0003| THE NMSA 1978 TO AUTHORIZE RESIDENT STUDENT STATUS FOR ATHLETIC
|
0004| SCHOLARSHIP RECIPIENTS.

0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0007| Section 1. Section 21-1-2 NMSA 1978 (being Laws 1970, Chapter 9, Section 1, as
|
0008| amended) is amended to read:
|
0009| "21-1-2. MATRICULATION AND TUITION FEES.--
|
0010| A. Except as otherwise provided in this section and in Section 21-1-4.3 NMSA
|
0011| 1978, the boards of regents of the university of New Mexico, New Mexico state university, New
|
0012| Mexico highlands university, western New Mexico university, eastern New Mexico university,
|
0013| New Mexico military institute, New Mexico institute of mining and technology and New Mexico
|
0014| junior college shall establish and charge matriculation fees and tuition fees as follows:
|
0015| (1) each student shall be charged a matriculation fee of not less than five
|
0016| dollars ($5.00) upon enrolling in each institution;
|
0017| (2) each student who is a resident of New Mexico shall be charged a
|
0018| tuition fee of not less than twenty dollars ($20.00) a year;
|
0019| (3) each student who is not a resident of New Mexico shall be charged a
|
0020| tuition fee of not less than fifty dollars ($50.00) a year;
|
0021| (4) each student shall be charged a tuition fee of not less than ten dollars
|
0022| ($10.00) for each summer session; and
|
0023| (5) each student may be charged a tuition fee for extension courses.
|
0024| B. Except as otherwise provided in this section and in Section 21-1-4.3 NMSA
|
0025| 1978, the board of regents of northern New Mexico state school shall establish and charge each
|
0001| student a matriculation fee and a tuition fee.
|
0002| C. The board of regents of each institution may establish and grant gratis
|
0003| scholarships to students who are residents of New Mexico in an amount not to exceed the
|
0004| matriculation fee or tuition and fees, or both. Except as provided in Section 21-1-4.3 NMSA
|
0005| 1978, the number of scholarships established and granted shall not exceed three percent of the
|
0006| preceding fall semester enrollment in each institution and shall not be established and granted for
|
0007| summer sessions. The president of each institution shall select and recommend to the board of
|
0008| regents of his institution, as recipients of scholarships, students who possess good moral
|
0009| character and satisfactory initiative, scholastic standing and personality. At least thirty-three and
|
0010| one-third percent of the gratis scholarships established and granted by each board of regents each
|
0011| year shall be granted on the basis of financial need.
|
0012| D. The board of regents of each institution set out in this subsection may establish
|
0013| and grant, in addition to those scholarships provided for in Subsection C of this section, athletic
|
0014| scholarships for tuition and fees. In no event shall the board of regents of any institution be
|
0015| allowed to award scholarships for tuition and fees for more than the number of athletic
|
0016| scholarships set out in this subsection and in no event shall more than seventy-five percent of the
|
0017| scholarships granted be for out-of-state residents:
|
0018| (1) the board of regents of the university of New Mexico may grant up to
|
0019| two hundred ninety-three athletic scholarships;
|
0020| (2) the board of regents of New Mexico state university may grant up to
|
0021| two hundred seventy athletic scholarships;
|
0022| (3) the boards of regents of New Mexico highlands university, eastern
|
0023| New Mexico university and western New Mexico university may each grant up to one hundred
|
0024| forty athletic scholarships; and
|
0025| (4) the board of regents of New Mexico junior college may grant up to
|
0001| fifty-two athletic scholarships.
|
0002| E. In the event that the number of athletic scholarships exceeds the number of
|
0003| athletic scholarships permitted that institution by regulations and bylaws of the national
|
0004| collegiate athletic association or the national association of intercollegiate athletics of which that
|
0005| institution is a member, the appropriate board of regents shall reduce the number of authorized
|
0006| tuition scholarships to comply with association rules and regulations.
|
0007| F. Matriculation fees and tuition fees shall be fixed and made payable as directed
|
0008| by the board of regents of each institution, collected by the officers of each institution and
|
0009| accounted for as are other funds of the institutions. Matriculation fees shall be charged only once
|
0010| for each institution in which a student enrolls."
|
0011| Section 2. Section 21-1-3 NMSA 1978 (being Laws 1970, Chapter 47, Section 1, as
|
0012| amended) is amended to read:
|
0013| "21-1-3. STATE EDUCATIONAL INSTITUTIONS--RESIDENT STUDENTS.--
|
0014| A. For the purpose of tuition payment at the resident student rates at state
|
0015| educational institutions, as defined in Article 12, Section 11 of the constitution of New Mexico,
|
0016| "resident student" includes:
|
0017| (1) any person not otherwise entitled to claim residence who is a member
|
0018| of the armed forces of the United States assigned to active duty within the exterior boundaries of
|
0019| this state; and
|
0020| (2) the spouse or dependent child of any person who qualifies under
|
0021| Paragraph (1) of this subsection.
|
0022| B. Assignment to active duty within the exterior boundaries of this state may be
|
0023| established by a certificate of assignment from the commanding officer of the person so assigned.
|
0024| C. For the purpose of tuition payment at resident student rates at New Mexico
|
0025| highlands university, "resident student" may include any person who is a Native American and a
|
0001| citizen of the United States.
|
0002| D. For the purposes of tuition payment and budget and revenue calculations, the
|
0003| board of regents of any post-secondary, state educational institution, as defined in Article 12,
|
0004| Section 11 of the constitution of New Mexico, may determine that "resident student" includes
|
0005| any Texas resident who resides within a one hundred thirty-five mile radius of that institution.
|
0006| E. For the purpose of tuition payment and budget and revenue calculations,
|
0007| "resident student" includes any student receiving an athletic scholarship from a
|
0008| post-secondary educational institution set forth in Article 12, Section 11 of the constitution
|
0009| of New Mexico."
