . . . . . . . 1.00; | 0003| and | 0004| (5) brain injury services fee, to be | 0005| collected upon conviction from persons convicted of violating | 0006| any provision of the Motor Vehicle Code involving the | 0007| operation of a motor vehicle . . . . . . . . . . . . . | 0008| 5.00. | 0009| E. Metropolitan court judges shall collect as | 0010| costs a mediation fee not to exceed five dollars ($5.00) for | 0011| the docketing of small claims and criminal actions specified | 0012| by metropolitan court rule. Proceeds of the mediation fee | 0013| shall be deposited into the metropolitan court mediation | 0014| fund." | 0015| Section 2. Section 66-8-116.3 NMSA 1978 (being Laws | 0016| 1989, Chapter 320, Section 5, as amended) is amended to read: | 0017| "66-8-116.3. PENALTY ASSESSMENT | 0018| MISDEMEANORS--ADDITIONAL FEES.--In addition to the penalty | 0019| assessment established for each penalty assessment | 0020| misdemeanor, there shall be assessed: | 0021| A. ten dollars ($10.00) to help defray the costs | 0022| of local government corrections; | 0023| B. a court automation fee of ten dollars | 0024| ($10.00); | 0025| C. a traffic safety fee of three dollars ($3.00), | 0001| which shall be credited to the traffic safety education and | 0002| enforcement fund; | 0003| D. a judicial education fee of one dollar | 0004| ($1.00), which shall be credited to the judicial education | 0005| fund; and | 0006| E. a brain injury services fee of five dollars | 0007| ($5.00), which shall be credited to the brain injury services | 0008| fund." | 0009| Section 3. Section 66-8-119 NMSA 1978 (being Laws 1968, | 0010| Chapter 62, Section 159, as amended) is amended to read: | 0011| "66-8-119. PENALTY ASSESSMENT REVENUE--DISPOSITION.-- | 0012| A. The division shall remit all penalty | 0013| assessment receipts, except receipts collected pursuant to | 0014| Subsections A through E of Section 66-8-116.3 NMSA 1978, to | 0015| the state treasurer for credit to the general fund. | 0016| B. The division shall remit all penalty | 0017| assessment fee receipts collected pursuant to: | 0018| (1) Subsection A of Section 66-8-116.3 NMSA | 0019| 1978 to the state treasurer for credit to the local | 0020| government corrections fund; | 0021| (2) Subsection B of Section 66-8-116.3 NMSA | 0022| 1978 to the state treasurer for credit to the court | 0023| automation fund; | 0024| (3) Subsection C of Section 66-8-116.3 NMSA | 0025| 1978 to the state treasurer for credit to the traffic safety | 0001| education and enforcement fund; | 0002| (4) Subsection D of Section 66-8-116.3 NMSA | 0003| 1978 to the state treasurer for credit to the judicial | 0004| education fund; and | 0005| (5) Subsection E of Section 66-8-116.3 NMSA | 0006| 1978 to the state treasurer for credit to the brain injury | 0007| services fund." | 0008| Section 4. BRAIN INJURY SERVICES FUND CREATED.-- | 0009| A. There is created in the state treasury the | 0010| "brain injury services fund". The fund shall be invested in | 0011| accordance with the provisions of Section 6-10-10 NMSA 1978, | 0012| and all income earned on the fund shall be credited to the | 0013| fund. | 0014| B. The brain injury services fund shall be used | 0015| to institute and maintain a statewide brain injury services | 0016| program designed to increase the independence of persons with | 0017| traumatic brain injuries. | 0018| C. The department of health shall adopt all | 0019| rules, regulations and policies necessary to administer a | 0020| statewide brain injury services program. The department of | 0021| health shall coordinate with and seek advice from the brain | 0022| injury advisory council to ensure that the statewide brain | 0023| injury services program is appropriate for persons with | 0024| traumatic brain injuries. | 0025| D. All money credited to the brain injury | 0001| services fund shall be appropriated to the department of | 0002| health for the purpose of carrying out the provisions of this | 0003| section and shall not revert to the general fund. | 0004| Section 5. EFFECTIVE DATE.--The effective date of the | 0005| provisions of this act is July 1, 1997. | 0006| |
