0001| AN ACT | 0002| RELATING TO EDUCATION; AMENDING A SECTION OF THE PUBLIC SCHOOL CODE | 0003| PERTAINING TO STUDENT PARTICIPATION IN INTERSCHOLASTIC EXTRACURRICULAR | 0004| ACTIVITIES. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. Section 22-12-2.1 NMSA 1978 (being Laws 1986, Chapter | 0008| 33, Section 27, as amended) is amended to read: | 0009| "22-12-2.1. INTERSCHOLASTIC EXTRACURRICULAR ACTIVITIES--STUDENT | 0010| PARTICIPATION.-- | 0011| A. A student shall have a 2.0 grade point average on a 4.0 | 0012| scale, or its equivalent, either cumulatively or for the grading | 0013| period immediately preceding participation, in order to be eligible to | 0014| participate in any interscholastic extracurricular activity. For | 0015| purposes of this section, "grading period" is a period of time not | 0016| less than six weeks. The provisions of this subsection shall not | 0017| apply to students receiving moderate to maximum special education | 0018| services. | 0019| B. No student shall be absent from school for | 0020| school-sponsored interscholastic extracurricular activities in excess | 0021| of fifteen days per semester, and no class may be missed in excess of | 0022| fifteen times per semester. | 0023| C. The provisions of Subsections A and B of this section | 0024| apply only to interscholastic extracurricular activities. | 0025| D. The state superintendent may issue a waiver relating to | 0001| the number of absences for participation in any state or national | 0002| competition. The state superintendent shall develop a procedure for | 0003| petitioning cumulative provision eligibility cases, similar to other | 0004| eligibility situations. | 0005| E. Student standards for participation in | 0006| interscholastic extracurricular activities shall be applied | 0007| beginning with a student's academic record in grade nine." |
