0001| AN ACT | 0002| RELATING TO CRIMES; DEFINING UNLAWFUL CARRYING OF A DEADLY WEAPON IN A | 0003| STATE OR JUDICIAL BUILDING; PROVIDING A PENALTY; ENACTING A NEW | 0004| SECTION OF THE NMSA 1978. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. A new Section 30-7-2.4 NMSA 1978 is enacted to read: | 0008| "30-7-2.4 UNLAWFUL CARRYING OF A DEADLY WEAPON IN A STATE OR | 0009| JUDICIAL BUILDING.-- | 0010| A. Unlawful carrying of a deadly weapon in a state or | 0011| judicial building consists of carrying a deadly weapon in a state or | 0012| judicial building by a person other than: | 0013| (1) peace officers in the lawful discharge of their | 0014| duties; | 0015| (2) federal or tribal law enforcement personnel in | 0016| the lawful discharge of their duties; | 0017| (3) state or federal military personnel in the lawful | 0018| discharge of their duties; | 0019| (4) private security personnel hired by or under | 0020| contract with the state or a local public body to provide armed | 0021| security; | 0022| (5) a person who possesses and transports weapons | 0023| into a court of law, at the direction of the court or prosecuting | 0024| attorney, for use as evidence; | 0025| (6) a person who owns, resides in or is otherwise in | 0001| legal possession of any portion of a state or judicial building not | 0002| owned or leased by the state or a local public body or a client, | 0003| customer or patron of that person; provided, that a client, customer | 0004| or patron of that person shall not enter that portion of a state or | 0005| judicial building that is owned or leased by the state or a local | 0006| public body; | 0007| (7) private uniformed security personnel under | 0008| written contract to provide armed security for the protection of the | 0009| property of a person who owns, resides in or is otherwise in legal | 0010| possession of any portion of a state or judicial building not owned or | 0011| leased by the state or a local public body; | 0012| (8) a person conducting or participating in a | 0013| program, class or other activity sanctioned by the state or a local | 0014| public body regarding lawful carrying of a deadly weapon; or | 0015| (9) a person in a motor vehicle in a parking area | 0016| within a state or judicial building, provided that the deadly weapon | 0017| remains in the motor vehicle. | 0018| B. As used in this section: | 0019| (1) "state" means the state of New Mexico and any of | 0020| its branches, agencies, departments, boards, commissions, | 0021| instrumentalities and institutions, including higher education | 0022| institutions; | 0023| (2) "local public body" means a county or | 0024| municipality within the state of New Mexico, including any of its | 0025| branches, agencies, departments, boards, commissions, | 0001| instrumentalities and institutions; and | 0002| (3) "state or judicial building" means a building or | 0003| part of a building, in which: | 0004| (a) state activities are regularly conducted | 0005| under the supervision of state management personnel; or | 0006| (b) judicial activities are regularly conducted, | 0007| including courtrooms, judge's chambers, witness rooms, jury | 0008| deliberation rooms, court clerk's offices and prisoner holding cells. | 0009| C. Whoever commits unlawful carrying of a deadly weapon in | 0010| a state or judicial building is guilty of a fourth degree felony. | 0011| D. Written notice of the provisions of this section shall | 0012| be posted conspicuously at each public entrance to a state or judicial | 0013| building by the person with administrative responsibility for that | 0014| building." | 0015| Section 2. EFFECTIVE DATE.--The effective date of the | 0016| provisions of this act is July 1, 1997. |
